What Is a AFP Pension Fund Affiliation Form Colombia?

The AFP Pension Fund Affiliation Form Colombia (Formulario de Afiliación AFP) is the official document used to enroll a worker in a private pension fund (Administradora de Fondos de Pensiones — AFP) operating under the Régimen de Ahorro Individual con Solidaridad (RAIS) established by Ley 100 de 1993. Colombia's pension system is structured around two competing regimes: the RAIS administered by private AFPs regulated by the Superintendencia Financiera de Colombia, and the Régimen de Prima Media con Prestación Definida (RPM) administered by Colpensiones, the public social insurance entity created by Decreto Ley 4121 de 2011 to replace the former Instituto de Seguros Sociales (ISS).

Ley 100 de 1993 established Colombia's thorough social security framework, replacing the fragmented pension system that existed prior to 1994. Article 15 of Ley 100 mandates that all workers earning a salary must affiliate with the pension system — either RAIS or RPM — within the first month of beginning an employment relationship. The employer bears the obligation to verify and report the worker's pension affiliation to the UGPP (Unidad de Gestión Pensional y Parafiscales) through the Planilla Integrada de Liquidación de Aportes (PILA), the electronic system administered by the Ministerio de Salud y Protección Social for collecting social security contributions.

Under the RAIS, each affiliated worker (afiliado) holds an individual savings account (cuenta de ahorro individual) within the AFP. Monthly contributions — calculated as a percentage of the Ingreso Base de Cotización (IBC) — are deposited into this individual account and invested by the AFP in portfolios approved by the Superintendencia Financiera de Colombia under Decreto 2555 de 2010. The combined contribution rate under Article 20 of Ley 100 (as modified by Ley 797 de 2003) is 16% of the IBC: 12% employer share (aporte patronal) and 4% worker share (aporte del trabajador). Of the total 16%, a solidarity fund contribution (Fondo de Solidaridad Pensional) of 1% is directed to subsidize pensions for lower-income workers.

The AFP affiliation form captures the worker's personal identification data, employment information, beneficiary designations, and the choice of investment portfolio (fondo de pensiones). Decreto 2555 de 2010 requires AFPs to offer at least four investment portfolios differentiated by risk profile and term: Fondo Especial de Retiro Programado, Fondo Conservador, Fondo Moderado, and Fondo Mayor Riesgo. Workers must select a portfolio appropriate to their age and retirement horizon — failure to select results in automatic assignment to the Fondo Moderado per Circular Básica Jurídica 029 de 2014 of the Superintendencia Financiera.

The right to choose between RAIS and RPM is established in Article 13 of Ley 100. Workers may transfer between regimes once every five years, subject to the restriction under Article 36 of Ley 100 that workers within ten years of the minimum retirement age may not transfer from RPM to RAIS. Ley 797 de 2003 modified the minimum pension age to 57 years for women and 62 years for men, and increased the minimum contribution weeks to 1,300 for those affiliated after Ley 797's entry into force. The Acto Legislativo 01 de 2005 (constitutional reform) eliminated special pension regimes and reinforced the dual-regime structure as the definitive Colombian pension architecture.

The Decreto Único Reglamentario del Sector Trabajo — Decreto 1072 de 2015 — consolidates the regulatory framework for pension contributions in its Book 2, Title 2, Chapter 1. Article 2.2.1.1.1 defines the IBC as the base for calculating contributions and establishes the minimum IBC as one Salario Mínimo Mensual Legal Vigente (SMMLV) for full-time workers. The UGPP, created by Ley 1151 de 2007, has the authority to audit employer contribution compliance and impose penalties for under-reporting or late payment of pension contributions under Ley 1438 de 2011.

When Do You Need a AFP Pension Fund Affiliation Form Colombia?

The AFP Pension Fund Affiliation Form Colombia is required in the following specific circumstances governed by Ley 100 de 1993 and Decreto 1072 de 2015.

New Employment: Every employer must complete the AFP affiliation process for each new worker within the first month of the employment relationship under Article 15 of Ley 100. The failure to affiliate a worker — or the continued payment of contributions without formal affiliation — constitutes a violation subject to penalties imposed by the UGPP under Ley 1438 de 2011. The employer must obtain the worker's AFP affiliation certificate (certificado de afiliación) before submitting the first PILA payment.

