What Is a Preventive Power of Attorney Spain (Poder Preventivo)?

A Preventive Power of Attorney Spain (Poder Preventivo) is a notarial document by which a person grants an agent (apoderado) authority that expressly survives — or comes into effect upon — the legal incapacitation or loss of mental capacity of the principal (poderdante). The Poder Preventivo is the primary planning instrument in Spanish law for protecting persons who anticipate future loss of decision-making capacity through aging, illness, or disability — it is governed by the Código Civil as reformed by Ley 8/2021, de 2 de junio, de reforma de la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica (Disability Reform Act 2021).

Prior to Ley 8/2021, Article 1732 of the Código Civil provided that a power of attorney was extinguished by the incapacitation (incapacitación) of the poderdante, subject to a specific exception: a power that expressly states it is granted to take effect in the event of the poderdante's incapacitation, or that expressly states it remains valid notwithstanding subsequent incapacitation, was recognised as a Poder Preventivo. Ley 8/2021 fundamentally reformed the framework by replacing judicial incapacitation (incapacitación judicial) with a system of supported decision-making (apoyos para el ejercicio de la capacidad jurídica) — the new Article 249 CC recognises that all persons with disabilities have full legal capacity and that support measures supplement rather than replace their capacity. Within this new framework, the Poder Preventivo remains the key voluntary planning instrument, now referred to as medidas de apoyo voluntarias (voluntary support measures).

Article 1732 CC as reformed by Ley 8/2021 now provides that a power of attorney granted by a person may include a clause stating that it does not extinguish upon the principal's loss of capacity — creating the Poder Preventivo. Additionally, a power may be granted to take effect only when the principal needs support — creating a suspended preventive power (poder preventivo de activación). This flexibility allows Spanish residents to plan for multiple scenarios: a present-effect power covering ongoing matters that continues even if capacity is lost, or a dormant power activated only when a triggering event (such as a medical diagnosis) occurs.

The Poder Preventivo under Spanish law performs functions broadly similar to the Lasting Power of Attorney in England and Wales (Mental Capacity Act 2005), the Vorsorgevollmacht in Germany, and the mandat de protection future in France — but with important differences in scope, registration, and oversight. In Spain, there is no central register of Poderes Preventivos equivalent to the Office of the Public Guardian in England; the Consejo General del Notariado maintains a register of powers of attorney (Registro General de Actos de Última Voluntad and the Registro de Poderes Notariales) which notaries consult when acting on a power, but registration is declaratory rather than constitutive.

The Poder Preventivo is particularly important for adult children planning for elderly parents, for persons recently diagnosed with progressive conditions such as dementia or Alzheimer's disease, and for persons with intellectual or psychosocial disabilities who wish to formally designate a trusted support person before any judicial intervention becomes necessary.

When Do You Need a Preventive Power of Attorney Spain (Poder Preventivo)?

A Preventive Power of Attorney Spain is used in specific life planning and disability protection contexts under Spanish law.

A Poder Preventivo is needed by any adult who wishes to designate a trusted person to manage their personal, financial, and healthcare affairs in the event of future loss of mental capacity — whether through aging, dementia, stroke, serious illness, or accident. The power allows the person to make this decision while they still have full capacity, avoiding the need for a judicial protection measure (medida judicial de apoyo) under the new Ley 8/2021 framework.

The power is required when elderly parents wish to authorise an adult child to manage their bank accounts, real estate, tax filings, and healthcare decisions without needing court supervision — providing practical continuity of management if the parent's condition deteriorates.

A Poder Preventivo is needed when a person receives a diagnosis of a progressive condition — such as early-stage Alzheimer's disease, multiple sclerosis, or Parkinson's disease — and wishes to put support arrangements in place while still fully able to choose and instruct their preferred agent.

The power must expressly state either: (a) that it does not extinguish upon the poderdante's loss of capacity (poder preventivo de efecto inmediato); or (b) that it only takes effect upon the poderdante's loss of capacity, to be evidenced by medical certification from two registered physicians (poder preventivo de activación diferida). Under Ley 8/2021, the preferred formulation refers to the poderdante's need for support in the exercise of their legal capacity rather than to incapacitation.

Scope of Powers: The specific acts the apoderado is authorised to perform — typically covering: banking and financial management (gestión de cuentas bancarias, inversiones, pensiones); real estate management (gestión de bienes inmuebles including rental, sale, and mortgage); tax filings before the AEAT (declaraciones fiscales); healthcare decisions (decisiones sanitarias) including hospital admission, medical treatment consent, and care home arrangements; and administrative procedures before the Seguridad Social (TGSS), local authorities, and other public bodies.

Healthcare Powers: Where the poderdante wishes the apoderado to make healthcare decisions, the power should specifically address: consent to medical treatment under Ley 41/2002 Básica Reguladora de la Autonomía del Paciente; decisions regarding care home placement; and advance healthcare directives (instrucciones previas or testamento vital) if separately executed.

Personal Welfare Provisions: Under Ley 8/2021, a Poder Preventivo may address personal welfare matters — where the poderdante wishes to live, with whom, and in what circumstances — as guidance for the apoderado and any supervising court.

Duration and Termination: The power continues until revoked by the poderdante while they retain capacity, or until terminated by a judicial protection measure appointed by a Juzgado de Primera Instancia under the new Ley 8/2021 support framework.
