a) Feriado proporcional: 1,25 días hábiles por mes trabajado, conforme al Artículo 73 del Código del Trabajo.

b) Gratificación proporcional: conforme a los Artículos 47 a 52 del Código del Trabajo.

c) Remuneraciones devengadas y no pagadas hasta el día [Fecha del Último Día].

What Is a Voluntary Resignation Letter Chile (Carta de Renuncia Voluntaria)?

Voluntary Resignation Letter Chile (Carta de Renuncia Voluntaria) is the written instrument by which a worker (trabajador) exercises the right of voluntary termination (renuncia voluntaria) established in Article 159 No. 2 of the Código del Trabajo de Chile (CT), unilaterally bringing the individual employment contract to an end by personal decision. Article 159 No. 2 classifies voluntary resignation as one of the causales de terminación that do not impose financial obligations on the resigning worker — the worker owes no indemnización por años de servicio, no notice period indemnification, and no penalty for departure — but the worker retains entitlements to proportional benefits (prestaciones proporcionales) accrued through the resignation date including feriado proporcional (proportional annual leave under CT Article 73), gratificación proporcional (proportional profit-sharing under CT Articles 47–52), and any outstanding remuneration.

The Dirección del Trabajo (DT) — the Chilean agency under the Ministerio del Trabajo y Previsión Social charged with enforcing labour legislation — and the Juzgados de Letras del Trabajo established by Ley N° 20.087 have consistently held that voluntary resignation under CT Article 159 No. 2 must be unequivocal, free, and deliberate — resignation obtained through coercion (vis compulsiva), threats, or undue pressure from the employer constitutes a despido encubierto (disguised dismissal) subject to the full unjust dismissal remedies under CT Article 168, including severance surcharges of 30% to 100%.

The Corte Suprema de Chile, through its Sala Laboral (Fourth Chamber), has established through recurso de unificación de jurisprudencia proceedings under CT Article 483 that the employer has the burden of proving the voluntariness of the worker's resignation — particularly when the resignation was obtained in circumstances of workplace harassment (acoso laboral under Ley N° 20.607), constructive dismissal conditions (despido indirecto), or as part of mass workforce reduction programs. The DT's Departamento de Relaciones Laborales processes denuncias laborales from workers alleging that resignations were coerced.

Article 177 of the Código del Trabajo requires that the finiquito arising from voluntary resignation be ratified before a ministro de fe — a Notario Público (authorized under Código Orgánico de Tribunales Articles 399–446), an inspector of the Dirección del Trabajo, or the secretary of the Juzgado de Letras del Trabajo — for the finiquito to have the liberatory effect (poder liberatorio) that prevents the former employer from facing subsequent claims regarding the settled employment relationship.

Chilean labour practice generally recognizes that the resigning worker should provide advance notice (aviso previo) to the employer — typically thirty calendar days — though CT Article 159 No. 2 does not expressly impose a statutory notice period on the resigning worker. Many employment contracts and collective bargaining agreements (instrumentos colectivos negotiated under CT Book IV) specify contractual notice periods, and failure to honor contractual notice obligations may entitle the employer to deduct the equivalent compensation from the finiquito settlement. The AFP pension contributions (to AFP Habitat, AFP Provida, AFP Capital, AFP Cuprum, AFP Modelo, or AFP Uno regulated by the Superintendencia de Pensiones under Decreto Ley N° 3.500), FONASA or ISAPRE health contributions, and AFC unemployment insurance contributions under Ley N° 19.728 must all be current at the resignation date for the finiquito to be valid.

When Do You Need a Voluntary Resignation Letter Chile (Carta de Renuncia Voluntaria)?

A Voluntary Resignation Letter Chile is needed whenever a worker decides to terminate an employment relationship of their own accord under Código del Trabajo Article 159 No. 2, and wishes to provide formal written notification to the employer that triggers the finiquito settlement process.

The carta de renuncia voluntaria is needed when a worker has received a competing job offer — a common scenario in Chile's financial sector (Banco de Chile, Banco BCI, Banco Santander Chile, Itaú Chile), mining industry (Codelco, BHP Escondida, Anglo American Chile, Antofagasta Minerals), retail sector (Falabella, Cencosud, Ripley), or technology sector — and needs to formally notify the current employer of departure while allowing adequate transition time.

The resignation letter is essential for workers wishing to transition to self-employment (trabajo independiente), start a new enterprise, or pursue further education — including enrollment in programs at the Universidad de Chile, Pontificia Universidad Católica de Chile, Universidad de Concepción, or Universidad Diego Portales. The language must be clear and unconditional — courts and the Dirección del Trabajo examine the wording to confirm the resignation was not obtained through duress or constructive dismissal conditions.

Effective Date of Resignation (Fecha de Término): The specific date on which the employment relationship will cease. The worker may specify an immediate effective date or a future date to allow transition. Chilean practice and many employment contracts contemplate thirty calendar days' advance notice, though CT Article 159 No. 2 does not legally require the worker to give notice — however, if the employment contract or collective bargaining agreement specifies a notice period, failure to provide it may entitle the employer to deduct the notice period compensation from the finiquito.

Acknowledgment of Pending Benefits (Reconocimiento de Prestaciones): A reference to the worker's entitlement to proportional benefits through the resignation date: feriado proporcional (1.25 working days per month of service under CT Article 73), gratificación proporcional (pro-rata profit-sharing through the resignation date under CT Articles 47–52), and any outstanding remuneration including salary, overtime, and commissions.
