La tácita reconducción establecida en el Artículo 2478 CCF opera de pleno derecho mientras ninguna de las partes notifique su intención de terminar el arrendamiento conforme a lo pactado.

IV. RENTA Y FORMA DE PAGO

El ARRENDADOR tiene la obligación de emitir un Comprobante Fiscal Digital por Internet (CFDI) por cada pago de renta recibido, conforme al Artículo 29-A del Código Fiscal de la Federación (CFF) y a las obligaciones del régimen de arrendamiento ante el SAT bajo el Artículo 114 LISR.

V. DEPÓSITO EN GARANTÍA

El ARRENDATARIO entrega en este acto al ARRENDADOR la cantidad de [Security Deposit] como depósito en garantía para responder por el pago de rentas adeudadas, daños al inmueble más allá del deterioro natural por uso normal, y adeudos de servicios (CFE, SACMEX, gas) a cargo del ARRENDATARIO.

El ARRENDADOR devolverá el depósito dentro del plazo de 30 días naturales siguientes a la desocupación del inmueble, una vez verificado que no existen adeudos ni daños imputables al ARRENDATARIO. En caso de incumplimiento en la devolución oportuna, el ARRENDADOR cubrirá los intereses legales correspondientes conforme al Artículo 2448-G CCCDMX.

VI. TERMINACIÓN Y AVISO PREVIO

Cualquiera de las partes podrá dar por terminado el presente contrato mediante aviso escrito a la otra parte con una anticipación mínima de [Notice Period], conforme al Artículo 2478 del Código Civil Federal que establece la obligación de dar aviso equivalente al período de pago de renta para arrendamientos de vigencia indeterminada.

El aviso deberá entregarse mediante: [Notice Method]. El período de aviso comenzará a correr a partir del día en que la otra parte reciba efectivamente la notificación, no desde la fecha de envío.

Al término del contrato, el ARRENDATARIO desocupará y entregará el inmueble en las mismas condiciones en que fue recibido, salvo el deterioro natural por uso normal.

VII. OBLIGACIONES DEL ARRENDATARIO

El ARRENDATARIO se obliga a: (a) destinar el inmueble exclusivamente al uso convenido ([Property Use]), conforme al Artículo 2416 CCF; (b) no subarrendar ni ceder el contrato sin consentimiento escrito previo del ARRENDADOR, conforme al Artículo 2480 CCF; (c) mantener el inmueble en buen estado y efectuar las reparaciones locativas (reparaciones menores) a su costa; (d) pagar oportunamente los servicios de energía eléctrica (CFE), agua potable (SACMEX o equivalente) y gas a su cargo; (e) no realizar modificaciones estructurales sin autorización escrita del ARRENDADOR; (f) permitir el acceso del ARRENDADOR para inspecciones con aviso previo razonable; y (g) notificar oportunamente cualquier desperfecto mayor al ARRENDADOR.

VIII. OBLIGACIONES DEL ARRENDADOR

El ARRENDADOR se obliga a: (a) entregar el inmueble en condiciones habitables conforme a los Artículos 2444 y 2445 CCF; (b) efectuar las reparaciones mayores (estructurales y de instalaciones) a su cuenta; (c) garantizar la posesión pacífica (posesión pacífica) del ARRENDATARIO durante toda la vigencia del contrato; (d) emitir CFDI por cada pago de renta recibido; y (e) respetar el aviso previo establecido en la Cláusula VI antes de solicitar la desocupación.

IX. LEY APLICABLE Y JURISDICCIÓN

El presente contrato se rige por el Código Civil Federal, el Código Civil para la Ciudad de México (para inmuebles ubicados en la CDMX), o el código civil del estado donde se ubique el inmueble, y demás disposiciones aplicables. Las controversias que no se resuelvan mediante arreglo directo serán sometidas a la jurisdicción del Juzgado Civil competente del lugar donde se ubique el inmueble arrendado, o ante la Procuraduría Social de la Ciudad de México (PROSOC) para inmuebles en la CDMX.
