PRIMERA — OBJETO

TERCERA — OBLIGACIONES DE LAS PARTES

El CONSULTOR AMBIENTAL se obliga a: (a) elaborar los estudios con objetividad técnica y científica, conforme al principio de imparcialidad del SINA; (b) aplicar las metodologías exigidas por [Autoridad Ambiental]; (c) mantener estricta confidencialidad sobre la información técnica y georreferenciada del proyecto; y (d) revelar fielmente los impactos ambientales identificados, aunque sean desfavorables para el CLIENTE.

El CLIENTE se obliga a: (a) suministrar al CONSULTOR la información técnica del proyecto, acceso al predio y documentos de propiedad requeridos; (b) pagar oportunamente los honorarios conforme a los hitos acordados; y (c) asumir los costos de laboratorio, análisis y trabajo de campo no incluidos en los honorarios, salvo acuerdo en contrario.

CUARTA — RESPONSABILIDAD

El CONSULTOR responde por la calidad técnica del estudio conforme a los términos de referencia de [Autoridad Ambiental]. El CONSULTOR no garantiza la obtención de la Licencia Ambiental, que es decisión discrecional de la autoridad ambiental. La responsabilidad del CONSULTOR por deficiencias técnicas imputables a su gestión se limita al valor total de los honorarios recibidos.
