Alta en la Seguridad Social: De conformidad con el Real Decreto 1493/2011 y el Real Decreto-Ley 28/2018, la empresa colaboradora dará de alta al becario/a en la Tesorería General de la Seguridad Social (TGSS) a través del CCC de la empresa ([CCC]) antes del inicio de las prácticas. El alta abarcará contingencias comunes y contingencias profesionales (AT/EP — accidentes de trabajo y enfermedades profesionales) en el Régimen General de la Seguridad Social. El incumplimiento de esta obligación constituye una infracción grave conforme al Real Decreto Legislativo 5/2000 (LISOS), sancionable con multa de entre 626 y 6.250 euros.

6. PREVENCIÓN DE RIESGOS LABORALES / OCCUPATIONAL HEALTH AND SAFETY

La empresa colaboradora tiene las mismas obligaciones en materia de prevención de riesgos laborales respecto al becario/a que respecto a sus propios trabajadores, conforme al artículo 3 de la Ley 31/1995 de Prevención de Riesgos Laborales (LPRL). Antes del inicio de las prácticas, la empresa deberá: llevar a cabo la evaluación de riesgos del puesto de trabajo del becario/a (art. 16 LPRL); impartir formación e información sobre seguridad e higiene en el trabajo (art. 18 LPRL); y proporcionar los equipos de protección individual (EPIs) necesarios (art. 17 LPRL).

7. EVALUACIÓN Y CERTIFICACIÓN / EVALUATION AND CERTIFICATION

El tutor de empresa ([Company Tutor]) realizará evaluaciones periódicas del desempeño del becario/a y remitirá un informe de valoración final al centro educativo al término de las prácticas. A la finalización, la empresa colaboradora expedirá un certificado de prácticas en el que consten la duración, las tareas realizadas y las competencias adquiridas, para su inclusión en el expediente académico del becario/a.

8. LEGISLACIÓN APLICABLE / GOVERNING LAW

Este acuerdo se rige por el Derecho español, principalmente el Real Decreto 1493/2011, el Real Decreto-Ley 28/2018, el Real Decreto 592/2014 y la Ley Orgánica 3/2022 de Ordenación e Integración de la Formación Profesional. Para los contratos de formación en alternancia, es también de aplicación el artículo 11.2 del Estatuto de los Trabajadores (RDL 2/2015). Los litigios se resolverán ante el Juzgado de lo Social o el Juzgado de Primera Instancia según la modalidad de prácticas aplicable.

An Internship Agreement Spain (Contrato de Prácticas Formativas / Acuerdo de Colaboración en Prácticas) governed by Real Decreto 1493/2011 and Ley Orgánica 3/2022 is a formal written agreement under which a company or institution (empresa colaboradora or entidad colaboradora) accepts a student or recent graduate (becario or estudiante en prácticas) for a period of professional training that complements their academic or vocational education.
