What Is a General Liability Waiver and Release Colombia?

A General Liability Waiver and Release in Colombia is a legal document under which a person (the Releasor) voluntarily acknowledges the inherent risks of an activity and waives in advance any claims for damages arising from participation. Governed by Código Civil Articles 1602 and 2341, the waiver is valid for ordinary risks but cannot override liability for gross negligence or wilful misconduct, and cannot be imposed on consumers under Ley 1480 de 2012 Article 43. The Corte Suprema de Justicia has upheld such waivers when the release is free, informed, and specific about the risks assumed.

The legal framework governing the General Liability Waiver and Release Colombia in Colombia draws on several key statutes and regulatory bodies. Under Colombian law, the Codigo Civil governs marriage, divorce, custody, and maintenance. The Ley 1098 de 2006 (Codigo de la Infancia y la Adolescencia) protects minors through the ICBF (Instituto Colombiano de Bienestar Familiar). The Ley 640 de 2001 governs conciliation. The Registraduria Nacional del Estado Civil records births, marriages, and deaths. The Defensoria del Pueblo protects fundamental rights. Parties executing a General Liability Waiver and Release Colombia in Colombia should confirm the document reflects current law, including any amendments enacted since the original drafting date. The Código Civil art. 2341; Ley 1480 de 2012 art. 43 sets the foundational requirements.

When Do You Need a General Liability Waiver and Release Colombia?

A Liability Waiver and Release in Colombia is needed whenever an organizer offers an adventure sport, recreational activity, medical procedure, educational outing, or corporate event with inherent physical risk. It must be signed before the activity, with adequate time for the participant to read and understand the specific risks. Activity providers registered under Decreto 2119/2018 (adventure tourism), gyms, sporting event organizers, and medical aesthetic clinics all require this document. Courts will scrutinize waivers signed under duress immediately before an activity begins.

Parties in Colombia should prepare a General Liability Waiver and Release Colombia proactively rather than waiting for a dispute to arise. Courts interpret agreements based on the written terms rather than oral representations. Under Colombian law, the Codigo Civil governs marriage, divorce, custody, and maintenance. The Ley 1098 de 2006 (Codigo de la Infancia y la Adolescencia) protects minors through the ICBF (Instituto Colombiano de Bienestar Familiar). The Ley 640 de 2001 governs conciliation. The Registraduria Nacional del Estado Civil records births, marriages, and deaths. The Defensoria del Pueblo protects fundamental rights. Where the transaction involves regulated activities, prior approval from the relevant authority may be required before execution.

What to Include in Your General Liability Waiver and Release Colombia

A valid Liability Waiver and Release in Colombia must include: full identification of both parties with cédula or NIT; detailed description of the specific activity and date; precise enumeration of the risks assumed (not a generic catch-all); declaration of the releasor's physical fitness; scope of waiver limited to ordinary negligence (not gross negligence or wilful misconduct); legal guardian signature for minors under Código Civil art. 1503; and autograph or digital signature compliant with Ley 527/1999. Overly broad waivers covering all possible damages are regularly invalidated by Colombian civil courts.
