What Is a Civil Union Agreement Mexico (Contrato de Sociedad de Convivencia)?

A Civil Union Agreement Mexico (Contrato de Sociedad de Convivencia) is a formal legal instrument through which two persons in Mexico — regardless of sex, sexual orientation, or family relationship, provided no impediment exists — enter into a legally recognized mutual aid and solidarity union that generates rights and obligations between them under the Ley de Sociedad de Convivencia para el Distrito Federal, published in the Gaceta Oficial del Distrito Federal on 16 November 2006 (effective 16 March 2007), the first law of its kind enacted in Mexico and a landmark in the recognition of diverse family structures within the Mexican legal order.

The Ley de Sociedad de Convivencia (LSC) was enacted by the Asamblea Legislativa del Distrito Federal as a progressive civil institution providing legal recognition and basic protections to households that did not qualify for marriage or for concubinato under the then-applicable restrictions — including same-sex couples (before Mexico City's marriage equality law of 2009), adult siblings caring for each other, adult friends sharing a household as a mutual aid unit, and heterosexual couples who chose not to marry but wanted legal recognition of their union beyond the two-year concubinato threshold. The LSC creates a voluntary contractual relationship registered before the Juzgado Cívico or the Registro Civil of Ciudad de México.

Under the LSC, the Sociedad de Convivencia generates the following legal effects between the partners (convivientes): mutual alimentary obligation (obligación alimentaria reciproca) — both convivientes must contribute to household support proportionally to their economic capacity, and upon dissolution, the economically weaker conviviente may claim post-dissolution alimentos for a period proportional to the union's duration; intestate succession rights — the surviving conviviente inherits in the same proportion as a legal spouse under the CCF intestate succession rules; hospital and medical decision-making rights — each conviviente has authority to authorize medical procedures for an incapacitated partner, equivalent to a spouse's right; and guardianship nomination — each conviviente may designate the other as legal guardian (tutor) in case of incapacity under the Código Civil aplicable.

The Suprema Corte de Justicia de la Nación (SCJN) has expanded the rights of sociedad de convivencia partners through jurisprudencia, holding that IMSS and ISSSTE survivor benefits must be extended to registered convivientes on the same basis as spouses and concubinos, applying the constitutional non-discrimination principle under Article 1 of the Constitución Política. Several states beyond Ciudad de México have enacted their own sociedad de convivencia or civil union legislation following the CDMX model, including Coahuila (Pacto Civil de Solidaridad), Campeche, Colima, Michoacán, and others, each with its own registration and rights framework.

For same-sex couples in Mexico today, marriage equality — available in all 32 states following SCJN jurisprudencia — provides fuller legal protection than the Sociedad de Convivencia, including automatic community property rights and equal parenting rights. However, the Sociedad de Convivencia remains a relevant institution for couples who prefer not to marry, for non-romantic household partnerships between relatives or friends, and for couples in states that have enacted civil union frameworks but not full marriage equality implementation at the registry level. The sociedad de convivencia framework reflects a broader policy recognition in Mexican family law that household relationships generating mutual dependency and solidarity deserve legal protection regardless of their form. The Consejo de la Judicatura Federal has tracked a significant increase in sociedad de convivencia registrations in Ciudad de México since 2010, reflecting growing awareness among cohabiting couples — both same-sex and opposite-sex — of the practical administrative and estate-planning benefits the institution provides. Legal practitioners note that the Contrato de Sociedad de Convivencia is particularly valuable for older adults who cohabit for mutual care and support without intending a romantic partnership, as it formalizes their mutual care arrangement and provides each partner with hospital decision-making authority and inheritance protection that blood relatives cannot override.

When Do You Need a Civil Union Agreement Mexico (Contrato de Sociedad de Convivencia)?

A Civil Union Agreement Mexico (Contrato de Sociedad de Convivencia) is needed whenever two persons in Ciudad de México or another state with equivalent civil union legislation wish to formally establish a legally recognized mutual aid union that generates alimentary rights, inheritance protections, and administrative rights without entering into marriage.

The contrato is needed when same-sex or opposite-sex partners who cohabit in a long-term relationship want immediate legal recognition without waiting for the two-year threshold required for concubinato under CCF Article 291-Bis. The Sociedad de Convivencia takes effect from the date of registration with the Juzgado Cívico or Registro Civil, providing an immediate legal framework for the couple's rights and obligations without a waiting period.

The document is needed when one partner wants to register the other as a beneficiary under their IMSS health coverage or ISSSTE benefits — following SCJN jurisprudencia extending benefits to registered convivientes, the registration certificate (constancia de sociedad de convivencia) serves as the qualifying document for IMSS and ISSSTE beneficiary enrollment, hospital authorization, and funeral benefit claims.

The contrato is needed for estate planning when the partners do not wish to execute a formal notarial will (testamento notarial) — the Sociedad de Convivencia creates intestate succession rights that protect the surviving partner in the absence of a will, preventing the deceased partner's estate from passing entirely to blood relatives who may not recognize the surviving partner's contribution to the household.

The agreement is needed when the partners are adult relatives — siblings, an adult child caring for a parent, or cousins sharing a household — who want legal recognition of their mutual care and support arrangement without the romantic or sexual relationship connotation of concubinato. The LSC does not require a romantic relationship — it requires a mutual aid and solidarity purpose.

