What Is a Household Appliances Sale Agreement Colombia (Compraventa de Electrodomésticos)?

A Household Appliances Sale Agreement Colombia (Contrato de Compraventa de Electrodomésticos) is a written contract governed by Código Civil (CC) Article 1857 — Ley 57 de 1887 — and, when the seller is a comerciante (merchant), by Ley 1480 de 2011 (Estatuto del Consumidor) and the Código de Comercio (CCo — Decreto 410 de 1971), formalising the transfer of ownership of household appliances, electronics, and domestic equipment from a vendedor (seller) to a comprador (buyer) in exchange for a price in Colombian pesos.

Ley 1480 de 2011 — Colombia's consumer protection statute — is administered by the Superintendencia de Industria y Comercio (SIC), the national consumer protection authority. The SIC supervises compliance with consumer rights, warranties, and product safety standards for all consumer goods including household appliances. When the seller is a comerciante (merchant, retailer, or distributor), the SIC enforces: the minimum legal guarantee (garantía mínima legal) of one year for durable goods under Ley 1480 Article 8; the right of return (retracto) within five business days for purchases made by remote means (internet, catalogue, telephone) under Ley 1480 Article 47; and the prohibition on deceptive commercial practices (prácticas comerciales engañosas) under Ley 1480 Articles 23-27.

For private sales between individuals (between particulares, where neither is a comerciante), Ley 1480 de 2011 does not apply, and the transaction is governed exclusively by CC Articles 1857-1929 (general rules on sale) and CC Articles 1880-1929 (obligations and rights of buyer and seller). In private sales, the seller's only warranty obligation is disclosure of known vicios ocultos (hidden defects) under CC Article 1893. The acción redhibitoria prescribes in six months from delivery for movable goods under CC Article 1923.

The Decreto 735 de 2013 regulated the practical application of Ley 1480 warranty rules, establishing the procedure for effective warranty claim processing by suppliers, manufacturers, importers, and distributors of consumer goods sold in Colombia. Under Decreto 735 de 2013, the minimum legal guarantee covers: manufacturing defects; material defects; design defects; and non-conformity with advertised specifications. The warranty obligation is joint and several (solidaria) between the productor (manufacturer or importer) and the expendedor (retailer) under Ley 1480 Article 11.

The Organización de Estados Iberoamericanos para la Protección del Consumidor and the SIC have published guidelines for the sale of second-hand (usado) electronics and appliances. The SIC's Delegatura para la Protección al Consumidor handles consumer complaints through the Centro de Atención al Consumidor and the plataforma en línea de la SIC for cases involving guaranteed goods that develop defects within the warranty period.

For large household appliance transactions — washing machines (lavadoras), refrigerators (neveras), air conditioning units (aires acondicionados), ovens (estufas), dishwashers (lavavajillas), and water heaters (calentadores) — the Reglamento Técnico de Instalaciones Eléctricas (RETIE) established by Resolución 90708 de 2013 of the Ministerio de Minas y Energía applies to the professional installation of electrical appliances, requiring certified electricians (instaladores eléctricos certificados) and compliance with NTC standards.

The Instituto Nacional de Metrología (INM) and the Instituto Colombiano de Normas Técnicas y Certificación (ICONTEC) establish quality and safety standards for electrical appliances sold in Colombia, including NTC (Normas Técnicas Colombianas) that products must comply with under the SIC's product surveillance programme.

When Do You Need a Household Appliances Sale Agreement Colombia (Compraventa de Electrodomésticos)?

A Household Appliances Sale Agreement Colombia is needed whenever appliances, electronics, or household equipment are sold between private individuals — covering televisions, refrigerators, washing machines, ovens, air conditioners, computers, smartphones, sound systems, or any domestic equipment — within Colombian territory. Under CC Article 1857, the sale is perfected by consent, but a written agreement creates documentary evidence of the transaction terms, the condition of the goods at sale, and the parties' warranty and liability allocations.

The agreement is needed when a private seller lists used appliances for sale on platforms such as OLX Colombia, Mercado Libre Colombia, or Facebook Marketplace and needs to document the agreed sale price, condition, and exclusion of commercial warranties. Colombian private sellers are not subject to the garantía mínima legal of Ley 1480 de 2011 — that statute applies only to comerciantes — but the written agreement protects both parties by documenting the condition and accepted defects.

The document is required when a comerciante (retail store, electronics chain, or appliance distributor) sells goods to a consumer (consumidor final) and needs to provide the written guarantee document required by Ley 1480 Article 10 and Decreto 735 de 2013. The written sale agreement serves as the proof of purchase (documento de compra) upon which the consumer's warranty claim rights under Ley 1480 are founded.

