I. COMPARECIENTE

What Is a Economic Dependency Declaration Chile?

Article 5 of DL 3.500 defines the beneficiaries eligible for survivor pension — including the surviving spouse or conviviente civil, children (hijos), and parents (padres) who were economically dependent on the deceased affiliate (afiliado fallecido). The Servicio de Registro Civil e Identificación and the Notarías de Chile are the primary places for executing this declaration. When Do You Need a Economic Dependency Declaration Chile?

An Economic Dependency Declaration Chile is required in a defined set of administrative and legal scenarios where a person must prove that they financially depend on another individual for their subsistence and that this dependency relationship qualifies them for specific social, pension, or health benefits.

AFP survivor pension applications are the primary use case. A Declaration of Economic Dependency is required for parents and other non-standard family members to be registered as cargas. ISAPRE plans (supervised by the Superintendencia de Salud) have similar carga requirements.

Asignación Familiar benefit claims through SUSESO or directly through employers require proof that a family member qualifies as an economically dependent carga under DFL N° 150 of 1981, entitling the worker to a monthly family allowance per qualifying dependent.

Inheritance proceedings (procedimientos sucesorios) and survivor benefit claims before the Instituto de Previsión Social (IPS — Chile Previsión) — which administers the old public pension system under INP and pensions for public servants under Ley N° 15.386 — also require Economic Dependency Declarations from parents and other qualifying relatives of deceased beneficiaries.

What to Include in Your Economic Dependency Declaration Chile

For AFP and ISAPRE carga registration purposes, the declarant's own income must be below the threshold established by the relevant regulations — typically below a maximum monthly income set by the Superintendencia de Pensiones or the ISAPRE system.

Relationship to Provider (Vínculo con el Sostenedor): The legal or factual relationship between the declarant and the provider — spouse (cónyuge), conviviente civil (under Ley N° 20.830), child (hijo/a), parent (padre/madre), sibling (hermano/a), or other. For AFP survivor pension purposes, the relationship must correspond to one of the categories in DL 3.500 Article 5.

Declaration of Exclusivity (Declaración de Exclusividad): A statement that the declarant is not registered as a carga económica with any other person or institution, and that the provider named is the sole or primary source of financial support. False declarations of economic dependency constitute the offense of declaración falsa (false declaration) under the Código Penal, which may result in criminal liability and repayment obligations.
