El Establecimiento garantiza que todos los alimentos y bebidas se prepararán y servirán en estricto cumplimiento de la Norma Oficial Mexicana NOM-251-SSA1-2009 sobre prácticas de higiene para el proceso de alimentos y bebidas, y que todo el personal manipulador de alimentos cuenta con tarjeta de salud vigente emitida por la autoridad sanitaria competente.

Todos los precios indicados en el presente contrato han sido informados al Cliente de manera previa y completa conforme al Artículo 7 de la Ley Federal de Protección al Consumidor. Los alimentos y bebidas preparados para consumo inmediato en establecimiento están sujetos al IVA a la tasa general del 16%, conforme a la Ley del Impuesto al Valor Agregado. El Establecimiento emitirá CFDI por cada pago realizado.

IV. POLÍTICA DE CANCELACIÓN

Cancelación por el Establecimiento: En caso de cancelación imputable al Establecimiento, el Cliente tendrá derecho a la devolución íntegra de todos los pagos realizados, más una pena convencional del 15% del precio total del contrato o consumo mínimo garantizado, conforme al Artículo 2117 del Código Civil Federal.

V. SEGURIDAD ALIMENTARIA E INOCUIDAD

El Establecimiento asume plena responsabilidad por la inocuidad y calidad de los alimentos y bebidas servidos al amparo del presente contrato, conforme a la NOM-251-SSA1-2009, la Ley General de Salud y el Reglamento de Control Sanitario de Productos y Servicios. En caso de incidente de enfermedad transmitida por alimentos (ETA) atribuible a negligencia en la preparación o servicio, el Establecimiento responderá por los daños causados conforme a los Artículos 1910 a 1934 del Código Civil Federal. Esta responsabilidad no puede excluirse contractualmente.

Para el servicio de bebidas alcohólicas, el Establecimiento confirma que cuenta con la licencia municipal para expendio de bebidas alcohólicas y que su personal cumple con las obligaciones de los Artículos 216 a 220 de la Ley General de Salud, incluyendo la prohibición de servir alcohol a menores de edad y a personas en estado de ebriedad evidente.

VI. PROTECCIÓN AL CONSUMIDOR Y LEY APLICABLE

El presente contrato se rige por la Ley Federal de Protección al Consumidor (LFPC), el Código Civil Federal, y la normatividad sanitaria federal aplicable de los Estados Unidos Mexicanos. El Cliente podrá presentar queja ante la Procuraduría Federal del Consumidor (PROFECO) a través del sistema CONCILIAEXPRÉS en caso de incumplimiento por parte del Establecimiento. What Is a Restaurant Services Contract Mexico (Contrato de Servicios de Restauración)?

A Restaurant Services Contract Mexico (Contrato de Servicios de Restauración) is a written agreement between a restaurant or food service establishment (establecimiento de servicio de alimentos y bebidas) and a client (cliente) — which may be an individual consumer, corporate client, or institutional food service buyer — by which the restaurant agrees to provide food and beverage services (servicios de alimentos y bebidas) for a specified arrangement, such as a private dining reservation (reservación de comedor privado), corporate food supply agreement (acuerdo de suministro de alimentos corporativo), employee cafeteria services (servicio de comedor empresarial), or regular catering arrangement, in exchange for an agreed price (precio pactado).
