What Is a Automatic Debit Authorization Colombia (Autorización de Débito Automático)?

Automatic Debit Authorization Colombia (Autorización de Débito Automático) is a formal written instruction by which an account holder (titular de la cuenta) authorises a financial institution (entidad financiera) to debit specified amounts from the account holder's bank account — cuenta corriente (checking account) or cuenta de ahorros (savings account) — at regular intervals or upon the occurrence of specified events, for the purpose of paying obligations to a designated beneficiary. The legal framework governing automatic debit authorisations in Colombia rests on the Estatuto Orgánico del Sistema Financiero (EOSF — Decreto 663 de 1993), the Código Civil (CC — Ley 84 de 1873) Articles 1602 through 1617 on contractual obligations, and the regulatory circulars issued by the Superintendencia Financiera de Colombia (SFC).

The Constitución Política de Colombia de 1991, Article 335, declares that financial activities are of public interest and may only be conducted by institutions authorised by the State, subject to regulation and supervision. The SFC, created by Ley 964 de 2005 and its predecessor regulations, exercises thorough supervision over banks (establecimientos bancarios), cooperativas financieras, compañías de financiamiento, and other entities that offer deposit and payment services. Automatic debit services constitute operaciones autorizadas under EOSF Part 3 — financial institutions provide these services as part of their deposit contract (contrato de depósito) regulated by CC Articles 2236 through 2246 and the Código de Comercio (CCo — Decreto 410 de 1971) Articles 1382 through 1392.

Under Colombian law, the automatic debit authorisation operates as a mandato (agency) granted by the account holder to the financial institution under CC Articles 2142 through 2199. The account holder (mandante) instructs the financial institution (mandatario) to execute periodic debits on the account holder's behalf, directing the debited funds to the designated beneficiary — a utility company (empresa de servicios públicos), an insurance company (aseguradora), a telecommunications provider, a loan creditor, a pension fund administrator (AFP), or any other person or entity to whom the account holder owes recurring payments.

The SFC's Circular Básica Jurídica (CE 029 de 2014) — Title I, Chapter 6 — establishes consumer protection standards for financial services, including requirements that automatic debit authorisations be granted voluntarily by the account holder, that the financial institution clearly inform the account holder of the terms and conditions, and that the account holder retain the right to revoke the authorisation at any time. Under Ley 1328 de 2009 (Régimen de Protección al Consumidor Financiero) Article 5 literal d, financial consumers have the right to receive clear, complete, and timely information about the products and services they contract.

The ACH Colombia (Cámara de Compensación Automatizada) operates the electronic payment system through which most automatic debits are processed in Colombia. ACH Colombia, supervised by the SFC, supports the electronic transfer of funds between financial institutions participating in the automatic debit system. Under the operating rules established by ACH Colombia and approved by the SFC, originating entities (entidades originadoras) submit debit instructions to the clearing house, which processes the transactions in batch cycles and settles inter-institutional balances through the Banco de la República's CUD (Cuentas de Depósito) system.

The Ley 1480 de 2011 (Estatuto del Consumidor) provides additional protections for consumers who authorise automatic debits for the payment of goods and services. Under Article 37 of the Estatuto del Consumidor, terms and conditions of recurring payment arrangements must be transparent and may not include abusive clauses (cláusulas abusivas) that create a significant imbalance between the rights and obligations of the parties.

When Do You Need a Automatic Debit Authorization Colombia (Autorización de Débito Automático)?

Automatic Debit Authorization Colombia is needed whenever an account holder seeks to establish an automated payment mechanism through a financial institution supervised by the Superintendencia Financiera de Colombia (SFC) for recurring obligations, eliminating the need for manual payment instructions for each billing cycle. The authorisation creates a standing instruction under the mandato framework of Código Civil (CC) Articles 2142 through 2199, allowing the financial institution to debit the designated account without requiring separate approval for each transaction.

The authorisation is required when individuals or businesses contract automatic payment services for utility bills — electricity (energía eléctrica) from companies like Enel Codensa or EPM, water and sewage (acueducto y alcantarillado) from the Empresa de Acueducto de Bogotá, natural gas from Vanti or Gases del Caribe, and telecommunications services from Claro, Movistar, or Tigo. Under Ley 142 de 1994 (Régimen de Servicios Públicos Domiciliarios) Article 146, utility companies may offer automatic debit as a payment method, and the SFC supervises the financial institutions processing these transactions.

The document is needed when borrowers authorise banks to debit monthly loan repayments — cuotas de crédito hipotecario (mortgage instalments), créditos de libre inversión (personal loans), créditos de vehículo (auto loans), or revolving credit card payments. Under the EOSF (Decreto 663 de 1993) and the SFC's prudential regulations, financial institutions commonly require borrowers to set up automatic debit as a condition of credit approval, confirming regular payment collection and reducing default risk.

