What Is a Workplace Biosecurity Protocol Colombia (Protocolo de Bioseguridad)?

A Workplace Biosecurity Protocol Colombia (Protocolo de Bioseguridad) is a formal document that establishes the set of preventive and corrective measures an employer must implement to reduce the risk of COVID-19 transmission and other biohazards within the work environment. Resolución 666 de 2020 del Ministerio de Salud y Protección Social, issued on 24 April 2020, made workplace biosecurity protocols mandatory for all economic sectors authorized to operate during the public health emergency declared through Decreto 417 de 2020. Every company, institution, and organization employing workers in Colombia was required to design, implement, and publish a biosecurity protocol aligned with the sector-specific guidelines issued by the Ministerio de Salud and the relevant sector ministry.

The legal foundation of the Protocolo de Bioseguridad sits within the intersection of occupational health law and public health emergency regulation. Decreto 1072 de 2015 (Decreto Único Reglamentario del Sector Trabajo), specifically its Libro 2, Parte 2, Título 4, Capítulo 6, establishes the Sistema de Gestión de la Seguridad y Salud en el Trabajo (SG-SST) as the mandatory occupational safety management framework for all Colombian employers. Resolución 0312 de 2019 del Ministerio del Trabajo sets the minimum SG-SST standards (estándares mínimos) calibrated to company size and risk level. COVID-19 biosecurity protocols became an extension of the SG-SST obligations, requiring employers to update their hazard identification (identificación de peligros), risk assessment (valoración de riesgos), and risk control matrices under Artículo 2.2.4.6.15 of Decreto 1072 de 2015.

Decreto 539 de 2020 del Ministerio del Trabajo empowered labor inspectors to verify biosecurity protocol compliance during workplace inspections and to impose sanctions under Ley 1562 de 2012 and Código Sustantivo del Trabajo for non-compliant employers. The Superintendencia Nacional de Salud and the Secretarías Distritales y Municipales de Salud were simultaneously authorized to conduct health inspections and order temporary business closure (cierre temporal) for establishments failing to meet the protocols under Decreto 476 de 2020.

ARL (Administradoras de Riesgos Laborales) participation is mandatory in biosecurity protocol design under Ley 1562 de 2012. Article 11 of Ley 1562 assigns ARLs the responsibility of providing employers with prevention and health promotion services (servicios de prevención y promoción), and the Ministerio del Trabajo's circulares (including Circular 0021 de 2020) directed ARLs to support employers in drafting biosecurity protocols. The Federación de Aseguradores Colombianos (FASECOLDA) coordinated sector-wide guidance for ARL compliance activities during the pandemic.

Beyond COVID-19, the Protocolo de Bioseguridad framework established by Colombia during the pandemic has proven to be a durable occupational health instrument. Employers in healthcare, food processing, education, transportation, and construction sectors now use biosecurity protocols as a permanent component of their SG-SST. Resolución 1111 de 2017, though superseded by Resolución 0312 de 2019, and the subsequent Circular 0064 de 2020, all reference biosecurity as an integral element of the minimum occupational health standards. The Comité Paritario de Seguridad y Salud en el Trabajo (COPASST), established under Decreto 1072 de 2015 Article 2.2.4.6.11, plays a central audit and oversight role in verifying protocol implementation at the workplace level.

For companies with ten or more workers, COPASST participation in biosecurity protocol design and quarterly review is mandatory. For smaller companies, the Vigía de Seguridad y Salud en el Trabajo fulfills this function. Both must document their review findings in meeting minutes (actas de reunión) that form part of the SG-SST documentary file. The Ministerio del Trabajo's inspectors verify these minutes during audits conducted under the Plan Nacional de Inspección, Vigilancia y Control del Trabajo established by Resolución 1309 de 2020.

When Do You Need a Workplace Biosecurity Protocol Colombia (Protocolo de Bioseguridad)?

A Workplace Biosecurity Protocol Colombia is required whenever an employer operates in any economic sector during a declared public health emergency and when sector-specific guidance from the Ministerio de Salud mandates protocol documentation. Under Resolución 666 de 2020, ALL economic sectors — including manufacturing, commerce, financial services, healthcare, transportation, education, and public administration — must have a written and published biosecurity protocol before resuming or continuing operations during the COVID-19 emergency period.

The protocol is specifically required when an employer's SG-SST risk matrix (matriz de riesgos) identifies biological hazards (riesgo biológico) as a priority risk, which applies broadly during pandemic conditions. Resolución 0312 de 2019 mandates that risk matrices be updated whenever a new hazard is identified, meaning every company must update its SG-SST documentation to incorporate COVID-19 biosecurity measures. Companies with 11 or more workers (riesgo I-III) must have their COPASST validate the protocol update before implementation.

Employers seeking affiliation with the ARL or requesting prevention services from their ARL under Ley 1562 de 2012 must present an updated biosecurity protocol as evidence of SG-SST compliance. ARLs (including Positiva Compañía de Seguros, Sura ARL, Colmena Seguros, Seguros Bolívar ARL, and Axa Colpatria) conduct periodic employer audits and require biosecurity protocol documentation as a prerequisite for occupational risk coverage during pandemic periods.

