3. ALCANCE DE LA INSPECCIÓN Y CERTIFICACIÓN

El Técnico se compromete a realizar una visita de inspección in situ del inmueble, recopilar todos los datos necesarios sobre la envolvente térmica del edificio (aislamiento térmico, ventanas, puentes térmicos), las instalaciones energéticas (calderas, sistemas de refrigeración, agua caliente sanitaria — ACS) y los patrones de ocupación, y elaborar y registrar el Certificado de Eficiencia Energética (CEE) conforme al Real Decreto 235/2013 y a la Directiva 2010/31/UE relativa a la eficiencia energética de los edificios.

4. ENTREGABLES Y PLAZO

El Técnico entregará lo siguiente en un plazo de [Delivery Days] desde la fecha de inspección:

  • El Certificado de Eficiencia Energética firmado en formato PDF, conforme al artículo 6 del RD 235/2013, identificando la calificación de eficiencia energética del edificio en la escala A–G.
  • La Etiqueta de Eficiencia Energética en formato digital, apta para portales de anuncios inmobiliarios conforme al artículo 12 del RD 235/2013.
  • El certificado de registro (número de registro) expedido por el registro de la comunidad autónoma de [Autonomous Community], acreditando el cumplimiento del artículo 5.4 del RD 235/2013.
  • Recomendaciones por escrito (medidas de mejora) para mejorar la calificación de eficiencia energética del edificio, con costes estimados y plazos de amortización.

5. OBLIGACIÓN DE INSCRIPCIÓN

El Técnico se compromete a inscribir el CEE en el registro oficial de la comunidad autónoma (Registro de Certificaciones Energéticas — [Autonomous Community]) dentro del plazo de entrega indicado anteriormente, conforme al artículo 5.4 del Real Decreto 235/2013. El Técnico facilitará al Propietario el número de registro oficial exigido para la venta y el alquiler del inmueble, así como para las escrituras públicas de compraventa. El certificado tendrá una validez de 10 años desde la fecha de expedición conforme al artículo 11 del RD 235/2013.

6. HONORARIOS PROFESIONALES Y PAGO

El Propietario abonará al Técnico los honorarios profesionales acordados de [Professional Fee], que incluyen la inspección, la simulación energética, la elaboración del CEE y la etiqueta energética, y la inscripción en el registro de la comunidad autónoma. Los honorarios se abonarán de la siguiente forma: 50% a la firma de este acuerdo; 50% a la entrega del certificado registrado y del número de registro.

Cualquier cargo adicional — incluyendo tasas administrativas autonómicas, gastos de desplazamiento que excedan el alcance acordado, u honorarios por una nueva inspección debida a cambios en el inmueble — se acordará por escrito antes de incurrirse en él.

7. RESPONSABILIDAD Y SEGURO PROFESIONAL

El Técnico responde de los errores en la calificación de eficiencia energética, la introducción incorrecta de datos o el incumplimiento de los plazos de inscripción que causen un perjuicio demostrable al Propietario, con arreglo a la cobertura del seguro de responsabilidad civil profesional identificado en la cláusula 1 anterior. Las reclamaciones deberán notificarse al Técnico por escrito en el plazo de 30 días desde que el Propietario tenga conocimiento del error. El plazo de prescripción aplicable es de 5 años conforme al artículo 1964 del Código Civil.

8. PROTECCIÓN DE DATOS

Los datos personales del Propietario se tratan para la ejecución de este acuerdo (artículo 6.1(b) RGPD) y para el cumplimiento de las obligaciones de inscripción del RD 235/2013 (artículo 6.1(c) RGPD). Los datos se tratan conforme a la Ley Orgánica 3/2018 (LOPDGDD) y el Propietario podrá ejercer sus derechos ante la Agencia Española de Protección de Datos (AEPD) en aepd.es.

9. LEY APLICABLE Y JURISDICCIÓN

Este acuerdo se rige por la legislación española, principalmente el Real Decreto 235/2013, el Código Civil, y la normativa aplicable de [Autonomous Community]. Las controversias se someterán a los tribunales de la jurisdicción del inmueble, o se resolverán mediante el procedimiento de arbitraje acordado por las partes.
