What Is a Notice of Works by Landlord Spain?

A Notice of Works by Landlord Spain (Notificación de Obras del Arrendador) is the formal written notification that a landlord (arrendador) must serve on a tenant (arrendatario) before commencing necessary conservation works, improvement works, or urgently required repairs on a rented property in Spain, pursuant to Article 22 of the Ley de Arrendamientos Urbanos (LAU), Ley 29/1994, de 24 de noviembre. Article 22 LAU distinguishes between conservation works (obras de conservación) necessary to maintain the property in habitable condition and improvement works (obras de mejora) that increase the property's utility, safety, or comfort — each category has different notice requirements and consequences for the tenancy.

Conservation works under Article 21 LAU are obligatory for the landlord — the property must be maintained in habitable condition (condición de habitabilidad) throughout the tenancy, and the tenant must tolerate necessary repairs. The landlord's obligation to carry out conservation works does not require tenant consent, but Article 22.1 LAU requires that the tenant be notified with at least three months' advance notice of the planned works, their nature, expected duration, and likely impact on the use of the dwelling.

Improvement works (obras de mejora) under Article 22 LAU are those that increase the property's value or utility beyond mere maintenance — energy efficiency improvements, installation of new systems, structural upgrades, or aesthetic improvements. For improvement works, the tenant has specific rights: if the works significantly affect the habitability of the dwelling, the tenant may withdraw from the contract without penalty under Article 22.2 LAU. If the works do not make the dwelling uninhabitable but inconvenience the tenant, the tenant is entitled to a rent reduction proportional to the area of the dwelling affected by the works under Article 22.4 LAU.

The statutory three-month notice period is a mandatory minimum — neither the lease contract nor any agreement between the parties can reduce it below three months for urban dwellings subject to the LAU. The notice must be served in writing and must specify the nature of the works, the expected start date, the estimated duration, the parts of the dwelling affected, and the contractor or responsible party carrying out the works. Proper written notice under Article 22 LAU has several legal consequences: it interrupts the tenant's right to object to the works on grounds of lack of notice; it triggers the tenant's right to withdraw from the contract if the works render the dwelling uninhabitable; and it provides documentary evidence in any subsequent dispute before a Juzgado de Primera Instancia.

Spain's civil courts — Juzgados de Primera Instancia — have jurisdiction over LAU disputes under Ley 29/1994. The Tribunal Supremo's civil chamber has confirmed in multiple judgments that failure to provide the required three-month advance notice for improvement works entitles the tenant to seek damages and potentially resist the works, though the landlord retains the right to carry out conservation works necessary to prevent deterioration of the property even with shorter notice in urgent circumstances under Article 21.3 LAU.

The legal framework governing the Notice of Works by Landlord Spain in Spain draws on several key statutes and regulatory bodies. Under the Ley de Arrendamientos Urbanos (LAU) 29/1994, Spanish tenancy law sets minimum duration (5 years individuals, 7 years entities) and deposit requirements. The Código Civil Articles 1445–1541 govern sale of property. The Ley Hipotecaria governs the Registro de la Propiedad. The Ley 5/2019 (LCCI) regulates mortgage lending with mandatory FEIN/FiAE disclosure. The Impuesto sobre Transmisiones Patrimoniales (ITP) applies to property transfers. Parties executing a Notice of Works by Landlord Spain in Spain should confirm the document reflects current law, including any amendments enacted since the original drafting date. The Ley 29/1994, de 24 de noviembre, de Arrendamientos Urbanos (LAU), art. 22 sets the foundational requirements.

When Do You Need a Notice of Works by Landlord Spain?

A Notice of Works by Landlord Spain is required whenever a property owner intends to carry out works on a rented property and the works fall within the categories regulated by Articles 21 and 22 of the Ley de Arrendamientos Urbanos (LAU), Ley 29/1994.

