What Is a Petition for Declaration of Heirship Colombia (Solicitud de Declaracion de Heredero)?

A Petition for Declaration of Heirship Colombia (Solicitud de Declaracion de Heredero) is the formal legal instrument through which a person claiming hereditary rights over the estate of a deceased Colombian national or resident formally establishes their status as a legal heir (heredero) before a competent authority. The petition triggers the legal recognition of the petitioner's vocacion hereditaria — hereditary calling — under the intestate succession rules of the Codigo Civil colombiano (Ley 57 de 1887), specifically Articles 1037 through 1072, which establish the ordenes hereditarios (orders of succession) that govern who inherits when the decedent left no valid will or when the will does not fully dispose of the estate.

The Colombian Codigo Civil recognizes five successive orders of intestate heirs. Under CC Article 1045, the first order consists of legitimate and adopted children (hijos) and the surviving spouse or compañero/a permanente — these descendants share the estate equally with the surviving partner receiving a portion equivalent to one child's share. Under CC Article 1046, the second order applies when there are no descendants and comprises the surviving spouse or partner, the decedent's parents (ascendientes), and recognized children if any. CC Article 1047 establishes the third order for siblings (hermanos) when neither descendants nor parents survive. CC Articles 1051 through 1053 place nephews and nieces (sobrinos) in the fourth order. The fifth and final order under CC Article 1054 grants the entire intestate estate to the Instituto Colombiano de Bienestar Familiar (ICBF) when no other heirs exist.

The Ley 54 de 1990 and its amendment Ley 979 de 2005 granted compañeros permanentes (permanent partners in uniones maritales de hecho) inheritance rights equivalent to those of a surviving spouse in the first and second orders, provided the union is formally declared and the sociedad patrimonial de hecho is recognized. A declaration of union marital must precede or accompany the declaration of heirship when the petitioner is a permanent partner.

The Codigo General del Proceso (Ley 1564 de 2012) — CGP — Articles 487 through 524 regulate the judicial succession proceeding (proceso de sucesion) within which the declaration of heirship occurs. Under CGP Article 488, once the succession proceeding is opened, the judge — typically a Juez de Familia in the last domicile of the decedent — publishes an edicto emplazatorio (notice) requiring all persons with hereditary interests to appear within a specified period, typically thirty days. CGP Article 494 governs the formal recognition of heirs through an auto de reconocimiento de herederos, by which the court establishes who has standing in the proceeding.

Decree Ley 960 de 1970 permits notarial declaration of heirship when all heirs agree and are legally capable. The Superintendencia de Notariado y Registro oversees notarial succession proceedings. Under Decreto 902 de 1988, notaries may recognize heirs through an escritura publica when no disputes exist, no minors are involved, and the heirs present complete documentary evidence of their kinship. The Registraduria Nacional del Estado Civil issues the registro civil de nacimiento, registro civil de matrimonio, and registro civil de defuncion documents that serve as the primary evidentiary instruments for establishing hereditary relationships.

When Do You Need a Petition for Declaration of Heirship Colombia (Solicitud de Declaracion de Heredero)?

A Petition for Declaration of Heirship Colombia becomes necessary in a range of practical circumstances that arise after the death of a Colombian national or resident who owned assets or left surviving family members with potential inheritance claims.

The petition is required when the decedent died intestate — without a valid will — and the heirs need to formally establish their right to the estate before a Juzgado de Familia or a notario. Under CGP Article 487, the succession proceeding is initiated by filing a demanda de sucesion or solicitud de apertura before the judge of the last domicile of the decedent. Without a formal declaration, no government authority, financial institution, or real estate registry will transfer assets out of the deceased's name.

The declaration is needed when real property (bienes inmuebles) registered in the Oficina de Registro de Instrumentos Publicos must be transferred to the heirs. Under Ley 1579 de 2012 (Estatuto de Registro de Instrumentos Publicos), the registrar requires a court order or notarial deed identifying the heirs before recording any change in the folio de matricula inmobiliaria. Bancolombia, Davivienda, BBVA Colombia, and other financial institutions similarly require a certified declaration of heirship before releasing funds from the deceased's accounts to beneficiaries.

