COMPARECENCIA

CLÁUSULA PRIMERA — OBJETO DEL PODER

1.1

El presente instrumento constituye un mandato especial (negocio determinado) conforme al Artículo 2141 del Código Civil de Chile, por el cual el Mandante confiere al Mandatario poder especial para realizar las operaciones bancarias y financieras que se especifican en la Cláusula Segunda, ante las siguientes instituciones financieras reguladas por la Comisión para el Mercado Financiero (CMF) y sujetas a la Ley General de Bancos (DFL N° 3 de 1997):

CLÁUSULA SEGUNDA — FACULTADES EXPRESAS (CC ART. 2141)

2.1

De conformidad con el Artículo 2141 del Código Civil, el Mandante confiere expresamente al Mandatario las siguientes facultades para su ejercicio ante las instituciones financieras individualizadas en la Cláusula Primera:

Monto máximo por operación: [Monto Máximo]. En ausencia de monto específico, el Mandatario queda autorizado para operar dentro de los límites establecidos por cada institución financiera conforme a la Circular CMF N° 3.591 y regulaciones internas del banco respectivo.

2.3

El Mandatario está expresamente autorizado para firmar y suscribir todos los documentos, formularios, contratos y solicitudes que las instituciones financieras exijan para la ejecución de las operaciones autorizadas, incluyendo cartas de instrucciones, órdenes de pago, confirmaciones de operación y documentos electrónicos de autenticación.

CLÁUSULA TERCERA — LIMITACIONES Y RESTRICCIONES

3.1

El presente Poder Especial Bancario se limita exclusivamente a las operaciones bancarias y financieras expresamente señaladas en la Cláusula Segunda. No confiere autoridad para actos de disposición de bienes raíces (compraventa, hipoteca), representación judicial, ni ninguna otra materia extrabancaria.

3.2

El Mandatario está prohibido de celebrar operaciones en beneficio propio (autocontratación) utilizando el presente poder, salvo autorización expresa previa del Mandante, conforme al Artículo 2144 del Código Civil.

3.3

El Mandatario deberá rendir cuenta de las operaciones realizadas al Mandante cuando éste lo requiera, conforme al Artículo 2155 del Código Civil.

CLÁUSULA CUARTA — DURACIÓN Y REVOCACIÓN

4.1

El presente poder tendrá duración [Tipo de Duración].

4.3

El Mandante podrá revocar el presente poder en cualquier tiempo, conforme al Artículo 2163 N° 3 del Código Civil, mediante revocación otorgada ante Notario Público y notificación a cada institución financiera autorizada. Hasta que cada banco regulado por la CMF reciba notificación de la revocación, los actos del Mandatario ejecutados de buena fe permanecerán válidos conforme al Artículo 2173 del Código Civil.

4.4

El presente mandato se extinguirá también por las causales generales del Artículo 2163 del Código Civil: cumplimiento del objeto; vencimiento del plazo; renuncia del mandatario; muerte de cualquiera de las partes; o interdicción de cualquiera de ellas.

CLÁUSULA QUINTA — AUTENTICACIÓN NOTARIAL

5.1

El Mandante solicita al Notario Público autorizante la incorporación del presente instrumento al Protocolo Notarial conforme al Artículo 407 del Código Orgánico de Tribunales (COT), y la emisión de las copias autorizadas necesarias para su presentación ante cada institución financiera regulada por la CMF.

5.2

El Mandante declara conocer y aceptar que, conforme a las regulaciones de la CMF y la Circular N° 3.591, cada banco podrá solicitar verificación adicional de identidad del Mandatario y podrá conservar una copia del presente poder en el expediente de la cuenta correspondiente.

What Is a Special Banking Power of Attorney Chile (Poder Especial Bancario)?

Special Banking Power of Attorney Chile (Poder Especial Bancario) is a specific-purpose mandate governed by Código Civil Article 2141, by which a mandante (principal) grants a mandatario (attorney-in-fact) express authority to conduct banking and financial operations at institutions regulated by the Comisión para el Mercado Financiero (CMF) on the mandante's behalf. Unlike the mandato general under CC Article 2132, which confers broad administrative powers, the poder especial bancario is strictly limited to the financial transactions and accounts identified in the instrument, complying with the principle of specialty established by the Corte Suprema de Chile.

