Quienes celebran el presente Acuerdo de Préstamo Personal (Mutuo) conforme a los artículos 2221 a 2235 del Código Civil colombiano y el artículo 1602 del mismo Código.

SEGUNDA. — OBJETO: ENTREGA DEL PRÉSTAMO

El Prestamista entrega en calidad de mutuo al Prestatario la suma de [Loan Amount COP], mediante [Disbursement Date].

El Prestatario declara recibir a su entera satisfacción dicho monto y se obliga a restituirlo con los intereses pactados en los términos del presente acuerdo.

TERCERA. — INTERESES

3.1. Interés remuneratorio: El préstamo devengará intereses a una tasa de [Interest Rate], inferior a la tasa de usura vigente certificada por la Superintendencia Financiera de Colombia (SFC) conforme a la Ley 45 de 1990, artículo 68. Cobrar intereses superiores a la tasa de usura vigente constituye el delito tipificado en el artículo 305 del Código Penal colombiano (Ley 599 de 2000).

3.2. Interés moratorio: En caso de mora en el pago de cualquier cuota, el Prestatario pagará intereses moratorios a la tasa de [Default Interest Rate], conforme al artículo 1 de la Ley 1555 de 2012. Queda expresamente prohibido el anatocismo (interés sobre interés) en los términos del artículo 2235 del Código Civil.

CUARTA. — PLAZO Y AMORTIZACIÓN

4.1. El Prestatario se obliga a devolver el capital e intereses en un plazo de [Loan Term], conforme al siguiente calendario de pagos:

SÉPTIMA. — LEY APLICABLE Y RESOLUCIÓN DE CONTROVERSIAS

El presente acuerdo se rige por los artículos 2221 a 2235 del Código Civil colombiano y el artículo 1602 del mismo Código. Toda controversia será resuelta mediante: [Dispute Resolution].
