What Is a Return to Work Plan After Accident Colombia (Plan de Retorno al Trabajo)?

A Return to Work Plan after Accident Colombia (Plan de Retorno al Trabajo) is a structured document that establishes the graduated process by which a worker who suffered a workplace accident (accidente de trabajo) or occupational disease (enfermedad laboral) reintegrates into the workforce following their medical recovery or stabilization. The Plan de Retorno operationalizes the rehabilitation and reintegration obligations established in Decreto 1072 de 2015 (Decreto Único Reglamentario del Sector Trabajo) and coordinates the roles of the employer (empleador), the ARL (Administradora de Riesgos Laborales), the EPS (Entidad Promotora de Salud), the treating physician (médico tratante), and the occupational medicine specialist (médico de salud ocupacional) in facilitating the worker's safe return.

Ley 1562 de 2012 (Ley del Sistema General de Riesgos Laborales) fundamentally restructured the occupational risk system in Colombia, establishing that ARLs bear primary financial and technical responsibility for worker rehabilitation after workplace accidents. Article 4 of Ley 1562 defines accidente de trabajo and establishes that all consequences — including medical treatment, rehabilitation, temporary disability payments (incapacidad temporal), permanent disability assessments (calificación de invalidez), and reintegration support — are covered by the occupational risk system. The Plan de Retorno is the formal document that activates this coverage for the reintegration phase.

Decreto 1072 de 2015, in its Articles 2.2.4.6.31 through 2.2.4.6.33, establishes the investigación de accidentes de trabajo as a mandatory employer obligation. The findings of the accident investigation must inform the Return to Work Plan, confirming that the conditions that caused the accident have been corrected before the worker returns to similar tasks. The accident investigation report (informe de investigación de accidente de trabajo) is a prerequisite document for designing an effective Plan de Retorno.

Resolución 0312 de 2019 del Ministerio del Trabajo classifies minimum SG-SST standards by company size and risk class. Standard 4.2 of Resolución 0312 specifically requires employers to implement a reintegration program (programa de reincorporación) for workers recovering from workplace accidents or occupational diseases. This standard is verified by labor inspectors during SG-SST compliance audits. Companies with 50 or more workers (risk classes I through III) or 11 or more workers (risk classes IV and V) must have a documented reintegration program as part of their SG-SST.

The Ministerio del Trabajo through Resolución 2346 de 2007 and its successor provisions established the pre-employment and periodic medical examination framework, including the post-incapacity medical evaluation (evaluación médica de reintegro) that must be conducted before a worker returns to active duties. The occupational medicine physician must issue a certificado de aptitud médica de reintegro specifying any functional restrictions (restricciones funcionales) that the employer must accommodate during the return-to-work period.

Colombians with disabilities resulting from workplace accidents enjoy special protection under Ley 361 de 1997 (Ley de Discapacidad) and Ley 1618 de 2013 (Estatuto de Discapacidad). The Constitutional Court of Colombia (Corte Constitucional) has consistently upheld in decisions such as Sentencia T-337 de 2019 and Sentencia SU-049 de 2017 the principle of estabilidad laboral reforzada — enhanced employment stability — for workers with disabilities, prohibiting dismissal without prior authorization from the Ministerio del Trabajo. The Plan de Retorno must reflect these legal protections and document the employer's accommodation measures.

When Do You Need a Return to Work Plan After Accident Colombia (Plan de Retorno al Trabajo)?

A Return to Work Plan Colombia is required whenever a worker has been on medical leave (incapacidad médica) for more than 15 calendar days following a workplace accident (accidente de trabajo) or the diagnosis of an occupational disease (enfermedad laboral) under the Tabla de Enfermedades Laborales established by Decreto 1477 de 2014. The plan is triggered at the moment the treating physician or the ARL's medical team determines that the worker has reached maximum medical improvement (estado de mejoría máxima) or is medically cleared for graduated work reintegration.

The Ministerio del Trabajo requires the Plan de Retorno as a component of the employer's SG-SST reintegration program under Resolución 0312 de 2019 Standard 4.2. Labor inspectors from the Direcciones Territoriales del Trabajo verify that companies with reportable workplace accidents have a documented Plan de Retorno for affected workers. Absence of this plan during an inspection constitutes a violation sanctioned under Ley 1562 de 2012 Article 30.

