3. SCOPE OF INSPECTION AND CERTIFICATION

The Technician undertakes to carry out an on-site visit (visita de inspección in situ) of the property, collect all necessary data on the building envelope (aislamiento térmico, ventanas, puentes térmicos), energy installations (calderas, sistemas de refrigeración, agua caliente sanitaria — ACS), and occupancy patterns, and prepare and register the Certificado de Eficiencia Energética (CEE) in compliance with Real Decreto 235/2013 and Directiva 2010/31/EU on the energy performance of buildings.

4. DELIVERABLES AND TIMELINE

5. REGISTRATION OBLIGATION

6. PROFESSIONAL FEES AND PAYMENT

7. LIABILITY AND PROFESSIONAL INSURANCE

The Technician is liable for errors in the energy efficiency rating, incorrect data entry, or missed registration deadlines that cause demonstrable loss to the Owner, subject to the cover provided by the seguro de responsabilidad civil profesional identified in clause 1 above. Claims must be notified to the Technician in writing within 30 days of the Owner becoming aware of the error. The applicable limitation period is 5 years pursuant to Article 1964 of the Código Civil.

8. DATA PROTECTION

Personal data of the Owner is processed for the performance of this agreement (Article 6.1(b) RGPD) and for compliance with the registration obligations of RD 235/2013 (Article 6.1(c) RGPD). Data is processed in accordance with Ley Orgánica 3/2018 (LOPDGDD) and the Owner may exercise their data rights before the Agencia Española de Protección de Datos (AEPD) at aepd.es.

9. GOVERNING LAW AND JURISDICTION

This agreement is governed by Spanish law, principally Real Decreto 235/2013, the Código Civil, and the applicable regulations of [Autonomous Community].
