What Is a Domestic Adoption Application Chile (Solicitud de Adopción Nacional)?

A Domestic Adoption Application Chile is a formal judicial petition governed by Ley N° 19.620 of 5 August 1999 — the principal Chilean statute regulating the adoption of minors — and its implementing regulations under Decreto Supremo N° 944 of 2000 issued by the Ministerio de Justicia y Derechos Humanos. Through this application, prospective adoptive parents (solicitantes de adopción) formally request the competent Tribunal de Familia to: (1) declare that a specific child or adolescent is susceptible of adoption (susceptibilidad de adopción) under Ley 19.620 Articles 8 through 14; and (2) grant the adoption (conceder la adopción), extinguishing all previous filiation ties and establishing a full adoptive filiation between the adoptee and the adoptive family under Ley 19.620 Article 37.

The Servicio Nacional de Menores (SENAME) — rebranded as Servicio Mejor Niñez under Ley N° 21.302 of 2021, under the supervision of the Ministerio de Desarrollo Social y Familia — plays a central role in Chilean domestic adoption. Mejor Niñez maintains the Registro Nacional de Adoptantes (RNA), administers the official approval process for prospective adoptive families (proceso de calificación y aprobación), supervises children in residential care (programas residenciales), and submits mandatory reports (informes técnicos) to the Tribunal de Familia regarding the suitability of the prospective family and the child's best interests.

The Chilean adoption framework rests on Article 1 of Ley 19.620, which establishes the guiding principle that adoption serves exclusively the interests and welfare of the adoptee (interés superior del menor) — a standard also enshrined in the United Nations Convention on the Rights of the Child (CRC), ratified by Chile in 1990 through Decreto Supremo N° 830 and incorporated into Chilean law under Article 5 of the Constitución Política de la República. The Tribunal de Familia applies this best-interest standard at every procedural stage, including the susceptibility declaration hearing, the entrust (confiar el menor) stage, and the final adoption grant hearing.

Chilean law establishes a mandatory pre-judicial administrative phase before the Tribunal de Familia can grant adoption. Prospective adoptive families must first register with Mejor Niñez and complete a psychosocial evaluation (evaluación psicosocial) conducted by a multidisciplinary team (equipo técnico) composed of social workers (trabajadores sociales) and psychologists (psicólogos). Upon satisfactory evaluation, the family is registered in the Registro Nacional de Adoptantes and receives a certificate of eligibility (certificado de idoneidad) valid for three years under Ley 19.620 Article 20.

The Ley 19.620 adoption procedure distinguishes between two judicial phases. Phase one — the susceptibility of adoption proceeding (procedimiento de susceptibilidad) under Articles 8–14 — declares the child legally free for adoption when the biological parents (padres biológicos) or legal guardian have died, abandoned the child, been judicially deprived of parental authority (patria potestad) under Código Civil Article 271, or voluntarily relinquished the child before the Tribunal de Familia. Phase two — the adoption grant proceeding under Articles 20–37 — assigns the child to the approved adoptive family and, after a monitored pre-adoptive care period (período de pre-adopción), issues the adoption decree (sentencia de adopción) that permanently extinguishes the child's previous filiation.

When Do You Need a Domestic Adoption Application Chile (Solicitud de Adopción Nacional)?

A Domestic Adoption Application Chile is required whenever Chilean married couples or single individuals meeting the requirements of Ley 19.620 Articles 20 through 22 wish to formally adopt a child declared susceptible of adoption by the Tribunal de Familia. The application becomes procedurally necessary after the prospective family has completed the mandatory Mejor Niñez evaluation, obtained the certificate of eligibility (certificado de idoneidad), and received notification from Mejor Niñez that a compatible child has been proposed for the pre-adoptive care period.

Chilean law under Ley 19.620 Article 20 requires that at least one of the adoptive parents be a Chilean national (ciudadano chileno) or have resided continuously in Chile for at least five years immediately preceding the application — ensuring domestic adoption priority over international adoption. Married couples applying jointly must present evidence of at least two years of continuous marriage (matrimonio vigente) or three years of civil union (acuerdo de unión civil — AUC) under Ley N° 20.830 of 2015. Single applicants must demonstrate exceptional circumstances justifying individual adoption, as Chilean adoption policy prioritizes placement with two-parent families under Ley 19.620 Article 21.