The notice is needed when a landlord plans conservation works (obras de conservación) to maintain the property in habitable condition — repairs to the roof, plumbing, electrical installations, structural elements, or heating systems that are necessary to prevent deterioration. While conservation works can be carried out without tenant consent, advance written notice is required to allow the tenant to prepare for disruption.

A formal notice is required when a landlord intends to carry out improvement works (obras de mejora) — installing a new lift, energy efficiency improvements, double glazing, or structural upgrades — particularly where those works require access to the rented premises or will affect the tenant's enjoyment of the property for an extended period.

The notice is needed when works are necessary due to administrative orders from the Ayuntamiento, Comunidad Autónoma, or Consorcio de la Zona Franca — compulsory improvement orders (órdenes de ejecución) or urban planning requirements may force landlords to carry out works that directly affect tenants.

A Notice of Works is required when urgent repairs cannot be deferred — Article 21.3 LAU permits the landlord to carry out urgent works without waiting for the three-month period when immediate action is required to prevent serious damage or to comply with a statutory obligation. However, even in urgent cases, written notice should be served as soon as reasonably practicable.

The notice is also needed when the works will be carried out by a comunidad de propietarios (homeowners' association) under the Ley de Propiedad Horizontal (LPH) — the landlord-member must transmit the comunidad's works notification to the tenant and confirm the tenant's statutory rights under Article 22 LAU are respected regardless of the communal nature of the works.

Parties in Spain should prepare a Notice of Works by Landlord Spain proactively rather than waiting for a dispute to arise. Courts interpret agreements based on the written terms rather than oral representations. Where the transaction involves regulated activities, prior approval from the relevant authority may be required before execution.

What to Include in Your Notice of Works by Landlord Spain

A legally valid Notice of Works by Landlord Spain under Article 22 of LAU (Ley 29/1994) must contain all of the following elements to comply with statutory requirements and protect both landlord and tenant rights.

Identification of Parties: Full name, DNI/NIE or NIF, and address of the landlord (arrendador). Full name and current address of the tenant (arrendatario) — the notice should be addressed to all named tenants in the lease contract. Reference to the lease agreement date and the property address (dirección del inmueble), including floor, door, and cadastral reference (referencia catastral) from the Sede Electrónica del Catastro.

Property Description: Full address of the rented property — street, number, floor, door, municipality, and postal code. Cadastral reference where available. If the property is part of a Comunidad de Propietarios, the community's name or address block reference.

Nature and Scope of Works: Clear description of the planned works — whether they are conservation works (obras de conservación) under Article 21 LAU or improvement works (obras de mejora) under Article 22 LAU. Specific description of each work element: area of the dwelling affected, type of repair or improvement, materials to be used, and any structural changes. Reference to any administrative permit (licencia de obras mayor or menor) from the Ayuntamiento, building inspection report, or technical architect's (arquitecto técnico) report requiring the works.

Timeline: Expected start date of the works. Estimated duration of the works. Expected completion date. Anticipated days or periods when access to the property or specific rooms will be required. This timing information triggers the tenant's right to withdraw under Article 22.2 LAU if the works will make the dwelling uninhabitable.

Rent Reduction Notice: If the works will reduce the tenant's enjoyment of the property — blocking access to rooms, restricting kitchen or bathroom use, generating dust, noise, or temporary disruption — the landlord should acknowledge the tenant's right to a proportional rent reduction under Article 22.4 LAU for the affected area during the works period.

Tenant Rights Statement: Notification to the tenant of their rights under LAU Article 22: (1) right to withdraw from the contract without penalty if the works render the dwelling uninhabitable for the duration; (2) right to a proportional rent reduction for rooms made unusable; (3) right to be compensated for costs necessarily incurred as a result of the works. These must be explicitly stated to avoid subsequent disputes.

Contact Details for Works Management: Name and contact details of the contractor (empresa constructora) carrying out the works. Working hours during which works will take place — must comply with municipal ordinances on permitted construction hours (ordenanzas municipales sobre horarios de obras) in the relevant Ayuntamiento. Emergency contact for issues arising during works.
