What Is a NIE Application Spain (Solicitud de Número de Identificación de Extranjero)?

A NIE Application Spain (Solicitud de Número de Identificación de Extranjero) is a formal administrative request submitted by a foreign national to the Cuerpo Nacional de Policía — through its Comisarías de Extranjería (immigration police stations) or, for non-residents applying abroad, through Spanish consulates and diplomatic missions — seeking the assignment of a Número de Identificación de Extranjero (NIE). The NIE is a unique, permanent personal fiscal and administrative identification number assigned to every foreign national who has economic, professional, or social interests (intereses económicos, profesionales o sociales) in Spain, under Real Decreto 616/2001, de 8 de junio, Article 1, as developed by Instrucción DGP/SGRJ/03/2007 of the Secretaría General de Inmigración y Emigración.

The NIE consists of a letter followed by 7 digits and a verification letter — for example, X-1234567-A (prior to 2008) or Y-1234567-Z (from 2008 onwards) or Z-1234567-B (most recent format since the X and Y series reached capacity). The Agencia Estatal de Administración Tributaria (AEAT) requires the NIE for filing any tax return (IRPF, IVA, ISD, ITP); the Notaría requires the NIE for any public deed (escritura pública) — including property purchase (compraventa de inmueble), mortgage (hipoteca), company formation, or inheritance acceptance; the Registro de la Propiedad requires the NIE to register any property right; the Tesorería General de la Seguridad Social (TGSS) requires the NIE for social security registration; Spanish banks (entidades de crédito) require the NIE to open a bank account or apply for a mortgage under Anti-Money Laundering Law Ley 10/2010 de Prevención del Blanqueo de Capitales; and the Dirección General de Tráfico (DGT) requires the NIE to register a vehicle or obtain a driving licence.

Two distinct types of NIE application exist. First, the NIE for non-residents (NIE para no residentes) — issued to foreign nationals who need a NIE for a specific, non-recurring economic, professional, or administrative transaction in Spain (e.g., purchasing a holiday home, inheriting Spanish property, or registering a Spanish company) without intending to reside in Spain. This NIE is assigned purely as a fiscal identifier and does not confer residence rights. Second, the NIE as part of the residence registration process — EU/EEA nationals exercising their right of free movement under EU Directive 2004/38/CE register at the Oficina de Extranjeros and receive their NIE as part of the certificado de registro de ciudadano de la UE; third-country nationals applying for a residence permit (autorización de residencia y trabajo) under Ley Orgánica 4/2000 de Extranjería receive their NIE upon approval of their residence permit and obtain their TIE card from the Comisaría.

The NIE application for non-residents must be submitted on Form EX-15 (Solicitud de Número de Identificación de Extranjero y Certificados) available from the Ministerio del Interior's website, accompanied by the fee payment by Modelo 790 Código 012, and processed at the Comisaría de Policía of the province where the reason for needing the NIE is located (e.g., the province where the property to be purchased is situated). Appointment booking (cita previa) is essential and must be made through the Sede Electrónica de la Policía Nacional (sede.policia.gob.es) — walk-in processing is not generally available.

When Do You Need a NIE Application Spain (Solicitud de Número de Identificación de Extranjero)?

A NIE Application Spain is required whenever a foreign national needs to carry out a legal, fiscal, administrative, or commercial transaction in Spain that requires personal identification by the Spanish authorities or by a Spanish institution.

The NIE is needed before purchasing property in Spain — whether residential, commercial, or agricultural. A NIE is required before taking up employment in Spain — the employer must register the employee with the Tesorería General de la Seguridad Social (TGSS) using the employee's NIE as the primary identifier in the social security system.

What to Include in Your NIE Application Spain (Solicitud de Número de Identificación de Extranjero)

A valid NIE Application Spain under Real Decreto 616/2001 Article 1 must contain the following essential elements to be processed by the Comisaría de Extranjería of the Cuerpo Nacional de Policía.

Completed Form EX-15: The official Solicitud de Número de Identificación de Extranjero y Certificados form (Modelo EX-15), available from the Ministerio del Interior's website (www.interior.gob.es) or at any Comisaría de Extranjería. Fee Payment: Proof of payment of the tasa for NIE issuance by self-assessment form Modelo 790 Código 012, payable at a Spanish financial institution (banco or caja) before the appointment. The fee for 2024 is approximately €9.84. The original payment receipt (justificante de pago) must be presented at the appointment — photocopies are not accepted.

Representative Authorisation (if applicable): Where a representative (representante or abogado) acts on behalf of the NIE applicant — which is permitted under Article 46 of Ley 39/2015 LPAC — a notarially authorised power of attorney (poder notarial) specifically authorising the representative to apply for the NIE on the applicant's behalf must be provided, together with the representative's own DNI or passport.
