What Is a Private Vehicle Rental Agreement Mexico (Acuerdo de Renta de Vehículo Particular)?

A Private Vehicle Rental Agreement Mexico (Acuerdo de Renta de Vehículo Particular) is a contract by which the owner (arrendador) of a privately registered motor vehicle (vehículo de uso particular) grants the renter (arrendatario) the temporary right to use the vehicle in exchange for a rental fee (renta), governed by Article 2398 of the Código Civil Federal (CCF) — the foundational provision on lease of movable property (arrendamiento de bienes muebles) — in conjunction with applicable federal and state traffic law (Ley de Caminos, Puentes y Autotransporte Federal, Reglamento de Tránsito en Carreteras y Puentes Federales de Jurisdicción Federal, and state traffic codes).

The Código Civil Federal Article 2398 defines arrendamiento as the contract by which the lessor (arrendador) grants the lessee (arrendatario) the temporary use or enjoyment of a thing (uso o goce temporal de una cosa) in exchange for a certain price (precio cierto). For movable property such as motor vehicles, the CCF arrendamiento provisions in Articles 2398–2496 govern the core rights and obligations of the parties, while federal and state traffic and insurance regulations create additional compliance obligations.

The Ley de Caminos, Puentes y Autotransporte Federal (LCPAF), published in the DOF on 22 December 1993, distinguishes between private vehicle use (uso particular) and commercial vehicle use (autotransporte federal) — a vehicle registered for private use (servicio particular) cannot legally be used to provide paid transportation services to the public (servicio público de transporte) without the corresponding federal or state concession or permit. Operating a private vehicle as a taxi or ride-share service (servicio de transporte de pasajeros) without the proper authorisation constitutes an infraction subject to fines and vehicle impoundment under LCPAF Articles 62–74.

Mandatory civil liability insurance (seguro de responsabilidad civil) for motor vehicles in Mexico is governed by the Ley sobre el Contrato de Seguro (LCS) published in the DOF on 31 August 1935 and the Circular Única de Seguros y Fianzas issued by the Comisión Nacional de Seguros y Fianzas (CNSF). The Ley de Caminos y Puentes requires minimum liability coverage for vehicles circulating on federal highways. Most Mexican states additionally require basic civil liability insurance under their state transit codes. The rental agreement must address which party — owner or renter — is responsible for maintaining insurance coverage during the rental period and for paying deductibles in case of accident.

The Reglamento de Tránsito en Carreteras y Puentes de Jurisdicción Federal and each state's Reglamento de Tránsito establish the traffic rules applicable to private vehicles, the penalties for infractions (multas de tránsito), and the procedures for vehicle impoundment (corralón). Traffic fines issued against the vehicle during the rental period are typically the renter's responsibility, but the owner may be the registered target of enforcement if the fine is issued against the vehicle's plates (placas) rather than the driver.

Vehicle circulation taxes (tenencia vehicular or Impuesto sobre Tenencia o Uso de Vehículos, ISTUV) — historically a federal tax abolished nationally in 2012 but still levied by some states including Estado de México — are the owner's obligation as registered vehicle owner. The rental agreement should clarify that periodic vehicular taxes and registration renewals (refrendo de placas) are the owner's responsibility, while fuel (gasolina), tolls (casetas de peaje), and traffic fines during the rental are the renter's.

Under CCF Articles 1913–1920 governing responsabilidad civil objetiva (objective civil liability), the registered owner of a motor vehicle can be held jointly liable with the driver for damages caused to third parties in accidents — this risk-theory liability makes it critical that the rental agreement include a robust indemnification clause and confirm adequate insurance coverage before the vehicle is delivered to the renter.

When Do You Need a Private Vehicle Rental Agreement Mexico (Acuerdo de Renta de Vehículo Particular)?

A Private Vehicle Rental Agreement Mexico is needed whenever one individual lends or rents their privately registered vehicle to another person for a defined period in exchange for payment (renta), and the parties wish to document the terms, allocate liability, and protect both the owner's asset and the renter's use rights.

The agreement is required between family members or friends where a vehicle is rented for a specific trip, vacation, or temporary transportation need, and the parties want clear documentation of the rental terms, insurance coverage, fuel responsibilities, and return conditions — avoiding disputes if the vehicle is damaged, involved in an accident, or receives traffic fines during the rental.

The document is essential when an individual vehicle owner rents their car through informal peer-to-peer platforms or direct arrangements as a secondary income source. Mexican traffic law requires that vehicles remain within their registered use category (uso particular) — the rental agreement must specify that the renter will use the vehicle exclusively for private transportation and not for commercial passenger or freight services, protecting the owner from regulatory liability under LCPAF Articles 62–74.

