IV. DERECHOS DE AUTOR SOBRE DISEÑOS ARQUITECTÓNICOS (LFDA)

Los derechos morales del Arquitecto — incluyendo el derecho a ser reconocido como diseñador del proyecto y a oponerse a modificaciones no autorizadas que afecten la integridad de la obra — son inalienables e irrenunciables conforme al Artículo 18 de la Ley Federal del Derecho de Autor (LFDA). El Cliente se obliga a acreditar al Arquitecto en toda publicación, concurso o comunicación pública del proyecto. Queda prohibida la reutilización de los planos para un proyecto distinto al indicado en la Cláusula II sin autorización escrita del Arquitecto.

V. RESPONSABILIDAD PROFESIONAL

El Arquitecto responde por errores de diseño que causen daños al Cliente conforme a los Artículos 2606 y 1910–1934 del Código Civil Federal. El plazo de prescripción de acciones por responsabilidad profesional es de 5 años conforme al Artículo 1159 CCF. Para obras que afecten elementos estructurales, la responsabilidad del Arquitecto por vicios estructurales es de 10 años conforme al Artículo 65 del Reglamento de Construcciones para el Distrito Federal y equivalentes estatales.

Supervisión de Obra: La supervisión arquitectónica pactada constituye supervisión estética y de diseño — no implica la responsabilidad técnica de la empresa constructora sobre la ejecución física de la obra. La distinción entre la responsabilidad del Arquitecto y la del Contratista de Obra se rige conforme al Artículo 2042 CCF.

VI. LEY APLICABLE Y JURISDICCIÓN

El presente Contrato se rige por la Ley General de Profesiones (Artículo 5), el Código Civil Federal (Artículo 2606) y la Ley Federal del Derecho de Autor de los Estados Unidos Mexicanos. What Is a Architecture Services Contract Mexico?

An Architecture Services Contract Mexico (Contrato de Prestación de Servicios de Arquitectura) is a written professional services agreement governed by the Ley General de Profesiones (LGP) Article 5 — which establishes the mandatory Cédula Profesional requirement for licensed professional practice — and the Código Civil Federal (CCF) Article 2606, by which a licensed architect (arquitecto) or architecture firm (despacho de arquitectura) holding a valid Cédula Profesional issued by the Dirección General de Profesiones (DGP) of the Secretaría de Educación Pública (SEP) agrees to provide architectural design, construction supervision, project management, or related professional services to a client (dueño de obra or contratante) in exchange for agreed professional fees (honorarios profesionales).
