SEGUNDO: OBJETO DEL CONTRATO

El arrendador da en arrendamiento al arrendatario, conforme al Artículo 1915 del Código Civil y la Ley N° 18.101/1982, la habitación cuya descripción es: [Descripción Habitación], ubicada en el inmueble sito en [Dirección Inmueble].

TERCERO: PLAZO Y RENTA

CUARTO: DEPÓSITO DE GARANTÍA

El arrendatario entrega en este acto al arrendador la suma de [Depósito de Garantía] a título de depósito de garantía, para caucionar el cumplimiento de las obligaciones del presente contrato. Dicha suma será restituida dentro de los 15 días hábiles siguientes a la restitución del inmueble, previa liquidación de eventuales deudas, rentas impagas o daños atribuibles al arrendatario.

QUINTO: NORMAS DE CONVIVENCIA Y USO

El arrendatario se obliga a respetar las siguientes normas de convivencia: [Normas de Convivencia].

El arrendatario no podrá: (a) subarrendar la habitación ni ceder el contrato sin autorización escrita del arrendador (Artículo 1946 del Código Civil); (b) destinar la habitación a usos distintos al habitacional; (c) introducir animales sin autorización expresa; (d) realizar modificaciones al inmueble sin consentimiento escrito del arrendador.

SEXTO: OBLIGACIONES DE LAS PARTES

Son obligaciones del arrendador: (a) entregar la habitación en estado de servir para el uso habitacional convenido (Artículo 1924 del Código Civil); (b) mantener al arrendatario en el goce pacífico de la habitación; (c) efectuar las reparaciones necesarias para mantener el inmueble en estado habitable (Artículo 1927).

Son obligaciones del arrendatario: (a) pagar la renta oportunamente; (b) conservar la habitación y los espacios comunes en buen estado (Artículo 1937); (c) restituir la habitación al término del contrato en el mismo estado en que la recibió, salvo deterioros provenientes del uso legítimo; (d) respetar las normas de convivencia y no perturbar la tranquilidad de los demás ocupantes del inmueble.

SÉPTIMO: TÉRMINO Y RESTITUCIÓN

Al vencimiento del contrato o ante el desahucio legalmente notificado, el arrendatario deberá restituir la habitación libre de ocupantes y con todos sus bienes, en el plazo que fije el tribunal competente si hubiere controversia. La Ley N° 21.461/2022 (Devuélveme Mi Casa) establece procedimientos acelerados ante los Juzgados de Letras en lo Civil para la restitución del inmueble en casos de mora, incumplimiento o vencimiento del plazo.

OCTAVO: LEY APLICABLE Y JURISDICCIÓN

El presente contrato se rige por la Ley N° 18.101/1982 sobre Arrendamiento de Predios Urbanos, la Ley N° 21.461/2022 y el Código Civil de Chile. What Is a Room Rental Agreement Chile?

Room Rental Agreement Chile (Contrato de Arrendamiento de Habitación) is a residential lease instrument governed primarily by Ley N° 18.101 sobre Arrendamiento de Predios Urbanos — published in the Diario Oficial on 29 January 1982 and substantially amended by Ley N° 21.461 of 2022, commonly known as the Ley Devuélveme Mi Casa — by which an arrendador (landlord) grants to an arrendatario (tenant) the temporary use and enjoyment of a single room (habitación) within a dwelling in exchange for a periodic rent (renta de arrendamiento) denominated in Chilean Pesos (CLP) or Unidades de Fomento (UF) as published by the Banco Central de Chile.

The room rental contract is a subspecies of the broader contrato de arrendamiento regulated under Título XXVI of the Código Civil (Articles 1915–1985) and the special urban lease statute Ley N° 18.101. Ley N° 21.461 of 2022 — enacted in direct response to documented abuses of tenants in shared housing arrangements — introduced key procedural reforms to expedite lease termination. Article 3 of Ley N° 21.461 amended Ley N° 18.101 to establish that, for fixed-term contracts (contratos a plazo fijo) of up to one year, the landlord may obtain a desahucio (termination notice) through a simplified restitución de inmueble procedure before the Juzgado de Letras in the jurisdiction of the property. The reformed Article 3 bis of Ley N° 18.101 establishes a notarial desahucio mechanism by which the arrendador can serve notice of termination through a Notario Público, requiring the arrendatario to vacate within the statutory period — two months for indefinite-term contracts under Article 3 of Ley N° 18.101.

Party Identification (Individualización de las Partes): Full legal names, RUT (Rol Único Tributario) assigned by the Servicio de Impuestos Internos (SII), domicilio, and contact information for both the arrendador and arrendatario.
