IV. DERECHOS DE AUTOR (LFDA ARTÍCULOS 26–28 Y 30)

El Fotógrafo conserva en todo caso los derechos morales (derechos morales) sobre las fotografías producidas, conforme al Artículo 18 de la Ley Federal del Derecho de Autor (LFDA), incluyendo el derecho de paternidad (crédito fotográfico) y el derecho de integridad (prohibición de distorsión o mutilación). Estos derechos son inalienables e imprescriptibles.

V. HONORARIOS, ANTICIPO Y POLÍTICA DE CANCELACIÓN

VI. DERECHO A LA PROPIA IMAGEN (LFDA ARTÍCULO 87)

El Cliente es responsable de obtener las autorizaciones de uso de imagen (consentimiento expreso por escrito) de todas las personas identificables cuyos retratos fotográficos sean utilizados con fines comerciales o publicitarios, conforme al Artículo 87 de la Ley Federal del Derecho de Autor (LFDA). El Cliente libera al Fotógrafo de cualquier responsabilidad por reclamaciones de terceros relacionadas con el uso de imágenes de personas por parte del Cliente.

VII. LEY APLICABLE Y JURISDICCIÓN

El presente contrato se rige por la Ley Federal del Derecho de Autor (LFDA), el Código Civil Federal (CCF), y la Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP), todos de los Estados Unidos Mexicanos. Para cualquier controversia, las Partes se someten a los Juzgados de Distrito en Materia Civil Federal competentes.

What Is a Photography Services Contract Mexico?

A Photography Services Contract Mexico (Contrato de Prestación de Servicios Fotográficos) is a written professional services agreement governed by Article 2606 of the Código Civil Federal (CCF) and the Ley Federal del Derecho de Autor (LFDA, DOF 24 December 1996, last reformed 2023) Articles 26–28, by which a professional photographer (fotógrafo profesional) or photography studio (estudio fotográfico) agrees to provide photographic services — including event photography, commercial photography, portrait sessions, product photography, or editorial work — to a client (contratante) in exchange for agreed fees, while defining the ownership and permitted uses of the photographic works produced.

The Ley Federal del Derecho de Autor (LFDA) is the primary statute governing photographic copyright in Mexico. Article 7 LFDA recognises photographs as literary and artistic works protected by copyright from the moment of creation, without registration requirement. Articles 26–28 LFDA establish the specific rights and limitations applicable to photographic works: Article 26 LFDA provides that the author (photographer) holds full moral and economic copyright in all photographs they create; Article 26 Bis addresses the rights of persons depicted in photographs (derechos de imagen — right of publicity); and Article 27 LFDA establishes the exclusive economic rights of the copyright holder — including reproduction, distribution, public communication, transformation (including digital manipulation and derivative works), and rental of the photographic work.

A critical distinction under Mexican copyright law that every photography contract must address: under LFDA Article 83, photographs created by an employee within the scope of their employment (relación de trabajo) belong to the employer. However, photographs created by an independent contractor (contratista independiente or prestador de servicios independiente) — including the vast majority of freelance photographers — belong to the photographer as author, unless the contract includes a written cesión de derechos patrimoniales (assignment of economic copyright rights) to the client. Without an express written assignment, the client receives only a licence to use the photographs for the specific agreed purpose — the photographer retains copyright and may use, licence, or exhibit the same images.

Moral rights (derechos morales) under LFDA Article 18 are inalienable, imprescriptible, and non-transferable — the photographer retains the right of attribution (derecho de paternidad — to be credited as author), the right of integrity (derecho de integridad — to object to distortion or mutilation of the work), and the right of disclosure (derecho de divulgación — to decide when and how the work is first published). These moral rights cannot be contractually waived or assigned, even in a complete copyright assignment.

The right of publicity (derecho a la propia imagen) of individuals depicted in photographs is protected under LFDA Article 87 and the Ley Federal de Telecomunicaciones y Radiodifusión (LFTR) — any person whose image is captured and published for commercial purposes must have provided express written consent (consentimiento expreso) or an image release (autorización de uso de imagen). LFPDPPP (Ley Federal de Protección de Datos Personales en Posesión de los Particulares) also applies when photographic images of identifiable individuals are stored, processed, or published — photographs constitute personal data under INAI guidelines.