The agreement is also needed when an employer allows an employee to use their personal vehicle for work errands (uso del vehículo para gestiones laborales) in exchange for compensation, establishing whether the use is covered by the employer's corporate insurance policy or the employee's personal insurance, and allocating liability for accidents occurring during work-related use under the Ley Federal del Trabajo.

Under CCF Article 2431, the lessee (arrendatario) of a movable thing is responsible for any deterioration or damage to the leased property caused by their use or negligence — the vehicle rental agreement documents the vehicle's condition at delivery (entrega) and return (devolución) through a vehicle inspection checklist (reporte de condición del vehículo) to establish the baseline condition and allocate responsibility for any damage incurred during the rental period.

The agreement is required when a Mexican resident rents their vehicle to a foreign tourist (turista extranjero) for travel within Mexico or across the border into the United States — a cross-border trip requires a temporary vehicle import permit (permiso de importación temporal de vehículos) under Resolución Miscelánea de Comercio Exterior and additional US-territory insurance from a Mexican insurer, all of which must be addressed in the rental agreement and confirmed by the Aduana México before crossing.

For owners who participate in car-sharing or vacation rental arrangements, documenting each rental through a written agreement creates a paper trail demonstrating the uso particular nature of the arrangement — important for insurance purposes (póliza de seguro de automóvil) and for SAT income reporting, since rental income (ingresos por arrendamiento de bienes muebles) received by a persona física is taxable under LISR Article 114 at rates up to 35%, with ISR to be reported in the annual declaración.

What to Include in Your Private Vehicle Rental Agreement Mexico (Acuerdo de Renta de Vehículo Particular)

A valid Private Vehicle Rental Agreement Mexico under CCF Article 2398 must contain the following essential elements:

Vehicle Identification: Complete description of the vehicle being rented — make (marca), model (modelo), year (año), colour (color), Vehicle Identification Number (NIV — Número de Identificación Vehicular), license plates (número de placas), state of registration, Tarjeta de Circulación number, and current odometer reading (kilometraje actual). The Tarjeta de Circulación (vehicle registration card) issued by the Secretaría de Movilidad or equivalent state authority confirms the vehicle's legal registration and use category.

Party Identification: Full legal name, CURP, RFC, domicile, and driver's license number (número de licencia de conducir) and expiry date of both the owner (arrendador) and renter (arrendatario). The renter must hold a valid Mexican driver's license (licencia de conducir vigente) issued by the applicable state Secretaría de Movilidad for the vehicle class being rented.

Rental Period: The exact start date and time (fecha y hora de entrega) and agreed return date and time (fecha y hora de devolución pactada) of the vehicle. Provisions for extension of the rental period, including notice requirements and additional rental fees.

Rental Fee: The agreed rental fee (renta pactada) in Mexican pesos (MXN) — whether per day (por día), per week (por semana), or for the total rental period — and the payment method (método de pago), payment due date, and any security deposit (depósito de garantía) required to cover potential damage.

Fuel Policy: Whether the vehicle is delivered with a full tank and must be returned with a full tank (política de tanque lleno), or whether the renter pays for fuel consumed during the rental period based on the odometer reading.

Insurance Coverage: Specification of the vehicle's civil liability insurance policy (póliza de seguro de responsabilidad civil) — insurer name, policy number, coverage amounts, and deductible (deducible). Allocation between owner and renter of responsibility for insurance deductibles in case of accident, and whether the owner's policy covers third-party renters or whether the renter must obtain their own coverage.

Allowed Use Territory: The geographic area where the vehicle may be used — within a specific city or state, nationwide on federal highways, or cross-border into the United States (which requires a separate tourist vehicle permit under Resolución Miscelánea de Comercio Exterior and additional insurance coverage from a Mexican insurer authorised for border crossings).

Traffic Fines and Violations: Clear allocation that all traffic fines (multas de tránsito), parking tickets (infracciones de estacionamiento), and corralón (impoundment) fees incurred during the rental period are the renter's sole responsibility, and the procedure for reimbursing the owner if fines are issued against the vehicle's plates.

Vehicle Condition Report: An attached vehicle inspection checklist (reporte de condición) documenting the vehicle's exterior condition, interior condition, tire condition, fuel level, and any pre-existing damage (daños preexistentes) at the time of delivery, signed by both parties, which serves as the baseline for assessing return condition.

SAT Income Reporting: Rental income received by the owner (persona física arrendadora) constitutes ingreso por arrendamiento de bienes muebles under LISR Article 114, taxable at progressive ISR rates. The owner must issue a CFDI de arrendamiento for each rental payment received, report rental income in the monthly declaración provisional de ISR, and include the full annual rental income in the declaración anual filed each April through the Portal del SAT.
