PARÁGRAFO. — El vehículo se encuentra registrado en el Registro Único Nacional de Tránsito (RUNT) a nombre de EL/LA COMODANTE. La entrega en comodato no implica transferencia de dominio ni requiere cambio de titularidad en la licencia de tránsito (Art. 47, Ley 769 de 2002).

TERCERA. — FINALIDAD Y USO PERMITIDO

EL/LA COMODATARIO usará el vehículo exclusivamente para la siguiente finalidad: [Loan Purpose], conforme al Artículo 2205 del Código Civil. El uso del vehículo para fines distintos a los aquí estipulados constituirá abuso y dará derecho a EL/LA COMODANTE a exigir la devolución inmediata (Art. 2206 C.C.).

CUARTA. — DURACIÓN

El presente comodato tendrá vigencia desde el [Loan Start Date] hasta el [Loan End Date]. Al vencimiento del plazo, EL/LA COMODATARIO deberá restituir el vehículo en las mismas condiciones en que lo recibió, salvo el desgaste normal por el uso convenido (Art. 2211 C.C.).

PARÁGRAFO. — EL/LA COMODANTE podrá exigir la restitución anticipada del vehículo en caso de necesidad urgente e imprevista, conforme al Artículo 2212 del Código Civil.

QUINTA. — OBLIGACIONES DEL COMODATARIO

EL/LA COMODATARIO se obliga a:

a) Conservar el vehículo con la diligencia de un buen padre de familia (Art. 2203 C.C.).

b) Usar el vehículo exclusivamente para la finalidad pactada en la cláusula tercera.

c) Mantener vigentes los documentos de circulación del vehículo: SOAT, revisión técnico-mecánica y licencia de tránsito.

d) Asumir los gastos ordinarios de conservación: combustible, lavado, y mantenimiento preventivo básico.

e) Responder por toda pérdida o deterioro causado por su culpa, incluso culpa leve (Art. 2204 C.C.).

f) No ceder ni prestar el vehículo a terceros sin autorización escrita de EL/LA COMODANTE (Art. 2208 C.C.).

g) Cumplir las normas de tránsito del Código Nacional de Tránsito (Ley 769 de 2002) y asumir las multas (comparendos) que se generen durante el período de préstamo.

h) Restituir el vehículo al vencimiento del plazo o cuando EL/LA COMODANTE lo solicite conforme a la ley.

SEXTA. — MANTENIMIENTO Y SEGUROS

EL/LA COMODATARIO asumirá los gastos ordinarios de conservación conforme al Artículo 2213 del Código Civil. Los gastos extraordinarios — reparaciones mayores no causadas por culpa del comodatario — serán asumidos por EL/LA COMODANTE como propietario/a del vehículo.

SÉPTIMA. — RESPONSABILIDAD CIVIL

EL/LA COMODATARIO será responsable de los daños causados a terceros durante el uso del vehículo, conforme a la doctrina de actividad peligrosa (Art. 2356 C.C.) y se obliga a mantener indemne a EL/LA COMODANTE frente a reclamaciones de terceros derivadas del uso del vehículo durante la vigencia del presente contrato.

EL/LA COMODATARIO responderá por las multas de tránsito (comparendos), inmovilizaciones y sanciones impuestas durante el período de préstamo conforme a la Ley 1383 de 2010 y el Código Nacional de Tránsito.

OCTAVA. — TERMINACIÓN

El presente contrato terminará por:

a) Vencimiento del plazo pactado.

b) Mutuo acuerdo de las partes.

c) Necesidad urgente e imprevista de EL/LA COMODANTE (Art. 2212 C.C.).

d) Uso indebido o abuso del vehículo por parte de EL/LA COMODATARIO (Art. 2206 C.C.).

e) Incumplimiento de las obligaciones establecidas en este contrato.

f) Fallecimiento de EL/LA COMODATARIO (Art. 2209 C.C.).

NOVENA. — LEY APLICABLE Y JURISDICCIÓN

El presente contrato se rige por los Artículos 2200 a 2220 del Código Civil colombiano y las disposiciones aplicables de la Ley 769 de 2002 (Código Nacional de Tránsito). Las controversias se someterán al Juzgado Civil Municipal o Juzgado Civil del Circuito competente conforme a las reglas de cuantía del Código General del Proceso (Ley 1564 de 2012), previa conciliación ante un centro de conciliación autorizado conforme a la Ley 640 de 2001.