The authorisation is required when employees or independent contractors direct their employer or paying entity to debit their bank account for contributions to fondos de pensiones voluntarias (voluntary pension funds) under Estatuto Tributario Article 126-1, aportes a cuentas AFC (savings accounts for housing promotion) under ET Article 126-4, or additional contributions to EPS (Entidad Promotora de Salud) health insurance plans beyond the mandatory contribution under Ley 100 de 1993.

The document is needed when businesses authorise automatic debits for supplier payments, lease payments (cánones de arrendamiento) under CC Article 1973, insurance premiums (primas de seguro) to companies supervised by the SFC, or contributions to cajas de compensación familiar under Ley 21 de 1982.

Parties in Colombia should prepare a Automatic Debit Authorization Colombia (Autorización de Débito Automático) proactively rather than waiting for a dispute to arise. Courts interpret agreements based on the written terms rather than oral representations. Under the Codigo de Comercio Articles 619-668, titulos valores (negotiable instruments) are governed in Colombia. The Superintendencia Financiera de Colombia (SFC) supervises banking and securities. The DIAN administers IVA and Impuesto de Renta under the Estatuto Tributario. The Banco de la Republica sets monetary policy. The Ley 1231 de 2008 governs factoring. The UIAF enforces anti-money-laundering regulations. Where the transaction involves regulated activities, prior approval from the relevant authority may be required before execution.

What to Include in Your Automatic Debit Authorization Colombia (Autorización de Débito Automático)

Automatic Debit Authorization Colombia under the Estatuto Orgánico del Sistema Financiero (EOSF — Decreto 663 de 1993), Código Civil (CC) Article 1602, and the SFC's Circular Básica Jurídica (CE 029 de 2014) must contain the following essential elements to constitute a valid standing instruction to the financial institution.

Account Holder Identification: The full legal name of the titular de la cuenta (account holder) — persona natural or razón social for persona jurídica — together with the número de identificación (cédula de ciudadanía for individuals, NIT for legal entities), address, and contact information. For legal entities, the signature of the representante legal with authority to bind the company as registered on the Certificado de Existencia y Representación Legal issued by the Cámara de Comercio. The account holder is the mandante (principal) under CC Article 2142 who grants the financial institution the instruction to execute debits.

Financial Institution Details: The name of the entidad financiera (bank or financial institution) where the account is held — for example, Bancolombia, Banco de Bogotá, Davivienda, or BBVA Colombia — all of which are supervised by the Superintendencia Financiera de Colombia (SFC) under the EOSF framework. The financial institution acts as mandatario (agent) executing the debit instructions on behalf of the account holder.

Account Information: The account type — cuenta corriente (checking account) or cuenta de ahorros (savings account) — and the account number to be debited. Under CCo Articles 1382 through 1392, the deposit contract between the account holder and the financial institution establishes the account holder's right to instruct debits, and the financial institution's obligation to execute authorised debits within the available balance.

Beneficiary Identification: The full legal name or razón social and NIT of the beneficiario (payee) — the person or entity receiving the debited funds. The beneficiary may be a utility company, insurance company, creditor, landlord, government entity, or any other payee to whom the account holder owes recurring payments.

Debit Amount and Frequency: The amount to be debited — which may be a fixed amount (valor fijo), a variable amount matching the billing statement (valor según factura), or a maximum amount (tope máximo) that the account holder authorises per transaction. The frequency of debits — monthly (mensual), bimonthly (bimestral), quarterly (trimestral), or as per the beneficiary's billing cycle. For variable-amount debits, the authorisation must specify whether the financial institution may debit the full invoiced amount or is limited to a maximum cap.

Effective Date and Duration: The start date (fecha de inicio) of the automatic debit arrangement and its duration — indefinite until revoked (vigencia indefinida hasta revocación), for a fixed term (plazo fijo), or until a specified number of debits have been processed. Under Ley 1328 de 2009 Article 5, the account holder has the right to revoke the authorisation at any time by written notice to the financial institution.

Revocation Rights: A clear statement that the account holder may revoke the automatic debit authorisation at any time by submitting a written request to the financial institution, in accordance with Ley 1328 de 2009 and the SFC's consumer protection regulations. The financial institution must process the revocation within the timeframe established by its internal procedures and cease debiting the account effective from the next billing cycle following the revocation.

Insufficient Funds Procedure: Instructions regarding the procedure when the account balance is insufficient to cover the scheduled debit — whether the financial institution should attempt a partial debit, retry after a specified period, or skip the debit and notify the account holder. Under CCo Article 1389, overdrafts on savings accounts require separate authorisation.
