What Is a Family Protection Order Application Colombia (Medida de Protección Familiar)?

A Family Protection Order Application Colombia (Solicitud de Medida de Protección Familiar) is the formal petition through which a domestic violence victim — or any person entitled by law to act on their behalf — requests the Comisaría de Familia to issue binding legal orders that physically separate the victim from the aggressor, restrict the aggressor's contact and movement, and provide immediate material support, all under the authority of Ley 294 de 1996, Ley 575 de 2000, and Ley 1257 de 2008.

The medida de protección (protection order) is the primary and most powerful administrative remedy for domestic violence in Colombia, distinct from — though often complementary to — the criminal process before the Fiscalía General de la Nación. While criminal prosecution addresses punishment for the perpetrator under Código Penal Article 229, the medida de protección focuses exclusively on the victim's immediate safety, providing rapid binding relief without requiring the lengthy evidentiary standards of a criminal trial.

Ley 294 de 1996 — Colombia's foundational domestic violence statute — established the Comisaría de Familia as the competent authority to issue protection orders. Ley 575 de 2000 transferred exclusive jurisdiction over protection orders from Juzgados de Familia to Comisarías de Familia, establishing the 10-working-day hearing deadline. Article 5 of Ley 575 de 2000 lists the full catalog of protection measures available.

Ley 1257 de 2008 — specifically Articles 17 through 19 — expanded the protection order framework for violence against women, adding: the right to receive emergency shelter and food support; the right to continue labor employment without discrimination while proceedings are pending; the right to reserved housing in case of eviction from the family home; and the right to be accompanied by an ICBF social worker or Defensoría del Pueblo advisor at all stages.

Decree 4799 de 2011 issued by the Ministerio del Interior regulates the implementation of Ley 1257 de 2008 and provides detailed procedural rules for Comisarías de Familia, requiring gender-sensitive protocols, specialized training, and coordination mechanisms with EPS, ICBF, and housing authorities.

The Constitución Política Article 43 establishes women's fundamental right to protection from any form of discrimination and violence, and Article 42 mandates that family violence shall be sanctioned by law. The Corte Constitucional has consistently held that Comisarías must apply the protection order framework with a gender perspective (perspectiva de género) per Sentencia T-967 de 2014 and multiple subsequent rulings.

When Do You Need a Family Protection Order Application Colombia (Medida de Protección Familiar)?

A Family Protection Order Application Colombia is needed whenever a person is experiencing domestic violence — physical, psychological, economic, or sexual — and requires immediate legal separation from the aggressor, enforcement of boundaries, and protection of their physical safety and wellbeing.

The application is urgently needed when the victim remains in the same household as the aggressor and eviction is required — the medida de protección is the only legal instrument that can order the removal of the aggressor from the shared home, even if the aggressor is the property owner or lessee, without going through the ordinary civil courts. Under Ley 294 de 1996 Article 7, the Comisaría can issue the eviction order provisionally on the same day the application is received, before the formal hearing.

The solicitud is needed when the victim is being stalked, harassed, or followed — when the aggressor is contacting the victim incessantly, waiting outside their home or workplace, following them, or monitoring their activities through digital means.

The application is needed when minor children are at risk — their exposure to domestic violence is itself a form of harm under CIA Article 20, and the Juzgado de Familia and ICBF Defensor de Familia must be involved when children's welfare is at stake.

The solicitud is needed when the victim requires economic support — under Ley 294 de 1996 Article 5, the Comisaría can order provisional alimony (cuota de alimentos provisionales) for the victim and their children.

The application is also appropriate when violence has not yet been physical but is escalating — threatening messages, increasing psychological control, destruction of property — since Colombian law does not require physical injury before issuing protection orders.

What to Include in Your Family Protection Order Application Colombia (Medida de Protección Familiar)

A valid Family Protection Order Application Colombia under Ley 294 de 1996, Ley 575 de 2000, and Ley 1257 de 2008 must contain the following essential elements for processing by the Comisaría de Familia.

Applicant Identification (Identificación del Solicitante): Full name, cedula de ciudadania, address, phone number, and relationship to the aggressor. The applicant may be the victim themselves, a family member, a neighbor, a public official (Defensoría del Pueblo, ICBF), or any person who has knowledge of the violence under Ley 294 de 1996 Article 6.

Aggressor Identification (Identificación del Agresor): Full name, cedula or identification, current address, phone number, place of work, and precise family relationship to the applicant. Accurate identification is essential for service of notice and for Policía Nacional enforcement of any issued protection order.

Relationship Basis (Vínculo Familiar): A description of the family or household relationship establishing jurisdiction under Ley 294 de 1996 Article 2 — covering spouses, former spouses, partners in unión marital de hecho, former partners, parents and children, siblings, grandparents, in-laws, and any permanent household member.

Facts of Violence (Hechos de Violencia): A clear, chronological description of specific acts of violence — dates, locations, nature of the violence, severity, frequency, and any injuries or damages. Specific incidents with dates and descriptions are required.

Specific Protective Measures Requested from the catalog in Ley 294 de 1996 Article 5: (a) eviction of the aggressor from the family home; (b) restraining order at specified distance; (c) prohibition on disturbing or threatening the victim; (d) provisional custody of minor children; (e) return of personal belongings; (f) provisional monthly alimony; (g) order for psychological treatment; and (h) any other necessary measure.
