What Is a Marriage Certificate Application Mexico (Trámite Acta de Matrimonio)?

A Marriage Certificate Application Mexico (Trámite de Acta de Matrimonio) is the formal administrative procedure by which two persons present their pre-matrimonial declaration (solicitud de matrimonio) before the Oficial del Registro Civil and request the scheduling of a civil marriage ceremony, ultimately producing an Acta de Matrimonio — a public document that legally establishes the marital bond and alters the civil status (estado civil) of both spouses. The Acta de Matrimonio issued by the Registro Civil is the only legally valid marriage document in Mexico; religious ceremonies have no civil legal effect under Article 130 of the Constitución Política de los Estados Unidos Mexicanos.

The legal framework governing civil marriage in Mexico derives from Articles 100 through 161 of the Código Civil Federal (CCF), which set minimum requirements for valid civil marriage throughout Mexico. Each state and Mexico City also has its own Código Civil and Ley del Registro Civil that may impose additional requirements — for example, mandatory pre-matrimonial medical examinations (exámenes prenupciales) required under some state laws under NOM-007-SSA2-1993 (maternal health) and related provisions.

Article 100 CCF establishes that persons wishing to marry must submit a written solicitud de matrimonio to the Oficial del Registro Civil of the municipio where either spouse is domiciled or where the marriage is to be celebrated. The solicitud must include full identity and civil status information for both contracting parties and their witnesses (testigos). Upon review of the application, the Oficial fixes a date for the civil ceremony — generally 8 to 15 days after application, though some states have shortened this period.

Marriage in Mexico is governed by the principle of equality between spouses under Article 4 of the Constitución Política, and Mexico City (CDMX) was the first jurisdiction in Latin America to legally recognize same-sex civil marriage under a reform to the Código Civil del Distrito Federal in December 2009. As of 2022, all 31 Mexican states and the CDMX recognize same-sex civil marriage, following a Supreme Court (SCJN) jurisprudential action (acción de inconstitucionalidad) that declared opposite-sex-only marriage definitions unconstitutional.

The Acta de Matrimonio produced by the Registro Civil is a public document under Article 327 of the Código Nacional de Procedimientos Civiles y Familiares (CNCPF) and is required by IMSS and ISSSTE for registration of the spouse as a beneficiary (derechohabiente), by the Instituto Nacional de Migración (INM) for spousal residency visas, by the SAT for joint tax filings (cómputo fiscal conjunto between spouses is not standard but marital status affects ISR deductions), by banks for joint account designations, and by foreign consulates for immigration applications.

The matrimonial property regime (régimen patrimonial del matrimonio) must be specified at the time of the marriage application: Mexico offers sociedad conyugal (community property — Article 183 CCF), under which property acquired during the marriage is jointly owned, and separación de bienes (separate property — Article 207 CCF), under which each spouse retains their own property. The chosen regime is recorded in the Acta de Matrimonio. A change of regime after marriage requires a notarial instrument and a court order under Article 267 CCF.

When Do You Need a Marriage Certificate Application Mexico (Trámite Acta de Matrimonio)?

A Marriage Certificate Application Mexico is needed whenever two persons who meet the legal requirements for civil marriage under the Código Civil Federal and the applicable state Código Civil wish to formalize their union before the Registro Civil. Without a valid Acta de Matrimonio, the couple's relationship has no civil legal status — they may be recognized as concubinos (common-law partners) after a continuous cohabitation period under Article 291-Bis CCF, but do not have the full inheritance rights, spousal presumption for IMSS and ISSSTE benefits, or joint parental authority that marriage confers.

The application is needed when either or both partners wish to register as IMSS beneficiaries (derechohabientes) under Article 84 of the Ley del Seguro Social: a spouse registered through the working partner's IMSS coverage has access to all medical, maternity, and hospitalization services of the IMSS. The Acta de Matrimonio is the primary document establishing the spousal benefit entitlement. ISSSTE coverage for federal employees similarly requires an Acta de Matrimonio for spousal registration.

