What Is a Bank Account Opening Agreement Chile?

Bank Account Opening Agreement Chile (Contrato de Apertura de Cuenta Bancaria) is a standardized adhesion contract (contrato de adhesión) regulated by Ley N° 19.496 on Consumer Protection Articles 3 and 17, the Comisión para el Mercado Financiero (CMF) Norma General N° 7 (formerly SBIF Circular N° 3.558), and Ley N° 20.009 on Limitation of Liability for Unauthorized Card Transactions, governing the legal relationship between a bank (banco) licensed by the CMF and an individual or business client (cliente) for the opening and operation of deposit accounts in the Chilean financial system.

The Chilean banking system is regulated by the Ley General de Bancos (LGB), codified in the Decreto con Fuerza de Ley N° 3/1997 (DFL 3/1997), which grants the CMF — successor to the Superintendencia de Bancos e Instituciones Financieras (SBIF) following the reform enacted by Ley N° 21.000/2017 — oversight authority over all banks operating in Chile.