The document is also needed when one or both partners are foreign nationals seeking immigration status based on family unity in Ciudad de México — the Instituto Nacional de Migración (INM) recognizes registered sociedad de convivencia as a family relationship basis for Tarjeta de Residencia Temporal applications by foreign partners of Mexican nationals or foreign residents, treating it equivalently to concubinato for immigration purposes.

Finally, the contrato is needed when the partners want to formally establish the terms of their property administration, expense sharing, and post-dissolution financial arrangements as part of the registration process — the LSC permits the partners to specify agreed property terms within the contract, providing a contractual framework similar to but legally distinct from matrimonial capitulaciones. The contrato is also needed when both partners are retired or nearing retirement age and wish to formalize their mutual care arrangement — designating each other as preferred caretakers, hospital decision-makers, and IMSS or ISSSTE beneficiaries. The Ley General de Salud Article 324 and hospital admission regulations in Mexico recognize the conviviente registered under a formal sociedad de convivencia as having equivalent decision-making authority to a spouse for medical procedures affecting an incapacitated partner, provided the registration certificate (constancia de registro) is presented to hospital administration.

What to Include in Your Civil Union Agreement Mexico (Contrato de Sociedad de Convivencia)

A valid Civil Union Agreement Mexico under the Ley de Sociedad de Convivencia para el Distrito Federal must contain the following elements to be registered and to generate legal rights under the LSC framework.

Identification of Both Convivientes: Full legal name, date of birth, nationality, CURP (Clave Única de Registro de Población), RFC (Registro Federal de Contribuyentes), INE credential or passport number, occupation, and domicile of each partner. Declaration that neither partner is currently married, in a registered sociedad de convivencia with another person, or in a concubinato with impediments — the LSC requires freedom from impedimentos civiles comparable to those for marriage.

Statement of Mutual Aid and Solidarity Purpose: A declaration that the partners share a home (hogar común) with a mutual aid, assistance, and solidarity purpose — the foundational legal characterization of the Sociedad de Convivencia under the LSC. This distinguishes the institution from marriage (which requires a romantic and sexual partnership) and from business partnerships (which require a profit-sharing purpose).

Shared Household Address: The address of the shared home (domicilio común) where both partners reside together — a central requirement for LSC registration, as the Juzgado Cívico verifies actual cohabitation.

Mutual Alimentary Obligation: Explicit acknowledgment of each conviviente's obligation to contribute to household support under the LSC alimentary framework, specifying the agreed division of household expenses (gastos comunes) — rent or mortgage, food, utilities, insurance — proportionally or equally as agreed. Post-dissolution alimentary support provisions, including duration and amount, protect the economically vulnerable partner upon termination.

Property Administration Arrangements: Agreed terms for the administration of jointly acquired or individually owned property during the union — specifying whether jointly acquired assets are held as copropiedad (co-ownership) or as each partner's individual property, the procedure for disposition of jointly held assets, and the allocation of household assets upon dissolution. Unlike marriage, the LSC does not automatically create a community property regime — property arrangements are entirely contractual.

IMSS and Beneficiary Designations: Declaration of intent to register the other partner as IMSS beneficiary under the SCJN-extended rights framework, and as beneficiary on life insurance policies, AFORE retirement accounts, and financial institution accounts. The constancia de registro of the Sociedad de Convivencia serves as the qualifying document for these designations.

Inheritance Rights Acknowledgment: Reference to the surviving conviviente's intestate inheritance rights under the LSC and the SCJN's interpretive jurisprudencia extending inheritance rights equivalent to those of a concubino under CCF Article 291-Quater. Expression of each partner's intention to execute a notarial will confirming the other as primary heir.

Guardianship Nomination: Designation of each partner as the other's preferred legal guardian (tutor) in the event of incapacity — an authorization that prevents blood relatives from assuming guardianship against the incapacitated partner's expressed preference. This nomination must also be confirmed in a formal poderes notariales (powers of attorney) and, where applicable, in advance directives (directivas anticipadas) under the Ley de Voluntad Anticipada para el Distrito Federal published on 7 January 2008.

Registration and Dissolution Provisions: Reference to the mandatory registration of the contrato before the Juzgado Cívico or Registro Civil of Ciudad de México, and the agreed dissolution procedure — which under the LSC may be unilateral or bilateral, with a minimum notice period to the other conviviente and notification to the registry authority. Forms-legal.com provides this Civil Union Agreement Mexico template as a practical drafting tool — registration requires submission to the competent Juzgado Cívico and legal advice from a licensed abogado is recommended to confirm the rights applicable under the specific state's legislation. Apostille and International Recognition Clause: For couples where one partner holds foreign nationality or where the partners may relocate abroad, a clause confirming that the Contrato de Sociedad de Convivencia can be apostilled through the Secretaría de Relaciones Exteriores (SRE) under the Convenio de La Haya of 5 October 1961 for use in foreign jurisdictions that recognize civil union documents. The apostille does not guarantee recognition in all countries, but significantly facilitates consular, immigration, and estate proceedings in Hague Convention signatory states.