The application is specifically necessary when biological parents have voluntarily appeared before the Tribunal de Familia — under Ley 19.620 Article 9 — to express their willingness to give the child up for adoption, or when SENAME/Mejor Niñez has requested the susceptibility declaration after determining that the child has been abandoned for more than thirty days (abandono calificado) or that the parents' conduct constitutes grave neglect (descuido grave) under Ley 19.620 Article 8. The application before the Tribunal de Familia formalizes the legal process that transforms the preliminary administrative eligibility into a binding judicial adoption.

Families who have been fostering a child (familia de acogida) under a formal agreement with Mejor Niñez or an Organismo Acreditado (authorized private adoption agency) and who wish to convert the foster placement into a formal adoption must also file this application before the Tribunal de Familia. The Corporación de Asistencia Judicial (CAJ) and legal aid clinics at Universidad de Chile Facultad de Derecho, Pontificia Universidad Católica de Chile, and Universidad Diego Portales provide free legal assistance to applicants who cannot afford private legal representation.

What to Include in Your Domestic Adoption Application Chile (Solicitud de Adopción Nacional)

A valid Domestic Adoption Application Chile under Ley N° 19.620 and Decreto Supremo N° 944/2000 must include the following essential elements to satisfy Tribunal de Familia procedural requirements and Mejor Niñez administrative standards:

Applicant Identification: Full legal names, RUT numbers (Rol Único Tributario — SII), domiciles, nationalities, dates of birth, occupations, and employment information for all applicants. For married couples, include the marriage certificate (certificado de matrimonio) from the Registro Civil e Identificación (SRCeI) showing the marriage date and continuous marital status, and the certificate of AUC registration if applicable under Ley N° 20.830. For single applicants, include documentation of the exceptional circumstances justifying individual adoption under Ley 19.620 Article 21 inciso 3.

Eligibility Documentation: Copy of the certificate of idoneidad (certificado de idoneidad) issued by Mejor Niñez, Registro Nacional de Adoptantes registration number, and the name of the Organismo Acreditado (if the evaluation was conducted by an accredited private agency rather than directly by Mejor Niñez). Include confirmation that the certificate remains valid — it expires three years from issuance under Ley 19.620 Article 20.

Child Information and Susceptibility Basis: Full name, date of birth, RUN (Rol Único Nacional), and current residential care location (programa residencial or family placement) of the child. Identification of the legal basis for susceptibility under Ley 19.620: Article 8 (biological family abandonment or neglect); Article 9 (voluntary relinquishment by biological parents before the Tribunal); Article 10 (judicial deprivation of parental authority); or Article 11 (death of parents without alternative family placement). Reference the prior susceptibility declaration case number (rol de causa) if the Tribunal has already issued the susceptibility declaration in a separate proceeding.

Pre-Adoptive Care Period Evidence: Documentation of the pre-adoptive care period (período de pre-adopción) during which the child has lived with the applicant family under Mejor Niñez supervision. Include the start date of placement, Mejor Niñez case worker contact information, and any periodic evaluation reports (informes de seguimiento) submitted to the Tribunal during the period. Under Ley 19.620 Article 28, the pre-adoptive care period lasts at least thirty days for children under two years, at least sixty days for children from two to seven years, and at least ninety days for children over seven years.

Socioeconomic Capacity Declaration: Statement of the applicants' economic resources, housing conditions, and family environment demonstrating capacity to provide adequately for the child's material, emotional, and educational needs. Attach supporting documents: most recent Certificado de Cotizaciones (AFP pension contribution history), recent pay stubs or income tax declarations (Formulario 22 from the SII), property title or lease agreement for the family home, and any relevant insurance policies or savings documentation.

Residence and Background Certificates: Certificado de residencia issued by the Registro Civil, criminal background certificate (certificado de antecedentes) from the Registro Civil showing no convictions for crimes against children under Ley N° 19.927 (child pornography), Ley N° 20.066 (intrafamily violence), or Ley N° 19.617 (sexual offenses), and certificate of no prior adoption revocation from the Registro Nacional de Adoptantes.

Best-Interest Statement: A narrative statement explaining why the adoption serves the best interests (interés superior) of the specific child, referencing the child's age, emotional bonds developed during the pre-adoptive care period, the applicants' family environment, and the guidance from the UN Committee on the Rights of the Child's General Comment No. 14 (2013) regarding the best-interest assessment methodology applied by Chilean Tribunales de Familia.
