What Is a Permanent Disability Application Spain (Solicitud de Incapacidad Permanente)?

A Permanent Disability Application (Solicitud de Incapacidad Permanente) in Spain is a formal request submitted to the Instituto Nacional de la Seguridad Social (INSS) or, for workers covered by a Mutua Colaboradora con la Seguridad Social, to the relevant Mutua, asking for a medical and administrative evaluation of the applicant's ability to work and the recognition of a permanent disability (incapacidad permanente) benefit under the Ley General de la Seguridad Social (RDL 8/2015, LGSS). The legal framework for incapacidad permanente is established principally in Articles 193 through 200 of the LGSS, with procedural rules governed by Real Decreto 1300/1995, de 21 de julio, which regulates the INSS's disability evaluation system and the composition and functions of the Equipos de Valoración de Incapacidades (EVI).

Spanish social security law recognises four degrees of permanent disability. Incapacidad permanente parcial (IPP) under Article 195.1 LGSS is awarded when the worker can no longer perform the fundamental tasks of their usual occupation (profesión habitual) but retains capacity for other work, generating a lump-sum compensation equivalent to 24 months of the regulatory base (base reguladora). When Do You Need a Permanent Disability Application Spain (Solicitud de Incapacidad Permanente)?

An application for Incapacidad Permanente in Spain becomes necessary when a worker has exhausted the maximum period of Incapacidad Temporal (IT) — 365 days extendable by 180 additional days under Article 174 LGSS — without recovery, or when the INSS medical services (médicos inspectores del INSS or Mutua doctors) determine that the prognosis indicates recovery enabling return to work is unlikely within the IT extension period. Under Article 195.1 LGSS, the INSS may initiate the permanent disability evaluation ex officio before the IT period concludes, or the worker may apply on their own initiative.

The most common trigger is a chronic or progressive medical condition — severe musculoskeletal disorders (dorsopatías, espondilitis anquilosante), oncological conditions following active treatment, severe cardiac disease (insuficiencia cardíaca congestiva), neurological disorders (esclerosis múltiple, enfermedad de Parkinson, ACV secuelado), respiratory insufficiency (EPOC grave, fibrosis pulmonar), or serious psychiatric conditions (trastorno bipolar severo, esquizofrenia paranoide) certified by the attending specialist at a hospital under the Red Hospitalaria del Sistema Nacional de Salud (SNS).

For autónomos under RETA, the application is particularly important because self-employed workers do not have IT protection equivalent to employed workers (unless they have contracted enhanced IT coverage with a Mutua Colaboradora or opted into prestación por cese de actividad under Ley 20/2007 LETA). Once activity ceases due to severe illness, the autónomo's only social security entitlement is the IP pension — making timely application critical to prevent a period of zero income.

A worker can also apply when they suffer a workplace accident (accidente de trabajo) or occupational disease (enfermedad profesional) that has left permanent sequelae. In these cases, the IP benefit derives from the contingencias profesionales system, the regulatory base calculation uses the salary from the year preceding the accident under Article 60 RD 1300/1995, and the Mutua or the INSS bears the cost rather than the common contingencies system.

Applicant identification is mandatory. The worker must provide their full name, DNI/NIE, Número de Afiliación a la Seguridad Social (NASS) as registered in the TGSS (Tesorería General de la Seguridad Social), date of birth, domicilio, contact telephone and email, and their current employment status (en activo, de baja por IT, desempleado, autónomo). The NASS number — formatted as two digits (régimen code) followed by eight digits and two check digits — is the key identifier in the Social Security database maintained by the TGSS.

Employment and contribution history documentation must demonstrate compliance with the carencia (qualifying period) requirement. Under Article 195.1 LGSS, IPT and IPA require a carencia of five years (1,800 days), of which at least one-fifth (360 days) must fall within the 10 years immediately before the contingency. Workers under 26 years old benefit from a reduced carencia formula under Article 195.2 LGSS. IPP requires only 1,800 days of contributions without a time-limited carencia. The worker must submit: the medical discharge report from the last IT episode (parte de alta médica); specialist medical reports (informes médicos especialistas) from hospital consultations (oncology, cardiology, rheumatology, psychiatry, etc.) within the Red Hospitalaria del Sistema Nacional de Salud; diagnostic test results (pruebas diagnósticas) including imaging (resonancias magnéticas, TAC), laboratory analyses, and functional assessments (espirometría, test de esfuerzo); and a general practitioner's summary (informe del médico de atención primaria) from the Centro de Salud under the Servicio Autonómico de Salud (SAS in Andalucía, SCS in Cantabria, SERMAS in Madrid, ICS in Cataluña, etc.). The Equipo de Valoración de Incapacidades (EVI) will call the applicant for a medical examination (reconocimiento médico) at the INSS Dirección Provincial.

The basis for disability claimed must be specified, identifying: the degree of incapacidad permanente requested (parcial, total, absoluta, gran invalidez); the profesión habitual in which disability is claimed for IPT under Article 194.1 LGSS; the reasons why the medical conditions prevent professional activity; and any previous IP resolutions or IT episodes in the INSS system.
