2. MARCO LEGAL

El presente contrato se rige principalmente por los artículos 1542 a 1581 del Código Civil (arrendamiento de cosas), prevaleciendo la voluntad de las partes, y de forma subsidiaria por la Ley de Arrendamientos Urbanos 29/1994 (LAU) en lo que resulte aplicable. El arrendamiento de una habitación privada dentro de un inmueble compartido no constituye un arrendamiento de vivienda conforme al Título II de la LAU (artículo 2.1 LAU), que exige el arrendamiento de una edificación habitable completa como residencia habitual del arrendatario. 6. OBLIGACIONES DEL ARRENDATARIO

El arrendatario deberá: (a) abonar la renta mensual en la fecha convenida; (b) destinar la habitación exclusivamente a uso residencial privado; (c) cumplir las normas de convivencia establecidas en la Cláusula 5; (d) no subarrendar ni ceder la habitación a terceros sin el consentimiento previo y escrito del arrendador; (e) no realizar alteraciones en la habitación o en el inmueble sin la autorización previa y escrita del arrendador; (f) notificar sin demora al arrendador cualquier daño o avería que requiera reparación; (g) devolver la habitación en el mismo estado en que la recibió al inicio del arrendamiento, salvo el desgaste ordinario, en la fecha de finalización.

7. DERECHO A LA INTIMIDAD E INVIOLABILIDAD DEL DOMICILIO

La habitación privada del arrendatario está protegida por el derecho a la inviolabilidad del domicilio reconocido en el artículo 18.2 de la Constitución Española de 1978 y por el principio de goce pacífico establecido en el artículo 1554 del Código Civil. El arrendador no podrá acceder a la habitación privada del arrendatario sin su consentimiento, salvo en casos de emergencia real. El arrendador podrá acceder libremente a las zonas comunes.

8. PROTECCIÓN DE DATOS

El arrendador trata los datos personales del arrendatario para la ejecución del presente contrato conforme al artículo 6.1(b) del Reglamento (UE) 2016/679 (RGPD) y a la Ley Orgánica 3/2018 (LOPDGDD). El arrendatario tiene derecho a acceder, rectificar, suprimir y oponerse al tratamiento de sus datos a través de la Agencia Española de Protección de Datos (AEPD) en aepd.es.

9. LEY APLICABLE Y JURISDICCIÓN

El presente contrato se rige por el Código Civil (Real Decreto de 24 de julio de 1889), artículos 1542 a 1581, y, subsidiariamente, por la Ley de Arrendamientos Urbanos 29/1994. Las controversias se resolverán ante el Juzgado de Primera Instancia de la jurisdicción donde se ubique el inmueble.
