3. MARCO JURÍDICO — LEY 8/2021

El presente acuerdo se enmarca en el artículo 215 del Código Civil y la Ley 8/2021, de 2 de junio, por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica — que sustituyó la declaración judicial de incapacitación por un modelo de apoyos alineado con la Convención de la ONU sobre los Derechos de las Personas con Discapacidad (CDPD), ratificada por España el 3 de diciembre de 2007.

Ley 8/2021 fundamentally transformed Spain's legal framework for persons with disabilities, replacing the traditional declaración judicial de incapacitación — which judicially removed legal capacity — with a new model of apoyos (supports) that respects the person's legal capacity and autonomy in accordance with the Convención de la ONU sobre los Derechos de las Personas con Discapacidad (CRPD — ratified by Spain on 3 December 2007).
