I. COMPARECIENTE

En [Lugar de Otorgamiento], República de Chile, con fecha [Fecha de Otorgamiento], ante el Notario Público que autoriza, comparece:

What Is a Declaration of Domicile Chile?

A Declaration of Domicile Chile is a formal legal statement governed by the Código Civil de Chile Articles 59 through 73, by which a natural person (persona natural) or legal entity (persona jurídica) officially establishes, changes, or confirms their civil domicile (domicilio civil) for all legal, administrative, and tax purposes under Chilean law. Article 59 of the Código Civil defines domicilio as the combination of residence (residencia) in a specific place with the real or presumed intention (ánimo) of remaining there permanently. This dual element — material (the physical presence) and intentional (the animus manendi) — distinguishes domicilio from mere residencia or morada, which lack the element of permanence.

The Código Civil Articles 59 through 73 establish a comprehensive framework for domicile in Chile. Article 60 provides that domicile can be political (domicilio político) — relating to the person's membership in Chilean society — or civil (domicilio civil), which is the domicile relevant to private legal relations. Article 61 establishes that a person's domicile for civil purposes is determined by the place of their habitual residence (residencia habitual). Article 62 recognises that a person can have multiple places of residence but only one civil domicile. Article 67 establishes the concept of domicilio especial — a particular domicile elected for specific purposes or contracts, such as a registered office domicile (domicilio constituido) for service of legal process.

The practical importance of the Declaration of Domicile Chile extends across multiple legal frameworks. For the Servicio de Impuestos Internos (SII), domicile determines the jurisdictional competence of the local Unidad del SII and the address for official notifications (notificaciones tributarias) under the Código Tributario. For the Servicio de Registro Civil e Identificación, domicile determines the officer's territorial competence for civil registration acts — births, marriages, deaths, and changes of personal status. For courts (Poder Judicial), domicile determines procedural venue (competencia territorial) under the Código de Procedimiento Civil (CPC) Article 134. For electoral purposes, domicile determines the voting district (local de votación) administered by the Servicio Electoral (Servel).

The Declaration of Domicile is also required by financial institutions — banks regulated by the Comisión para el Mercado Financiero (CMF), insurance companies (compañías de seguros), AFP pension fund administrators regulated by the Superintendencia de Pensiones, and ISAPRE health insurers regulated by the Superintendencia de Salud — to update the declarant's contact information and comply with anti-money laundering regulations under Ley N° 19.913 (Unidad de Análisis Financiero — UAF).

A Declaration of Domicile executed before a Notario Público takes the form of an instrumento público (public document) under Código Civil Article 1700, which gives it full evidentiary value (plena fe) in legal proceedings. Declarations made before administrative agencies — such as the Servicio de Registro Civil e Identificación — have the same legal status as official administrative records. The Notarías de Chile, regulated by the Código Orgánico de Tribunales (COT) Articles 399–437, can issue authorized copies (copias autorizadas) of the declaration for use before third parties.

When Do You Need a Declaration of Domicile Chile?

A Declaration of Domicile Chile is required in a wide range of legal and administrative situations where proof of civil domicile is necessary under Chilean law, particularly in connection with government services, financial institutions, and judicial proceedings.

Change of domicile between regions or communes is the most common trigger. When a person moves from one region to another — for example, relocating from Valparaíso to Santiago, from Concepción to Temuco, or from Antofagasta to Iquique — they must update their domicile with the SII (via the Formulario 3239 or online through the SII portal), the Servicio de Registro Civil e Identificación, the Servel (for electoral roll purposes), and their financial institutions. A notarised Declaration of Domicile provides a single authoritative document to present to all these agencies.

Foreigners obtaining or renewing residency (residencia temporaria or residencia definitiva) under Decreto Ley N° 1.094 (Ley de Extranjería) must declare their domicile in Chile to the Departamento de Extranjería e Inmigración of the Ministerio del Interior y Seguridad Pública and to the PDI (Policía de Investigaciones de Chile) when registering their visa. The Declaration of Domicile is also required when applying for a cédula de identidad through the Registro Civil.

Financial and banking operations routinely require proof of current domicile. When opening bank accounts at Banco de Chile, BancoEstado, Banco Santander Chile, Banco BCI, or Scotiabank Chile, applicants must provide domicile verification under CMF and UAF requirements. Insurance policy applications, mortgage (mutuo hipotecario) applications, and AFP affiliation changes also require current domicile documentation.

What to Include in Your Declaration of Domicile Chile

A valid Declaration of Domicile Chile under Código Civil Articles 59 through 73 must contain the following essential elements to establish an enforceable, legally recognised domicile for all relevant purposes:

Declarant Identification (Individualización del Declarante): Full legal name, RUT number (Rol Único Tributario issued by the SII), nationality, date and place of birth, marital status (estado civil as registered in the Registro Civil), and current occupation or profession. For foreign nationals, the passport number and immigration document (visa or cédula de extranjería issued by the PDI) must be included alongside the RUT if already assigned by the SII.

Declaration of Domicile (Declaración del Domicilio): Precise street address (calle y número), apartment or unit number (departamento, oficina, piso), commune (comuna), city (ciudad), region (región), and postal code (código postal if applicable). The address should match the official property designation used by the municipality (municipalidad) and the SII. For rural properties (predios rurales), the property description, sector name, and nearest municipality should be specified.

Basis of Domicile (Fundamento del Domicilio): A brief statement of the basis on which the declarant occupies the property — as owner (propietario), as tenant under a contract of lease (arrendatario bajo contrato de arrendamiento), as a family member (familiar), or as a beneficiary of a social housing allocation (beneficiario de vivienda social under programs of the Servicio de Vivienda y Urbanización — SERVIU). This element supports the animus element of Article 59 of the Código Civil.

Date of Establishment (Fecha de Establecimiento): The date on which the declarant established their domicile at the declared address. For recent changes of domicile, this supports the claim that the address constitutes a new habitual residence under CC Article 61.

Previous Domicile (Domicilio Anterior): Where the declaration constitutes a change of domicile, the previous address should be stated. This information is required by the SII (for tax domicile update under the Código Tributario), the Servicio de Registro Civil e Identificación (for updating identity documents), and the Servel (for electoral register updates under Ley N° 18.556).

Elected Domicile for Notifications (Domicilio Constituido): Under CC Article 67 and CPC Article 49, the declarant may elect a special domicile (domicilio constituido o especial) for the purpose of receiving legal notices and judicial notifications. This is particularly important in contractual and litigation contexts, where designating a specific address for service of process avoids procedural complications if the declarant subsequently changes physical residence.

Notarial Authentication (Autenticación Notarial): Execution before a Notario Público regulated by COT Articles 399–437 gives the declaration the status of instrumento público under CC Article 1700. The Notario verifies the declarant's identity against their cédula de identidad issued by the Servicio de Registro Civil e Identificación and incorporates the declaration into the protocolo notarial. Authorized copies (copias autorizadas) are issued for presentation to government agencies, financial institutions, and courts.

Signature and Notarial Authorization: The declarant's signature must be authenticated by the Notario Público, who certifies the declarant's identity, legal capacity, and that the declaration was made freely and voluntarily. The Notario's stamp (timbre), signature, and protocol number complete the instrument.