ARLs legally require a Plan de Retorno before authorizing a worker's return to active duties when the worker's medical history includes a workplace accident or occupational disease. The ARL's rehabilitation team — which under Ley 1562 de 2012 Article 11 must include occupational therapists, physiotherapists, and occupational medicine physicians — typically co-designs the Plan de Retorno with the employer and the worker. The ARL covers the cost of functional rehabilitation and reintegration support services.

The plan is also required when an employer needs to demonstrate compliance with estabilidad laboral reforzada obligations under Ley 361 de 1997 and Constitutional Court jurisprudence. When a worker files a tutela action (acción de tutela) for reinstatement after a dismissal that allegedly violated enhanced employment stability, the Plan de Retorno serves as evidence that the employer fulfilled their accommodation obligation before seeking Ministerio del Trabajo authorization for dismissal under Circular 098 de 2015.

For public sector employers governed by Ley 909 de 2004 (Estatuto del Servidor Público) and Decreto 1083 de 2015, the Plan de Retorno intersects with the sistema de carrera administrativa and the worker's right to reassignment (reubicación laboral) when permanent functional restrictions prevent return to the original position. The Comisión Nacional del Servicio Civil (CNSC) and the Departamento Administrativo de la Función Pública (DAFP) have issued guidance on public sector return-to-work accommodations.

What to Include in Your Return to Work Plan After Accident Colombia (Plan de Retorno al Trabajo)

A valid Return to Work Plan Colombia under Decreto 1072 de 2015, Ley 1562 de 2012, and Resolución 0312 de 2019 must contain the following essential elements to satisfy regulatory requirements and protect the rights of the injured worker.

Worker and Accident Identification: Full name of the worker (trabajador), cédula de ciudadanía, job position (cargo), work area (área de trabajo), date of the workplace accident (fecha del accidente de trabajo) or occupational disease diagnosis date, and the FURAT (Formulario Único de Reporte de Accidente de Trabajo) number submitted to the ARL. The FURAT must be filed within two business days of the accident under Artículo 3 of Ley 1562 de 2012.

Medical Diagnosis and Restrictions: The treating physician's diagnosis (diagnóstico médico) using ICD-10 codes, the disability period (período de incapacidad) in calendar days, and the post-incapacity medical evaluation (evaluación médica de reintegro) results issued by the occupational medicine physician per Resolución 2346 de 2007. Functional restrictions (restricciones funcionales) must be specified clearly — for example, maximum weight lifting capacity (capacidad máxima de levantamiento de carga), prohibited postures (posturas prohibidas), maximum standing time, or required ergonomic adaptations.

Graduated Reintegration Plan: A week-by-week schedule for the worker's progressive return to normal work duties, specifying work hours per day, permitted tasks, and performance benchmarks. The plan should distinguish between the initial rehabilitation phase (fase de rehabilitación), the graduated reintegration phase (fase de reintegración gradual), and the full reintegration phase (fase de reintegración plena). Each phase should have defined duration and medical review milestones.

Job Role Adaptation (Reubicación Laboral): Description of any temporary or permanent changes to the worker's job duties, workstation ergonomics, work schedule, or physical environment required to accommodate the functional restrictions. Under Artículo 8 of Ley 776 de 2002, employers have an obligation to reintegrate workers after workplace accidents in a position compatible with their medical restrictions, and must modify the work environment as needed.

ARL Coordination: Contact information for the ARL case manager (gestor de caso de la ARL), the ARL rehabilitation team members assigned to the case, and the schedule of ARL follow-up visits (visitas de seguimiento). The ARL's rehabilitation services — physical therapy, occupational therapy, vocational rehabilitation, and psychological support — must be referenced and their scheduling confirmed.

Employer Obligations and Monitoring: Schedule of medical follow-up evaluations (evaluaciones médicas de seguimiento) during the reintegration period, the responsible person within the company for monitoring the worker's adaptation (responsable de seguimiento), and the reporting mechanism for complications or non-compliance. Monitoring records must be maintained as part of the SG-SST documentary file per Decreto 1072 de 2015 Article 2.2.4.6.22.

Worker and Union Consent: Signature of the worker acknowledging the plan and their functional restrictions. If the company has a union (sindicato) or collective bargaining agreement (convención colectiva de trabajo), the union representative's acknowledgment may be required. Workers who refuse a medically appropriate return-to-work assignment risk losing ARL temporary disability benefits under Ley 776 de 2002.