A sale agreement is needed when the buyer purchases appliances on instalment payments (cuotas) — common in Colombia through retailers such as Alkosto, Falabella, Homecenter, La 14, and Éxito, which offer cuotas diferidas through cooperativas de ahorro and financial institutions supervised by the Superintendencia Financiera de Colombia. The instalment sale agreement must comply with Ley 1480 de 2011 Articles 33-36 regarding credit sales disclosure requirements.

The agreement is needed when the buyer finances the purchase through a tarjeta de crédito (credit card) with a cuotas diferidas agreement and requires documentary evidence for the transaction. The SIC enforces disclosure requirements for credit purchase terms under Circular Única de la SIC and Ley 1328 de 2009 (Ley de Reforma Financiera).

A written sale agreement is important when high-value electronics — professional cameras, high-end laptops, home theatre systems, or imported electronics — are sold privately and the buyer needs insurance coverage documentation. Colombian home insurance policies (seguros de hogar) issued by insurers supervised by the Superintendencia Financiera typically require a purchase receipt or sale agreement as proof of ownership and declared value for insured electronic items.

What to Include in Your Household Appliances Sale Agreement Colombia (Compraventa de Electrodomésticos)

A valid Household Appliances Sale Agreement Colombia under Código Civil Article 1857 and Ley 1480 de 2011 must include the following essential elements to document the transaction and establish the parties' rights and obligations.

Identification of Parties: Full legal name, cédula de ciudadanía (CC), address, and contact information of both the vendedor and comprador. For commercial sellers: razón social, NIT assigned by the DIAN, Cámara de Comercio registration, and CC of the representante legal. For online or distance sales, the seller's registered business address must be disclosed under Ley 1480 Article 46.

Description of Goods (Descripción de los Bienes): Complete identification of each appliance or electronic item: brand (marca), model (modelo), serial number (número de serie), colour (color), year of manufacture (año de fabricación), and condition (condición — nuevo/used, stating specific defects for used items). For used goods: description of existing defects (defectos existentes), cosmetic damage (daños estéticos), and functional condition confirmed by the buyer before purchase.

Sale Price and Payment (Precio y Forma de Pago): Total purchase price in Colombian pesos (COP), stated both in numbers and letters. Payment method — cash, bank transfer, cheque de gerencia, credit card (tarjeta de crédito), or instalment plan (cuotas diferidas). For instalment sales: number of instalments, interest rate (tasa de interés — expressed as nominal annual or effective annual under Circular Básica Contable y Financiera of the SFC), and total cost of credit (costo total del crédito) as required by Ley 1480 Article 33.

Warranty Terms (Términos de Garantía): For commercial sellers, explicit reference to the garantía mínima legal (minimum legal guarantee) of one year for durable goods under Ley 1480 Article 8, covering manufacturing and material defects. For used goods sold by a commercial seller, Decreto 735 de 2013 permits the guarantee period to be reduced by agreement to a minimum of three months. For private sales between individuals, the agreement should explicitly state that no commercial warranty applies and specify any known defects — this protects the private seller from liability under CC Article 1893 (vicios ocultos) for defects that were disclosed and accepted by the buyer.

Delivery and Condition (Entrega y Estado): Delivery location, date, and method — on-site pickup (recogida en sitio), home delivery (entrega a domicilio), or postal service. Risk of loss (riesgo de pérdida) transfers from seller to buyer upon delivery. For large appliances requiring professional installation — air conditioners, built-in ovens, water heaters — the agreement should specify whether installation is included, and whether the installer holds the RETIE (Reglamento Técnico de Instalaciones Eléctricas) certification required by Resolución 90708 de 2013.

Technical Documents and Accessories (Documentos Técnicos y Accesorios): List of items included with the appliance — user manual (manual de usuario), remote control (control remoto), power adaptor, original packaging (caja original), and any accessories. Original warranty certificate (certificado de garantía de fábrica) and proof of purchase for new goods. For used goods: record of prior repairs (historial de reparaciones) if known.

Return and Cancellation (Derecho de Retracto): For purchases made through distance channels (internet, telephone, or catalogue) from a commercial seller, the buyer's right of retracto within five business days under Ley 1480 Article 47 must be disclosed — the seller must refund the price within fifteen business days and collect the goods at the seller's expense. In-store purchases do not automatically trigger the right of retracto under Colombian consumer law.

Forms-legal.com provides this Household Appliances Sale Agreement Colombia as a practical template for documenting appliance sales. Consumers purchasing from commercial sellers should verify the SIC's public registry of warranty complaints (sistema de información de quejas y reclamos de garantía) before purchasing and know their right to file a protection claim (acción de protección al consumidor) before the SIC's Delegatura para la Protección al Consumidor if a commercial seller fails to honour the garantía mínima legal.
