El/La solicitante solicita el reconocimiento de la pensión de viudedad al amparo del artículo 219 del Real Decreto Legislativo 8/2015, de 30 de octubre, por el que se aprueba el Texto Refundido de la Ley General de la Seguridad Social (LGSS). La pensión de viudedad corresponde al cónyuge superviviente o, en su caso, al/la sobreviviente de una pareja de hecho que cumpla los requisitos del artículo 221 LGSS.

La base reguladora de la pensión se calculará conforme al artículo 227 LGSS, siendo el porcentaje de la base reguladora el 52 por ciento, incrementable hasta el 70 por ciento para los supuestos del artículo 31 del Real Decreto-ley 15/2020 cuando concurran hijos a cargo con ingresos reducidos.