The petition is necessary when the surviving partner in a union marital de hecho (Ley 54 de 1990) seeks inheritance rights as a compañero permanente. Because Colombian law requires proof of the union before the compañero can be recognized as an heir, the declaration of heirship proceeding often includes a simultaneous or prior declaration of the union marital and sociedad patrimonial before the Juzgado de Familia or notario.

The solicitud is needed to activate employer or government death benefits. Cajas de compensacion familiar such as Compensar, Colsubsidio, and Cafam require proof of heirship before paying survivor benefits. Colpensiones and the private pension fund administrators (AFP) require a formal declaration before transferring pension balances or survivor pensions to eligible heirs under Ley 100 de 1993 Articles 46 through 49.

The document is required when an heir seeks to accept or repudiate the inheritance (aceptar o repudiar la herencia) under Codigo Civil Articles 1282 through 1320. Under CC Article 1283, acceptance may be express or tacit, and the declaration of heirship establishes the legal framework within which acceptance or repudiation takes effect. Heirs may accept with the benefit of inventory (aceptacion con beneficio de inventario under CC Article 1304) to limit personal liability for estate debts.

What to Include in Your Petition for Declaration of Heirship Colombia (Solicitud de Declaracion de Heredero)

A valid Petition for Declaration of Heirship Colombia under the Codigo Civil and the Codigo General del Proceso must contain the following essential elements to be accepted by the Juzgado de Familia, the notario, or the relevant registry authority.

Identification of the Petitioner (Solicitante): Full legal name, cedula de ciudadania number, address, and contact information of the person filing the petition. The petitioner must state their kinship (parentesco) or other legal relationship to the decedent that gives rise to their hereditary calling (vocacion hereditaria) under the applicable order of succession of CC Articles 1045-1054.

Identification of the Decedent (Causante): Full name, cedula de ciudadania, date and place of death, and last domicile. The registro civil de defuncion issued by the Registraduria Nacional del Estado Civil must be attached. The last domicile determines the competent judge under CGP Article 28 numeral 14 — the Juzgado de Familia or Juzgado Civil del Circuito of the decedent's last municipality of residence.

List of All Known Heirs (Relacion de Herederos Conocidos): The petition must identify all persons known to have hereditary rights over the estate, including their full names, cedulas, and relationship to the decedent. Under CGP Article 489, all known heirs must be notified of the succession proceeding. Omitting a known heir with superior or equal hereditary rights can invalidate the partition under CC Article 1389.

Evidentiary Documents (Pruebas del Parentesco): The petitioner must attach or reference all kinship documents issued by the Registraduria Nacional del Estado Civil: registro civil de nacimiento (birth certificate) proving descent; registro civil de matrimonio (marriage certificate) proving spousal status; judicial or notarial declaration of union marital de hecho under Ley 54 de 1990 proving compañero permanente status; adoption decree from the Juzgado de Familia for adopted children. Foreign documents must be apostilled under the Convenio de La Haya de 1961 and translated by an official translator certified by the Ministerio de Relaciones Exteriores.

Applicable Order of Succession (Orden Hereditario): The petition must specify which order of succession applies under CC Articles 1045-1054 and demonstrate that no heir of a superior order exists. Where heirs of the same order coexist, the petition must describe their relative shares — equal among children, with the surviving spouse receiving an equivalent share under CC Article 1045.

Statement Regarding the Will (Declaracion sobre el Testamento): The petitioner must state whether the decedent left a will, either registered in the Registro de Testamentos maintained by the Superintendencia de Notariado y Registro or executed abroad. If a will exists, it must be identified and attached to determine which assets are covered by intestate succession.

Assets of the Estate (Descripcion del Patrimonio): A preliminary inventory of known estate assets — real property with folio de matricula inmobiliaria references, vehicles, bank accounts, and other property — assists the court or notary in determining the scope of the succession proceeding and the applicable jurisdiction based on estate value.

Request for Legal Recognition (Peticion al Despacho): The formal prayer requesting that the court or notary declare the petitioner and other identified persons as legal heirs of the decedent, order the edicto emplazatorio under CGP Article 488, and open the succession proceeding leading to inventory, appraisal, and partition of the estate.