Chilean banking law — primarily the Ley General de Bancos (DFL N° 3 of 1997), administered by the CMF — requires that banks accept valid poderes notariales before allowing third-party account operations. Each bank in Chile (Banco de Chile, BancoEstado, Banco Santander Chile, Scotiabank Chile, Banco BCI, Banco Itaú Chile, BICE) maintains internal regulations requiring presentation of a copia autorizada of the poder, identity verification of the mandatario, and — for operations above certain thresholds — notarization as escritura pública. CC Article 2141 establishes that a mandato for a specific business (negocio determinado) confers only the authority explicitly mentioned and the powers that are naturally implied by the specific transaction. For banking operations, this means the poder must expressly list each authorized transaction: girar cheques (issue cheques against the current account — cuenta corriente regulated by the DFL N° 707), efectuar transferencias electrónicas (execute electronic transfers under the Ley N° 20.950 on payment systems), contratar mutuos y créditos (contract loans and credit lines), suscribir pagarés (execute promissory notes under Ley N° 18.092), operar tarjetas de crédito y débito (operate credit and debit cards), endosar documentos negociables (endorse negotiable instruments under the Ley de Letras de Cambio y Pagarés), and realizar inversiones en instrumentos financieros (conduct investments in financial instruments regulated by the CMF under Ley N° 18.045 del Mercado de Valores).

The instrumento must be executed as escritura pública before a Notario Público regulated by the Código Orgánico de Tribunales (COT) Articles 399–437 for the mandatario to operate accounts at Chilean banks. Some banks accept poderes granted as instrumento privado con firma autorizada ante Notario for limited operations (deposits, balance inquiries), but for account withdrawals, cheque issuance, and loan contracting, escritura pública is the required standard throughout Chile. The Notario Público incorporates the poder into the protocolo notarial and issues copias autorizadas that the mandatario presents to each financial institution.

The poder especial bancario is a preferred instrument for Chileans residing abroad (expatriates in the United States, Canada, Spain, or Australia) who need a trusted family member or financial advisor (asesor financiero) to manage their Chilean bank accounts, collect rental income, pay utility bills (ENEL, Aguas Andinas, VTR, Entel), and manage investment accounts at corredoras de bolsa regulated by the Bolsa de Comercio de Santiago and the CMF. The Chilean Consulate in the country of residence can authenticate the poder for use in Chile under the Apostille Convention (Chile ratified the Hague Convention of 1961 on July 14, 1981).

When Do You Need a Special Banking Power of Attorney Chile (Poder Especial Bancario)?

A Special Banking Power of Attorney Chile is required whenever a person needs to authorize another individual to conduct specific financial operations at Chilean banks and financial institutions regulated by the CMF, without granting the broad general authority of a mandato general.

Chileans living abroad — working in the United States, Spain, Canada, Australia, or other countries — need a poder especial bancario to authorize a family member or trusted advisor in Chile to manage their bank accounts at BancoEstado, Banco de Chile, Banco Santander Chile, or Banco BCI. The typical operations needed include: collecting monthly rental income from leased properties (arriendos); paying mortgage installments (dividendos hipotecarios) to financial institutions; paying property taxes (contribuciones de bienes raíces) via SII transfer; paying utility bills; and managing AFP pension fund contributions.

Business owners and company directors who cannot personally attend to banking operations authorize gerentes financieros (financial managers) or contadores (accountants) to operate company accounts — signing cheques for payroll, making wire transfers to suppliers, contracting short-term credit lines (líneas de crédito) with Banco BCI or Scotiabank Chile, and managing factoring operations under Ley N° 19.983 (cesión de facturas electrónicas).

Elderly individuals (adultos mayores) and persons with reduced mobility grant poderes especiales bancarios to adult children or trusted advisors to withdraw pensions (pensiones AFP or IPS — Instituto de Previsión Social), pay monthly expenses, and make deposits — without granting the broader authority of a mandato general that would cover non-financial matters.

