What Is a Inheritance Renunciation Colombia (Repudio de Herencia)?

The Inheritance Renunciation Colombia (Repudio de Herencia) is a formal legal instrument through which a person called to a succession — as an heir by intestate law or by testamentary designation — voluntarily, expressly, and irrevocably waives all rights to the estate (masa herencial) of a deceased person (causante). The document is governed primarily by Codigo Civil Articles 1282 through 1290, which establish the conditions, form, and effects of a valid repudiation of inheritance under Colombian succession law.

Colombian succession law, rooted in Ley 57 de 1887 (Codigo Civil), treats succession as a voluntary act: no person may be compelled to accept an inheritance against their will. Codigo Civil Article 1282 establishes the right to repudiate, stating that every person with the legal capacity to freely dispose of their assets may renounce an inheritance. The repudiation must be express and solemn — it cannot be implied from conduct and cannot be made verbally. Under CC Article 1283, the repudiation of an intestate succession must be executed through a public deed (escritura publica) before a notario publico authorized under Decreto Ley 960 de 1970, or through a written declaration before the Juzgado de Familia or Juzgado Civil del Circuito handling the succession proceeding.

The legal effect of repudiation is profound and irrevocable. Under Codigo Civil Article 1285, a person who repudiates an inheritance is deemed never to have been a heir (se reputa no haber tenido jamas la calidad de heredero). This retroactive legal fiction means the repudiating party has no right to estate assets, no liability for estate debts, and no claim to any fruits or proceeds generated by the estate after the causante's death. The heir's descendants cannot inherit by representation (derecho de representacion under CC Article 1041) in a renounced succession — when an heir repudiates, their portion accrues to the other heirs of the same order through the right of accretion (acrecimiento under CC Article 1289).

Repudiation differs fundamentally from acceptance with benefit of inventory (aceptacion con beneficio de inventario under CC Article 1304). In the acceptance scenario, the heir receives estate assets but limits personal liability for debts to the value of those assets. In repudiation, the heir takes nothing and assumes no obligation whatsoever. Repudiation is the appropriate instrument when the estate is insolvent — when liabilities exceed assets — or when the heir has financial, professional, or personal reasons to avoid inheriting.

Ley 1564 de 2012 (Codigo General del Proceso — CGP) Articles 487 through 524 govern judicial succession proceedings, and repudiation may be filed directly before the Juzgado de Familia handling the succession case under CGP Article 491. The Superintendencia de Notariado y Registro oversees the notarial protocol for repudiation declarations. Decreto Ley 960 de 1970 (Estatuto del Notariado) governs the form and registration of notarial instruments including repudiation deeds.

Once executed, the repudiation cannot be revoked. Codigo Civil Article 1286 provides that the repudiation is irrevocable and no subsequent acceptance is possible. The only exception recognized by Colombian courts is when the repudiation was induced by fraud (dolo), serious error (error grave), or violence (fuerza), in which case the repudiation may be challenged through a nulidad action before the Juzgado Civil del Circuito within the four-year prescription period established by CC Article 1750.

Tax implications must be considered before repudiating. The DIAN (Direccion de Impuestos y Aduanas Nacionales) does not tax a repudiating heir since they receive nothing from the estate. Under Estatuto Tributario Article 302, the ganancia ocasional (occasional gain) tax applies only to assets actually received by heirs.