The Instituto Nacional del Derecho de Autor (INDAUTOR) — a deconcentrated body of the Secretaría de Cultura — administers copyright registration (registro de derechos de autor), mediates copyright disputes, and maintains the Registro Público del Derecho de Autor. While copyright protection in Mexico arises automatically at creation without registration, voluntary registration with INDAUTOR provides a public record (fecha cierta) and simplifies enforcement proceedings.

When Do You Need a Photography Services Contract Mexico?

A Photography Services Contract Mexico is required whenever a client engages a professional photographer for commercial, editorial, event, or portrait photography — and is essential under LFDA Articles 26–28 to establish copyright ownership, permitted uses, and deliverable obligations.

The contract is needed for commercial photography engagements — product photography for e-commerce platforms (Mercado Libre, Amazon México, brand websites), advertising campaigns requiring commercial image rights, corporate headshots (fotografías corporativas) for executive teams and annual reports, and architectural photography for real estate developers and interior design firms. Commercial clients require full copyright assignment (cesión de derechos patrimoniales) or at minimum a broad commercial licence to use images across digital and print channels.

What to Include in Your Photography Services Contract Mexico

Identification of Parties: Full legal name, RFC, and domicilio of both the photographer or photography studio (prestador del servicio) and the client (contratante). For commercial clients contracting with the photographer, the Registro Público de Comercio reference and representative authority should be specified.

Detailed Description of Photography Services: Specific service type — event photography (number of hours, coverage start and end times, locations), commercial photography (product categories, number of images, set and studio requirements), portrait sessions (number of subjects, duration, location), or editorial assignment. For event photography, the confirmed date, venue address, and specific events to be covered (ceremonia religiosa, recepción, sesión de pareja, etc.).

Deliverables — Format, Quantity, and Timeline: The number of edited photographs (fotos editadas) to be delivered, file format (high-resolution JPEG, TIFF, or RAW), minimum resolution (megapixels or pixel dimensions), delivery method (Wetransfer, Google Drive, USB drive), and delivery deadline (plazo de entrega). For event photography, the turnaround time for edited images is critical — typically 4–8 weeks for weddings. Specification of whether RAW files are included in the deliverables or retained by the photographer.

Copyright Ownership — LFDA Cesión or Licencia: The most critical clause. Two alternatives: (1) Cesión de derechos patrimoniales (copyright assignment) — the photographer transfers all economic copyright rights in the delivered photographs to the client, permanently and for the territory agreed, with consideration included in the service fee. The photographer retains inalienable moral rights (derechos morales) under LFDA Article 18 — including attribution rights. (2) Licencia de uso (licence) — the photographer grants the client a non-exclusive licence to use the photographs for specific defined purposes (e.g., personal use, one website, one advertising campaign), for a defined territory and duration — the photographer retains copyright and may licence the same images to others unless exclusivity is granted. Commercial clients typically require full copyright assignment or exclusive broad commercial licences. Event clients (weddings, quinceañeras) typically receive a personal-use licence with the right to print and share on personal social media.

Image Rights and LFDA Article 87 Releases: For any photography involving identifiable individuals who are not paid models — guests at events, employees in corporate photography, subjects of portrait sessions — the contract should address the right of image (derecho a la propia imagen) under LFDA Article 87. For commercial use of images depicting identifiable individuals, a separate written image release (autorización de uso de imagen) from each depicted person is required. The contract should specify who is responsible for obtaining these releases — typically the client for models and employees they engage, and the photographer for any third parties incidentally depicted.

Photographer Credit and Portfolio Use: The photographer's right to include delivered photographs in their professional portfolio (portafolio profesional), website, and social media showcases — subject to any confidentiality or embargo restrictions specified by the client. Travel expenses (gastos de traslado), equipment hire, and assistant costs reimbursement terms.

Cancellation, Postponement, and Failure to Perform: Cancellation penalty scale for client-initiated cancellations — graduated by proximity to the event date. Photographer's obligation to provide a qualified substitute (fotógrafo sustituto) of equivalent skill if incapacitated on the event date. The client's remedies — partial or full refund — if the photographer fails to appear without a substitute.
