La empresa de limpieza aportará todos los productos de limpieza, materiales fungibles y equipos necesarios para la prestación de los servicios contratados, salvo acuerdo escrito en contrario. El pago se realizará en los 30 días siguientes a la fecha de factura conforme a la Ley 3/2004 de lucha contra la morosidad. Cualquiera de las partes podrá resolver el presente contrato mediante [Notice Period] de preaviso escrito previo. La resolución anticipada por el Cliente sin causa justificada dará derecho a la empresa de limpieza a reclamar daños y perjuicios conforme al artículo 1101 del Código Civil. La resolución por incumplimiento esencial (incumplimiento de los estándares de calidad del servicio o falta de pago) requiere notificación escrita especificando el incumplimiento y un período de subsanación de 15 días antes de que surta efecto el preaviso de resolución. 5. COORDINACIÓN DE ACTIVIDADES EMPRESARIALES (CAE) / OCCUPATIONAL RISK COORDINATION

Ambas partes cumplirán las obligaciones de coordinación de actividades empresariales (CAE) conforme al RD 171/2004. El Cliente facilitará a la empresa de limpieza documentación sobre los riesgos del lugar de trabajo y los procedimientos de emergencia. La empresa de limpieza aportará su evaluación de riesgos, registros de formación de trabajadores, evidencia de EPI y certificado de seguro antes del inicio de los servicios, y mantendrá esta documentación actualizada durante toda la vigencia del contrato. 6. PROTECCIÓN DE DATOS / DATA PROTECTION

Cuando los trabajadores de limpieza accedan a zonas en las que se traten datos personales del Cliente, la empresa de limpieza actuará como encargada del tratamiento conforme al artículo 28 del Reglamento (UE) 2016/679 (RGPD) y la Ley Orgánica 3/2018 (LOPDGDD). Las partes suscribirán un acuerdo de encargo de tratamiento según proceda. La empresa de limpieza instruirá a sus trabajadores para que mantengan estricta confidencialidad sobre cualquier información personal o comercial a la que tengan acceso durante la prestación de los servicios. El presente contrato se rige por el Derecho español — artículo 1544 del Código Civil, el Convenio Colectivo Estatal del Sector de Limpieza de Edificios y Locales y la normativa aplicable en materia de salud y seguridad laboral. Las controversias se resolverán ante el Juzgado de Primera Instancia de la jurisdicción donde se ubiquen las instalaciones objeto del servicio. What Is a Cleaning Services Contract Spain (Contrato de Limpieza)?

A Cleaning Services Contract Spain (Contrato de Limpieza) is a formal written agreement between a client (cliente) — whether a business, property owner, or public body — and a professional cleaning company (empresa de limpieza) or self-employed cleaner (trabajador autónomo) to provide regular or one-off professional cleaning services for commercial, residential, industrial, or public premises, governed principally by Article 1544 of the Código Civil (CC) on the arrendamiento de servicios (services contract) and, where the cleaning company employs workers, by the applicable Convenio Colectivo del Sector de Limpieza de Edificios y Locales.

Article 1544 CC defines the arrendamiento de servicios as an agreement by which one party (the service provider) undertakes to perform a service for another (the client) in exchange for a price.