Persons undergoing medical treatment, hospitalization, or rehabilitation who temporarily cannot conduct banking operations authorize a family member to manage their accounts during the period of incapacity. The poder may include an expiration date aligned with the expected recovery period, or the mandante may revoke it upon recovery under CC Article 2163.

What to Include in Your Special Banking Power of Attorney Chile (Poder Especial Bancario)

A valid Special Banking Power of Attorney Chile under Código Civil Article 2141 and the Ley General de Bancos (DFL N° 3/1997) must contain the following essential elements to be accepted by Chilean financial institutions regulated by the CMF:

Principal Identification (Individualización del Mandante): Full legal name, RUT number (Rol Único Tributario issued by the SII), nationality, marital status (estado civil), profession, and domicilio. For corporate mandantes, include razón social, RUT empresarial, the legal representative's identity (representante legal), and the resolution or escritura granting the representative authority to execute the poder. Banks require verification of the mandante's identity through the Registro de Personas Jurídicas of the CMF for corporate clients.

The mandatario must present their Cédula de Identidad (issued by the Servicio de Registro Civil e Identificación) or Pasaporte chileno to each bank when exercising the poder. Banks are required by CMF regulations to verify the mandatario's identity before processing authorized transactions.

Specific Financial Institutions (Instituciones Financieras Específicas): The poder should identify each bank or financial institution where the mandatario is authorized to operate — Banco de Chile, BancoEstado, Banco Santander Chile, Scotiabank Chile, Banco BCI, Banco Itaú Chile, Banco BICE, or other CMF-regulated entities. Including specific account numbers (números de cuenta corriente, cuentas de ahorro, or cuentas vista) is best practice and may be required by individual bank policies.

Authorized Transactions (Operaciones Autorizadas): The poder must expressly enumerate each type of financial operation authorized under CC Article 2141: — Girar cheques (issue cheques against current accounts regulated by DFL N° 707) — Efectuar transferencias electrónicas y pagos (execute electronic transfers and payments under Ley N° 20.950) — Depositar y retirar fondos (deposit and withdraw funds) — Contratar créditos y mutuos (contract loans and credit products) — Suscribir pagarés (execute promissory notes under Ley N° 18.092) — Endosar documentos negociables (endorse negotiable instruments) — Operar tarjetas de crédito y débito (operate credit and debit cards) — Renovar y cancelar depósitos a plazo (renew and redeem time deposits) — Contratar y cancelar líneas de crédito (open and close credit lines) — Realizar inversiones en instrumentos financieros (invest in financial instruments under Ley N° 18.045) — Operar cajas de seguridad (access safe deposit boxes)

Transaction Limits (Límites de Operación): Best practice is to establish maximum transaction amounts (montos máximos por operación) for cheques and transfers, particularly when the mandatario is not a close family member. Chilean banks may impose their own internal transaction limits for poder-based operations under CMF Circular N° 3.591.

Duration and Scope (Duración y Alcance): The poder should specify its duration — indefinite (duración indefinida) or fixed term (plazo fijo) with an expiration date. Under CC Article 2141, the scope is limited to the specifically listed banking operations — the poder does not confer authority for real estate dispositions, judicial representation, or other non-banking matters. Including a clear scope limitation protects the mandante from unauthorized extensions of the mandatario's authority.

Revocation Mechanism (Mecanismo de Revocación): Under CC Article 2163 N° 3, the mandante may revoke the poder at any time. The revocation must be executed before a Notario Público and communicated to each bank — banks are required under CMF regulations to acknowledge receipt of the revocación and immediately restrict the mandatario's access. Best practice is to request the bank to stamp (timbrar) the revocation as evidence of notification.

Notarial Authentication (Autenticación Notarial): The poder must be executed as escritura pública before a Notario Público regulated by COT Articles 399–437. The Notaría incorporates the poder into its protocolo notarial and issues copias autorizadas. Banks require an original or certified copy (copia autorizada) of the poder — photocopies are not accepted. Chilean banks typically retain a copy of the poder in the account file and may request annual revalidation for long-term poderes.
