What Is a AFC Unemployment Insurance Benefit Application Chile?

AFC Unemployment Insurance Benefit Application Chile (Liquidación del Seguro de Cesantía AFC) is the official request submitted by a worker to the Administradora de Fondos de Cesantía (AFC Chile) to access the benefits of Chile's mandatory unemployment insurance system established by Ley N° 19.728 of 2001 (Ley que establece un seguro de desempleo). AFC Chile is a private entity created by the same law and regulated and supervised by the Superintendencia de Pensiones and the Superintendencia de Seguridad Social (SUSESO) to administer the unemployment insurance funds on behalf of Chilean workers and their employers.

The Seguro de Cesantía established by Ley N° 19.728 operates through two separate funding mechanisms. The first is the Cuenta Individual por Cesantía (CIC) — an individual unemployment savings account held in each worker's name, funded by mandatory monthly contributions: 0.6% of the worker's taxable remuneration paid by the worker, and 2.4% paid by the employer (total 3% of salary for indefinite-term contracts — contratos de trabajo indefinidos). These individual account funds belong to the worker and may be withdrawn when unemployment occurs, regardless of the reason for termination, though the monthly amounts and duration of benefits depend on accumulated savings and the worker's chosen withdrawal schedule under Ley N° 19.728 Articles 12 through 16.

The second mechanism is the Fondo de Cesantía Solidario (FCS) — a solidarity fund financed by additional employer contributions (0.8% of salary for indefinite contracts, plus state contributions established in the annual Budget Law — Ley de Presupuestos) and administered collectively by AFC Chile under SUSESO oversight. Access to FCS benefits is conditional: the dismissed worker must not have sufficient CIC balance to receive the minimum monthly benefit schedule, and must meet additional eligibility criteria including: having contributed to the system for at least twelve continuous months (for indefinite contracts) or at least six months (for fixed-term or project-based contracts) before the unemployment event; the termination must have been involuntary — CT Article 159 numerals 4, 5, and 6 (fixed-term expiration, work conclusion, force majeure) or CT Article 161 (business needs or desahucio) — not resignation (renuncia) under CT Article 159 numeral 2, which disqualifies the worker from FCS access.

Ley N° 19.728 Articles 12 through 24 govern the benefit amounts, payment schedule, and access conditions for both the CIC and FCS components. CIC payments under Article 15 may be made monthly in up to twelve installments (cuotas) for indefinite-term contract workers. FCS payments supplement CIC withdrawals when the CIC balance would produce below-threshold monthly benefits. Benefit amounts range from 50% of the worker's average remuneration in the first month down to 30% in the fifth and subsequent months for indefinite-term contract workers accessing FCS, subject to minimum and maximum benefit floors and ceilings updated annually by SUSESO and the Ministerio del Trabajo y Previsión Social.

When Do You Need a AFC Unemployment Insurance Benefit Application Chile?

An AFC Unemployment Insurance Benefit Application (Liquidación del Seguro de Cesantía) must be filed with AFC Chile whenever an eligible worker under Ley N° 19.728 separates from employment and wishes to access their Cuenta Individual por Cesantía (CIC) savings or qualify for Fondo de Cesantía Solidario (FCS) benefits. Every worker employed under an indefinite-term or fixed-term individual labour contract (contrato individual de trabajo) that began on or after October 1, 2002 — the date the Seguro de Cesantía became operative — is automatically enrolled in the system, with AFC Chile maintaining an individual account from the first day of the employment relationship.

Workers should file the application promptly after the employment relationship ends — the application may be filed online through AFC Chile's portal (www.afcchile.cl), at any AFC Chile branch office (sucursal AFC), at affiliated banking institutions (BancoEstado, Banco de Chile, Santander Chile, Banco BCI, and others with AFC Chile service points), or through ChileAtiende service centers operated by the Instituto de Previsión Social (IPS). Delays in filing may affect the worker's ability to access the optimal benefit schedule, since the benefit amounts under Ley N° 19.728 Articles 15 and 18 are calculated based on the worker's average remuneration over the twenty-four months preceding separation for CIC benefits, and the benefit schedule begins running from the month following separation regardless of when the application is filed.

