TESTAMENTO VERBAL OTORGADO EN PELIGRO INMINENTE DE VIDA Código Civil de Chile — Artículos 1030 a 1055

I. INDIVIDUALIZACIÓN DEL TESTADOR

En [Lugar de Otorgamiento], con fecha [Fecha de Otorgamiento], ante los cinco testigos hábiles cuyos datos se indican a continuación, COMPARECIÓ: [Nombre del Testador], de nacionalidad [Nacionalidad], estado civil [Estado Civil], de profesión [Profesión], RUT [RUT del Testador], con domicilio en [Domicilio del Testador], quien encontrándose en pleno uso de sus facultades mentales y en peligro inminente de vida, formuló las siguientes declaraciones de última voluntad.

III. DECLARACIONES DE ÚLTIMA VOLUNTAD

IV. TESTIGOS HÁBILES (CC ART. 1033)

V. ADVERTENCIA LEGAL / NOTA PARA HEREDEROS

ADVERTENCIA LEGAL IMPORTANTE: El presente testamento verbal (testamento menos solemne) conforme a los Artículos 1033–1036 del Código Civil CADUCA si el testador no fallece dentro de los 30 días siguientes a su otorgamiento. En caso de fallecimiento del testador, los cinco testigos DEBEN comparecer ante el Juzgado Civil del último domicilio del testador dentro de los 30 días siguientes al fallecimiento para iniciar el procedimiento de reducción a escrito conforme a los Artículos 866–870 del Código de Procedimiento Civil. El incumplimiento de este plazo dejará el testamento verbal sin efecto legal.

What Is a Less Solemn Will Chile (Testamento Menos Solemne)?

A Less Solemn Will Chile (Testamento Menos Solemne) is a privileged testamentary instrument governed by Código Civil Articles 1030 through 1055, which permits a testator (testador) to execute a valid will in exceptional circumstances where compliance with the full formalities of a solemn will (testamento solemne) — principally the presence of a Notario Público and five witnesses — is impossible or impractical. The Chilean Civil Code divides all wills into two categories: testamentos solemnes (solemn wills requiring full formalities under CC Articles 1008–1029) and testamentos menos solemnes or privilegiados (less solemn or privileged wills under CC Articles 1030–1055), which are granted special dispensation from certain formalities due to the exceptional circumstances of their execution.

CC Article 1030 defines testamentos privilegiados as those that may be executed with fewer formalities than the ordinary solemn will, and enumerates three categories: the testamento verbal (oral will, CC Articles 1033–1036), the testamento militar (military will, CC Articles 1041–1047), and the testamento marítimo (maritime will, CC Articles 1048–1055). The testamento menos solemne most commonly encountered outside military or maritime contexts is the testamento verbal — a will made by a testator in imminent danger of death (en peligro inminente de vida) before five witnesses when there is no possibility of executing a solemn will.

For the testamento verbal under CC Articles 1033–1036, the testator must be in circumstances of imminent danger of death that prevent compliance with ordinary solemnities. The will must be made in the presence of at least five competent witnesses (testigos hábiles) who hear the testator's declarations of last wishes. The witnesses are responsible for testifying before a court (Tribunal de Letras or Juzgado Civil) within 30 days following the testator's death to reduce the will to writing — this judicial process is called la protocolización judicial del testamento verbal or the reducción a escrito. Without this judicial proceeding, the testamento verbal produces no legal effect.

Witness competency (habilidad de testigos) is governed by CC Article 1012, which disqualifies as witnesses to Chilean wills: minors under 18 years of age; persons interdicted for dementia (interdictos por demencia); persons who lack sufficient use of reason (los que de palabra o por escrito no pudieren expresar su voluntad claramente); deaf or blind persons (sordomudos and ciegos); persons convicted of certain serious crimes (los que hubieren sido condenados por delito que merezca pena aflictiva, or theft, fraud, or other crimes involving dishonesty); employees of the Notario Público before whom the solemn will is executed; and the beneficiaries (asignatarios) named in the will or their spouses and close relatives.

The Corte Suprema de Chile has interpreted the imminent danger requirement strictly — the testador must face a genuine threat to life, not merely poor health or old age. Chilean courts have upheld testamentos verbales executed by persons injured in accidents, suffering sudden severe illness, or facing other acute life-threatening emergencies where no Notario Público could be reached in time. The Registro Civil e Identificación and the CBR (Conservador de Bienes Raíces) process testamentos menos solemnes only after judicial validation.

When Do You Need a Less Solemn Will Chile (Testamento Menos Solemne)?

A Less Solemn Will Chile is required in emergency circumstances where the testator faces imminent death and cannot execute a full solemn will under Código Civil Articles 1008–1029 before a Notario Público.

Typical scenarios include: sudden serious medical emergencies — heart attacks, strokes, or severe accidents — where the testator is hospitalized in a Chilean clinic or hospital (Clínica Las Condes, Hospital del Salvador, Hospital Regional de Concepción) without sufficient time to summon a Notario Público; natural disasters or mass emergency situations where Notarios Públicos are temporarily inaccessible; and remote rural areas of Chile where Notarios Públicos may not be immediately available.

Persons who have not previously executed a solemn testamento abierto or testamento cerrado before a Notario Público and who find themselves in a life-threatening emergency need the testamento verbal to ensure their assets pass according to their wishes rather than under Chile's intestacy rules (sucesión intestada) of CC Articles 980–1008.

The less solemn will is also relevant after its execution — families of deceased persons who executed testamentos verbales need legal guidance on the 30-day judicial filing deadline and the protocolización judicial procedure before the Juzgado Civil of the testator's last domicile in Chile.

What to Include in Your Less Solemn Will Chile (Testamento Menos Solemne)

A valid Less Solemn Will Chile under Código Civil Articles 1030–1055 must contain these essential elements:

Testator Identification: Full name, RUT, nationality, marital status, domicile, and declaration of sound mind and legal capacity. The testator must be of legal age (18 years or older under CC Article 1005) and must not be subject to legal incapacity.

Circumstances of Imminent Danger: Clear description of the specific life-threatening emergency — nature of the illness or accident, location, date, and time — establishing why the solemn will formalities could not be observed. Chilean courts require genuine imminence, not merely poor health.

Declaration of Last Wishes: Specific dispositions — naming heirs (herederos), legatees (legatarios), and the specific assets or portions of the estate assigned to each. Must respect mandatory forced shares (asignaciones forzosas): legitimarios receive their legítima rigorosa, the cuarta de mejoras, and the free disposable quarter under CC Articles 1167–1250.

Witness Identification and Attestation: Full name, RUT, profession, and domicile of each of the five required witnesses (testigos hábiles). Each witness must attest that they heard the testator's declarations, that the testator appeared to be of sound mind, and that the circumstances of imminent danger existed.

Date and Place: Exact date (day, month, year) and location (commune, region of Chile) where the will was executed.