Immigration proceedings requiring spousal residency in Mexico — applications for Tarjeta de Residente Temporal por vínculos familiares or Residente Permanente under Article 55 of the Ley de Migración — require the Acta de Matrimonio apostilled or legalized (if the marriage occurred abroad) as proof of the family relationship. The Instituto Nacional de Migración (INM) processes spousal residency applications based on a valid Mexican or foreign marriage certificate.

The Acta de Matrimonio is needed for name change registration: in Mexico, marriage does not legally change either spouse's official name under the CURP system, but spouses who choose to use a compound surname in social or professional contexts may document this preference in the Acta, and certain states permit marginal notations.

The document is required for estate and inheritance purposes: under Articles 1368 and 1602 of the Código Civil Federal, a surviving spouse is a forced heir (heredero forzoso) entitled to the same portion as the number of children. Without an Acta de Matrimonio, the surviving partner has no automatic inheritance right — they may have rights as concubino/a if they can prove the conditions of Article 291-Bis CCF, but this requires separate judicial proof. The Acta de Matrimonio is also needed for pension survivor benefits from AFORE retirement savings governed by the Ley de los Sistemas de Ahorro para el Retiro (LSAR).

What to Include in Your Marriage Certificate Application Mexico (Trámite Acta de Matrimonio)

A valid Marriage Certificate Application Mexico and the resulting Acta de Matrimonio under Articles 100–161 of the Código Civil Federal must contain the following essential elements to be legally complete, accepted by the Registro Civil, and recognized by government agencies and institutions.

Spouse Identification: Full legal name, date and place of birth, CURP, nationality, occupation, and domicile of both contracting parties. Proof of identity must be submitted using INE/IFE voter credential, passport, or — for foreign nationals — a Tarjeta de Residente or passport with valid immigration status issued by the INM. Both parties must appear personally before the Oficial del Registro Civil.

Civil Status Documentation: Birth certificates (Actas de Nacimiento) of both parties, demonstrating identity and current single status. If either party was previously married, dissolution documents are required: Acta de Divorcio (divorce certificate) under Articles 266–291 CCF, or Acta de Defunción of the deceased prior spouse. Mexico does not recognize divorce by mutual consent without judicial intervention except through the administrative divorce before the Registro Civil in jurisdictions that permit it (divorcio administrativo under Article 272 CCF, available in CDMX where both parties agree and have no minor children or disputed property).

Witnesses: Full name, CURP, identity document numbers, and domiciles of at least two adult witnesses (testigos) per Article 102 CCF. Witnesses must be at least 18 years old, must not be relatives of either contracting party in the direct line (padres, hijos, abuelos), and must be physically present at both the application and the ceremony. Some state civil codes require four witnesses.

Pre-Matrimonial Medical Examinations: In states that require prenupciales (pre-marital health examinations), a medical certificate issued by a licensed physician (médico titulado) confirming that neither party has a communicable disease that would legally impede marriage — specifically under Article 156 CCF, which establishes that certain incurable contagious diseases are an impediment to marriage. Blood type results are included in some state forms for obstetric records.

Matrimonial Property Regime Declaration: Explicit declaration of the chosen regime — sociedad conyugal or separación de bienes — per Articles 98 and 183 CCF. This declaration is irrevocable without a subsequent notarial instrument and court order under Article 267 CCF, making careful consideration essential. In the CDMX, the solicitud form includes checkboxes for regime selection and an explanation of each regime's consequences.

Parental Authority and Children Declaration: Disclosure of whether either party has minor children (hijos menores de edad) from prior relationships, identifying them by name and CURP. This information is used by the Registro Civil to record the marriage's effect on existing parental authority (patria potestad) arrangements.

Civil Marriage Ceremony Record: The Acta de Matrimonio itself records the date, time, and place of the civil ceremony; the names of the Oficial del Registro Civil officiating; statements of consent (manifestación de voluntad) of both parties; the matrimonial property regime; signatures of both spouses, the Oficial, and the witnesses; and the official seal of the Registro Civil.