Workers dismissed for business needs (necesidades de la empresa — CT Article 161) are the primary beneficiaries of FCS access, as their involuntary termination qualifies them for solidarity benefits. Workers dismissed for causes under CT Article 160 (misconduct) are technically entitled to CIC access only — not FCS — since the Reglamento del Seguro de Cesantía (DS 49/2001 del Ministerio del Trabajo) classifies misconduct-based dismissals as equivalent to voluntary separations for FCS eligibility purposes, though the worker retains all accumulated CIC savings regardless. Workers who resigned voluntarily (renuncia — CT Article 159 numeral 2) may access their CIC balance after twelve continuous months of contributions and are not eligible for FCS benefits, reflecting the insurance principle that solidarity benefits are reserved for involuntary unemployment.

What to Include in Your AFC Unemployment Insurance Benefit Application Chile

A complete AFC Unemployment Insurance Benefit Application (Liquidación del Seguro de Cesantía) under Ley N° 19.728/2001 must contain the following essential elements to enable AFC Chile and SUSESO to process the benefit claim correctly and disburse funds promptly:

Worker Identification: Full legal name, RUT (Rol Único Tributario), date of birth, marital status, home address, contact telephone, and email address for AFC Chile communications. Bank account details (cuenta corriente, cuenta vista, or cuenta RUT — available through BancoEstado for all RUT holders) for benefit payment by direct deposit (transferencia electrónica). Workers without a bank account may receive payment at a BancoEstado branch or affiliated payment point.

Employment and Contribution History: Name and RUT of the employer from which the worker separated; employment start date (fecha de inicio de la relación laboral); termination date (fecha de término); and the termination ground (causal de término) as stated in the carta de despido or finiquito — critical for determining CIC-only vs. CIC plus FCS eligibility under Ley N° 19.728 Articles 12 and 22. AFC Chile will verify contribution history against its own records and the Servicio de Impuestos Internos (SII) database.

Termination Documentation: Copy of the carta de despido specifying the Código del Trabajo article and numeral; copy of the finiquito (settlement agreement) ratified before the Inspección del Trabajo, Notario Público, or Secretario Municipal under CT Article 177; and confirmation that the employer has paid all social security contributions (cotizaciones previsionales) including the AFC Chile unemployment insurance contributions (cotizaciones al Seguro de Cesantía) — an employer's failure to pay these contributions does not extinguish the worker's benefit rights, as AFC Chile and SUSESO have collection mechanisms (cobranza de cotizaciones) against delinquent employers under Ley N° 19.728 Article 5.

Benefit Election (Tipo de Prestación Solicitada): The worker must specify whether they are requesting: CIC withdrawals only (retiro de la Cuenta Individual por Cesantía — Article 15); CIC plus FCS supplementary benefits where eligible (prestaciones complementarias del Fondo de Cesantía Solidario — Article 18); or a lump-sum withdrawal of the entire CIC balance as a pension supplement if the worker is retiring (pensionado — Article 24). For CIC benefits, the worker selects the monthly installment schedule: up to five monthly payments for indefinite-term contract workers drawing only from CIC; up to twelve monthly payments for indefinite-term contract workers qualifying for FCS supplements; or up to three monthly payments for fixed-term or project-based contract workers.

Job Search Certification (Certificación de Búsqueda de Empleo): Workers accessing FCS benefits must certify their active job search status and participation in reemployment support programs (programas de apoyo a la reinserción laboral) offered through SENCE (Servicio Nacional de Capacitación y Empleo) — an agency of the Ministerio del Trabajo y Previsión Social — including subsidized training vouchers (franquicia tributaria SENCE), bonos de capacitación, and intermediación laboral services. Non-compliance with the active job search requirement may result in suspension of FCS benefit payments.

Benefit Amount Calculation Reference: The application should include the worker's last twelve months' average remuneration for reference, as AFC Chile calculates the monthly benefit using the formula specified in Ley N° 19.728 Article 15: 50% of the average of the last three months' remuneration for the first monthly benefit, declining to 45% (second month), 40% (third month), 35% (fourth month), and 30% (fifth and subsequent months) for indefinite-term contract workers accessing FCS, subject to annual maximum benefit caps and minimum benefit floors established by SUSESO.
