What Is a Unemployment Benefits Application Spain?

An Unemployment Benefits Application Spain (Solicitud de Prestación por Desempleo) is the formal claim submitted to the Servicio Público de Empleo Estatal (SEPE) by a worker who has become unemployed involuntarily and wishes to claim the contributory unemployment benefit (prestación contributiva por desempleo) established under Articles 262 to 278 of the Ley General de la Seguridad Social (Real Decreto Legislativo 8/2015, de 30 de octubre — LGSS), developed by the Real Decreto 625/1985, de 2 de abril, and subsequent regulations.

The prestación contributiva por desempleo is a replacement income benefit paid by the SEPE, replacing the worker's salary during the period of involuntary unemployment. Article 266 LGSS sets out the entitlement requirements: the worker must be in a legal situation of unemployment (situación legal de desempleo), as defined by Article 267 LGSS — which includes dismissal (despido), objective dismissal (despido objetivo), collective redundancy (ERE — expediente de regulación de empleo), end of a temporary contract, company dissolution, resignation with just cause (dimisión justificada), and suspension of the employment contract under Articles 45 and 47 ET. Voluntary resignation without just cause does not give rise to entitlement under Spanish law.

The contributory benefit is calculated as a percentage of the worker's base reguladora — the average of the contribution bases for contingencias profesionales (occupational contingencies) in the six months preceding the unemployment. During the first 180 days of the benefit, the worker receives 70% of the base reguladora; from day 181 onwards, the rate drops to 50%. The minimum benefit is 80% of the IPREM (Indicador Público de Renta de Efectos Múltiples) without dependent children, or 107% with one dependent child, or 120% with two or more dependent children — and the maximum benefit is 175% of the IPREM without dependent children, rising to 200% or 225% with dependent children.

The duration of the prestación contributiva depends on the period of contributions (cotizaciones por desempleo) in the six years prior to unemployment: from 360 to 539 days of contributions, 120 days of benefit; from 540 to 719 days, 180 days; and so on up to 2,160 or more days of contributions, which generates 720 days (two years) of maximum benefit, as set out in the contribution table in Article 269 LGSS.

The SEPE (Servicio Público de Empleo Estatal) is the Spanish state employment agency responsible for managing unemployment benefits, active employment policies, and the Catálogo de Ocupaciones de Difícil Cobertura. Workers must register as job seekers (demandantes de empleo) with the SEPE or the corresponding autonomous community employment service (e.g. SOC in Catalonia, SEXPE in Extremadura, SAE in Andalusia) simultaneously with filing the benefit application, and must maintain their availability for work and comply with active job search obligations throughout the benefit period.