The Ministerio del Trabajo requires the protocol during labor inspections conducted by inspectors from the regional Direcciones Territoriales del Trabajo. Under Decreto 1072 de 2015 Article 2.2.4.6.21, employers must make their SG-SST documentation — including biosecurity protocols — available to labor inspectors upon request. Failure to present the protocol constitutes a violation sanctioned under Ley 1562 de 2012 Article 30, with fines ranging from 1 to 1,000 SMLMV (salarios mínimos legales mensuales vigentes).

Companies participating in public procurement through SECOP II under Decreto 1082 de 2015 must demonstrate SG-SST compliance as a habilitating requirement (requisito habilitante) in bidding processes. Biosecurity protocols form part of the SG-SST compliance package that contracting entities (entidades contratantes) verify before awarding contracts. Colombia Compra Eficiente has incorporated biosecurity documentation into its standard procurement due-diligence checklists.

Parties in Colombia should prepare a Workplace Biosecurity Protocol Colombia (Protocolo de Bioseguridad) proactively rather than waiting for a dispute to arise. Courts interpret agreements based on the written terms rather than oral representations. Under the Codigo Sustantivo del Trabajo (CST), Colombian employment law governs individual and collective labour relations. The Ministerio del Trabajo enforces compliance and issues regulations. The Sistema General de Seguridad Social (EPS, ARL, Fondo de Pensiones) provides health, occupational risk, and pension coverage. The Unidad de Gestion Pensional y Parafiscales (UGPP) audits employer contributions. The Caja de Compensacion Familiar administers family subsidy benefits. Where the transaction involves regulated activities, prior approval from the relevant authority may be required before execution.

What to Include in Your Workplace Biosecurity Protocol Colombia (Protocolo de Bioseguridad)

A valid Workplace Biosecurity Protocol Colombia under Resolución 666 de 2020, Decreto 539 de 2020, and Decreto 1072 de 2015 must contain the following essential elements to satisfy regulatory requirements and protect both employer and employee.

Company Identification and Scope: Full legal name (razón social), NIT (Número de Identificación Tributaria), economic activity code (CIIU — Clasificación Industrial Internacional Uniforme), work location addresses, number of workers, ARL affiliation, and risk classification (clase de riesgo I through V under Decreto 1607 de 2002). The protocol scope must specify whether it covers all premises or only specific work areas.

General and Specific Biosecurity Measures: Hand hygiene stations (dispensadores de gel antibacterial) at building entrances, mandatory handwashing protocols for a minimum of 20 seconds with soap and water per World Health Organization guidelines incorporated into Colombian health directives. Physical distancing measures (distanciamiento físico) of a minimum of 1 meter between workers in work areas, adapted per Resolución 666 de 2020 sector-specific annexes.

Personal Protective Equipment (EPP) Requirements: Type and standard of face masks required by work area and exposure level — industrial masks certified under NIOSH N95 or EN 149:2001 standards for high-exposure roles, surgical masks (tapabocas quirúrgicos) for moderate exposure, and cloth masks for low-exposure office workers. Gloves, face shields, gowns, and other PPE must be specified with supply chain responsibilities. Under Resolución 0312 de 2019, EPP provision is an employer obligation at no cost to the worker.

Ventilation and Air Quality Controls: Requirements for natural and mechanical ventilation in enclosed spaces, maximum occupancy limits per square meter of usable area (aforo máximo), and protocols for HVAC system maintenance and air filter replacement. HVAC maintenance records must be kept as part of the SG-SST documentary file per Decreto 1072 de 2015 Article 2.2.4.6.22.

Surface Disinfection Schedule: Frequency of cleaning and disinfection for high-touch surfaces (surfaces tocadas con frecuencia) such as door handles, elevator buttons, shared equipment, and workstation desks. Approved disinfectant concentrations (diluciones de desinfectantes) per INVIMA (Instituto Nacional de Vigilancia de Medicamentos y Alimentos) authorized products list under Decreto 677 de 1995 and Circular Externa de 2020.

Symptom Monitoring and Case Management: Daily health screening (tamizaje de síntomas) procedure — temperature checks (termometría), symptom questionnaire, and exclusion criteria for workers presenting fever (≥38°C), cough, dyspnea, or other COVID-19 symptoms. Protocol for suspected case isolation (aislamiento preventivo), notification to the ARL within two business days of a workplace COVID-19 case under Ley 1562 de 2012 Article 3, and referral to the EPS (Entidad Promotora de Salud) for medical evaluation.

Contact Tracing Procedure: Method for identifying and notifying co-workers who had close contact (less than 2 meters for more than 15 minutes) with a confirmed or suspected COVID-19 case. This procedure must align with the Protocolo de Vigilancia en Salud Pública issued by the Instituto Nacional de Salud (INS) and the lineamientos of the Ministerio de Salud.

COPASST Oversight and SG-SST Integration: Minutes of COPASST meetings (actas del COPASST) where the biosecurity protocol was reviewed and approved, frequency of protocol audits, and documentation of worker training sessions (capacitaciones) on biosecurity measures. Training attendance records must be maintained under Decreto 1072 de 2015 Article 2.2.4.6.11.

Forms-legal.com provides this Protocolo de Bioseguridad COVID-19 Colombia template as a starting point for employer compliance. Given that biosecurity requirements may evolve with new ministerial resolutions from the Ministerio de Salud y Protección Social, employers should verify current requirements with their ARL and consult a professional en salud ocupacional or abogado laboralista before implementing the protocol.