First Employment: Workers entering the formal labor market for the first time must use this form to select between RAIS (AFP) and RPM (Colpensiones). The choice has long-term financial implications — workers under 35 years of age generally benefit from RAIS given the compound growth of individual accounts, while older workers approaching retirement age may benefit from the defined benefit structure of Colpensiones RPM.

Regime Transfer: Workers exercising their right under Article 13 of Ley 100 to transfer from RPM (Colpensiones) to RAIS must complete an AFP affiliation form with their chosen AFP. The transfer is subject to the five-year lock-in period and the ten-year proximity restriction. The AFP is required to verify compliance with these restrictions before processing the transfer.

AFP Change: Workers already in RAIS who wish to transfer their individual savings account from one AFP to another must submit a new affiliation form to the receiving AFP. The transfer of account balances between AFPs is regulated by Circular Básica Jurídica 029 de 2014 of the Superintendencia Financiera, which establishes the procedures for account transfer including the obligation to transfer accumulated returns along with the principal balance.

Beneficiary Update: Workers must update their AFP affiliation records when changes occur in their beneficiary designations due to marriage, divorce, birth of children, or death of previously designated beneficiaries. Beneficiaries designated in the AFP form receive the pension survivor benefit (pensión de sobrevivientes) regulated by Article 46 of Ley 100 as modified by Ley 797 de 2003.

Parties in Colombia should prepare a AFP Pension Fund Affiliation Form Colombia proactively rather than waiting for a dispute to arise. Courts interpret agreements based on the written terms rather than oral representations. Under the Codigo Sustantivo del Trabajo (CST), Colombian employment law governs individual and collective labour relations. The Ministerio del Trabajo enforces compliance and issues regulations. The Sistema General de Seguridad Social (EPS, ARL, Fondo de Pensiones) provides health, occupational risk, and pension coverage. The Unidad de Gestion Pensional y Parafiscales (UGPP) audits employer contributions. The Caja de Compensacion Familiar administers family subsidy benefits. Where the transaction involves regulated activities, prior approval from the relevant authority may be required before execution.

What to Include in Your AFP Pension Fund Affiliation Form Colombia

A valid AFP Pension Fund Affiliation Form Colombia under Ley 100 de 1993 must contain the following essential elements to be processed by the AFP and reported to the UGPP through the PILA system.

Worker Personal Identification: Full legal name as it appears on the cédula de ciudadanía, cédula de extranjería, or pasaporte; document type and number; date and place of birth; gender; home address and municipality; contact telephone and email. The AFP validates the worker's identity against the Registraduría Nacional del Estado Civil database before activating the account.

Employer Information: Legal name (razón social) of the employer; NIT assigned by the DIAN; business address; name and cédula of the legal representative; contact telephone and email. The employer's information is cross-referenced with the Registro Único Empresarial (RUE) of the Cámara de Comercio and the DIAN's taxpayer registry.

Employment Details: Date of commencement of the employment relationship (fecha de inicio del contrato); monthly salary (salario mensual) expressed as the IBC base; type of employment contract (término indefinido under CST Article 45 or término fijo under CST Article 46); and the employer's declaration that contributions will be paid through the PILA platform.

Regime and Portfolio Selection: The worker's explicit selection of the RAIS regime (as opposed to Colpensiones RPM); the name of the AFP chosen; and the investment portfolio selected from the four options required by Decreto 2555 de 2010: Fondo Conservador, Fondo Moderado, Fondo Mayor Riesgo, or Fondo Especial de Retiro Programado. The selection must be made in writing with the worker's informed consent per Circular Básica Jurídica 029 of the Superintendencia Financiera de Colombia.

Beneficiary Designation: Names, relationship, identification numbers, and date of birth of designated beneficiaries (cónyuge or compañero/a permanente; children; parents) who will receive the pensión de sobrevivientes under Article 46 of Ley 100 or the devolución de saldo in the event of the worker's death before meeting pension requirements.

Authorizations and Consent: The worker's signature authorizing the AFP to: (a) manage the individual savings account; (b) invest contributions in the selected portfolio; (c) report account information to the Superintendencia Financiera de Colombia and the UGPP; and (d) process the solidarity fund contribution (Fondo de Solidaridad Pensional) deduction as required by Article 27 of Ley 100.

Date and Signatures: The affiliation form must be signed and dated by both the worker and the employer's authorized representative. The AFP issues a certificado de afiliación within five business days confirming the worker's enrollment, which the employer must retain in the personnel file (expediente laboral) as evidence of social security compliance for UGPP audit purposes.
