What Is a Central Credit Registry Exclusion Request Colombia?

The Central Credit Registry Exclusion Request Colombia (Solicitud de Exclusión de Centrales de Riesgo) is the formal document by which the holder of financial credit information demands that the reporting financial entity and credit registry operators — DataCrédito (TransUnión Colombia S.A.S.) and CIFIN (Experian Colombia S.A.) — permanently remove an erroneous, outdated, or unlawful negative entry from their credit history. This right is recognized in Article 15 of the Constitución Política de Colombia as part of the fundamental right to habeas data, and is specifically regulated in Articles 13 through 16 of Ley 1266 de 2008 — the Statutory Law of Financial Habeas Data.

The right of exclusion or suppression of negative data from credit registries operates under specific conditions established in Ley 1266 de 2008: (a) when the information is inaccurate or incomplete; (b) when the obligation was paid and the permanence periods established in Article 13 have elapsed; (c) when the report was generated by an obligation the holder never contracted (identity fraud); (d) when the permanence of the negative data exceeds the legal time limit; or (e) when the financial entity failed to comply with the updating procedure ordered by the Superintendencia de Industria y Comercio.

Article 13 of Ley 1266 de 2008 establishes the permanence periods for negative data: the delinquency information remains for twice the period of the default, with a maximum limit of 4 years counted from the date of payment of the delinquent obligation. Obligations never paid that are still being collected are not subject to the same time limit, but are subject to accuracy and currency controls. The Corte Constitucional in Sentencia C-1011 de 2008 declared the negative data permanence regime constitutional, provided it respects the debtor's rights of rehabilitation and forgetting.

The Superintendencia de Industria y Comercio — as the data protection authority in Colombia under Article 19 of Ley 1266 de 2008 — has sanctioning powers to fine entities that maintain negative reports beyond the legal term, with fines of up to 2,000 monthly minimum legal wages.
