What Is a Family Subsidy Application Colombia?

The Family Subsidy Application Colombia (Solicitud de Subsidio Familiar) is the formal written request that an affiliated worker submits to their Caja de Compensación Familiar to claim the monthly family subsidy payment (subsidio familiar) for each qualifying dependent. The subsidio familiar is Colombia's primary cash transfer mechanism for low-to-middle income formal sector workers with dependent children and family members, established by Ley 21 de 1982 and subsequently reformed by Ley 789 de 2002.

Ley 21 de 1982 defined the subsidio familiar as a financial benefit paid by the Cajas de Compensación Familiar from the employer's 4% parafiscal payroll contribution, distributed monthly to workers with qualifying dependents as a partial compensation for the cost of raising a family. The subsidy is not paid by the employer directly — it is paid by the Caja from the collective pool of parafiscal contributions collected from all affiliated employers. This solidarity mechanism allows workers with several dependents to receive substantially more than their employer's direct 4% contribution.

Article 3 of Ley 21 de 1982 establishes the basic eligibility rules: workers must earn a salary (salario) — the subsidy does not apply to workers in independent contractor arrangements (contrato de prestación de servicios) — must be earning four SMMLV or less (above this threshold, workers can access Caja services but do not receive the cash subsidio familiar payment), and must have qualifying dependents registered with the Caja. Ley 789 de 2002 introduced the cuota monetaria (cash payment) and cuota en especie (in-kind benefits) modalities and modified the dependent qualification criteria.

The subsidio familiar operates through three forms: cuota monetaria (a monthly cash payment to the worker, calculated as a fixed amount per qualifying dependent determined by the Caja's board within regulatory limits set by the SSF); cuota en especie (non-cash equivalent benefits such as school supplies, groceries, or medical services substituting for part of the cash payment); and servicios sociales (access to the Caja's health, education, and recreation programs for the worker and registered beneficiaries, available regardless of income level). The cuota monetaria is modest — typically a fraction of the SMMLV per dependent per month — but the combined value of servicios sociales access is often the most valuable component of the subsidy.

The Superintendencia del Subsidio Familiar (SSF) — a specialized oversight body within the Ministerio del Trabajo — sets the regulatory framework for the subsidio familiar, approves Caja operating standards, and investigates complaints against Cajas for failure to pay subsidies or improper denial of service access. Workers whose Caja denies or reduces their subsidio familiar may file a complaint with the SSF through its online portal or regional offices.

When Do You Need a Family Subsidy Application Colombia?

The Family Subsidy Application Colombia must be submitted in the following circumstances under Ley 21 de 1982 and Ley 789 de 2002.

New Employment with Qualifying Dependents: When a worker with children under 18 years (or other qualifying dependents) begins formal employment with an employer affiliated to a Caja de Compensación Familiar, the worker must submit this application to register their dependents and begin receiving the monthly subsidio familiar. The subsidy is not automatic — the worker must affirmatively apply.

Birth or Adoption of a Child: When a worker has a new child through birth or adoption, the worker must submit this application (or an amendment to an existing application) to add the new child as a qualifying dependent and increase the monthly subsidy accordingly. The birth certificate (registro civil de nacimiento) must be presented as supporting documentation.

Change in Dependency Status: When a qualifying dependent's status changes — for example, a child turns 18 and no longer qualifies unless they are disabled or full-time students (up to age 23 under some Caja regulations), or a child who was a full-time student graduates — the worker must update the Caja registration to remove the no-longer-qualifying dependent and adjust the monthly payment accordingly.

Change of Employer or Caja: When a worker changes employers, and the new employer is affiliated to a different Caja, the worker must submit a new Family Subsidy Application to the new Caja to re-register qualifying dependents and resume the monthly subsidy. Subsidy payments from the previous Caja cease with the termination of employment at the prior employer.

Income Change Below Threshold: Workers whose salary increases above four SMMLV lose eligibility for the cuota monetaria cash payment but retain access to Caja services for themselves and registered dependents. Workers whose salary subsequently falls back below four SMMLV may reapply for the cash subsidy.

What to Include in Your Family Subsidy Application Colombia

A complete Family Subsidy Application Colombia under Ley 21 de 1982 and Ley 789 de 2002 must include the following essential elements.

Worker Identification: Full legal name, cédula de ciudadanía number, home address, contact telephone and email, and Caja membership number (número de afiliado a la Caja).

Employer Information: Employer legal name (razón social), NIT, business address, and monthly salary (salario mensual) — the salary must be four SMMLV or below for the worker to qualify for the cuota monetaria cash payment. The Caja verifies the salary against the PILA submissions made by the employer.

Dependent Registration: For each qualifying dependent, the worker must provide: full name; relationship to the worker (hijo/a, padre/madre dependiente); date of birth (for children); cédula or tarjeta de identidad number; and enrollment information for students (institution name, grade or semester, enrollment certificate). The following dependents qualify under Ley 21 de 1982 and Ley 789 de 2002: (a) children under 18; (b) disabled children of any age with PCL ≥ 50% certified by the Junta de Calificación de Invalidez; (c) children under 23 who are full-time students at an officially recognized educational institution; and (d) dependent parents with no independent income (subject to the specific Caja's regulations).

Subsidy Modality Selection: The worker's preference for the cuota monetaria (monthly cash payment to the worker's bank account or through Caja payment mechanisms) or cuota en especie (equivalent benefits in school supplies, food baskets, or other approved in-kind forms). Not all Cajas offer in-kind modalities — the available options depend on the specific Caja's programs.

Documentary Evidence: Supporting documents for each dependent: registered birth certificate (registro civil de nacimiento) for children; disability dictamen from the Junta de Calificación de Invalidez for disabled dependents; enrollment certificate (certificado de matrícula) for student children aged 18-23; and financial dependency declaration for parents.

Declarations: Worker's sworn declaration that the information is accurate, that no other worker is claiming the subsidio familiar for the same dependents (only one worker per dependent can claim the subsidy), and authorization for the Caja to verify compliance with the SSF and UGPP.
