What Is a Maternity Leave Application Spain?

A Maternity Leave Application Spain (Solicitud de Permiso de Maternidad) is the formal document submitted by a worker to her employer and, separately, to the Instituto Nacional de la Seguridad Social (INSS) to claim the sixteen-week paid leave entitlement on the birth, adoption, or fostering of a child, as established under Article 48.4 of the Estatuto de los Trabajadores (Real Decreto Legislativo 2/2015, de 23 de octubre) and developed by the Real Decreto 295/2009, de 6 de marzo, which regulates the economic benefits of the Social Security system for maternity, paternity, risk during pregnancy, and risk during breastfeeding.

The permiso de maternidad under Article 48.4 ET consists of sixteen weeks of suspended employment contract — the worker retains full employment rights, seniority accrual, and the right to return to the same or equivalent position. The first six weeks after the birth are compulsory rest for the biological mother and cannot be waived or transferred. The remaining ten weeks may be transferred to the other parent, distributed between parents, or taken in whole or in part simultaneously by both parents after the compulsory period. The employer ceases to pay salary from the date the suspension begins and the INSS benefit replaces the salary in full. Adoptive and foster parents are equally entitled to the sixteen-week permiso de maternidad under Article 48.4 ET, with the entitlement period starting from the date of the judicial or administrative resolution approving the adoption or fostering. When Do You Need a Maternity Leave Application Spain?
