4. RESTRICCIONES Y USOS PROHIBIDOS

Esta autorización no cubre: (a) usos de las imágenes fuera de los fines autorizados y el ámbito geográfico indicados anteriormente; (b) modificaciones de las imágenes que distorsionen o degraden la apariencia o reputación del titular; (c) uso en contextos que asocien al titular con actividades ilegales, contenido político o contenido contrario a su dignidad; (d) sub-licencia a terceros sin consentimiento previo y por escrito del titular. El uso fuera del ámbito acordado constituye una intromisión ilegítima conforme al artículo 7.6 de la LO 1/1982, que faculta al titular a solicitar medidas cautelares e indemnización por daños conforme al artículo 9 de la LO 1/1982.

Esta autorización no transmite los derechos de autor (derechos de autor) sobre las fotografías — los derechos de autor de las imágenes corresponden al fotógrafo conforme a los artículos 10 y 128 de la Ley de Propiedad Intelectual (RDL 1/1996). Para la cesión o licencia de los derechos de autor debe obtenerse un documento específico del fotógrafo.

5. DERECHO DE REVOCACIÓN

El titular conserva el derecho a revocar esta autorización en cualquier momento conforme al artículo 2.3 de la LO 1/1982 y al artículo 7(3) del RGPD, mediante comunicación escrita a [Beneficiary Name]. La revocación surte efecto desde la fecha de comunicación y no invalida los usos ya realizados durante el período de vigencia. La revocación sin causa justa puede dar lugar a una reclamación de daños y perjuicios por parte del cesionario por los costes incurridos en razón de esta autorización conforme al artículo 2.3 de la LO 1/1982.

6. PROTECCIÓN DE DATOS (RGPD)

La imagen fotográfica del titular constituye un dato personal conforme al artículo 4(1) del RGPD y la Ley Orgánica 3/2018 (LOPDGDD). El cesionario (responsable del tratamiento) trata estos datos sobre la base del consentimiento del titular (artículo 6.1(a) RGPD) para los fines comerciales descritos en esta autorización. El titular tiene derecho de acceso, rectificación, supresión (derecho al olvido — artículo 17 RGPD), limitación y oposición al tratamiento de sus datos de imagen, ejercitable mediante solicitud escrita al cesionario y, en su caso, ante la Agencia Española de Protección de Datos (AEPD — aepd.es). Los datos se conservarán durante el plazo de vigencia de esta autorización más el plazo de prescripción aplicable conforme al Derecho español.

What Is a Commercial Image Use Authorization Spain (Autorización de Uso de Imagen Comercial)?

A Commercial Image Use Authorization Spain (Autorización de Uso de Imagen Comercial or Cesión de Derechos de Imagen) is a written consent document through which a natural person (the subject — sujeto titular de la imagen) grants a business, photographer, or media producer (the beneficiary — cesionario) the right to reproduce, publish, distribute, and use that person's photographic image, video footage, or other likeness for commercial purposes, including advertising campaigns, marketing materials, social media, and digital media. The authorization is governed principally by Ley Orgánica 1/1982, de 5 de mayo, de protección civil del derecho al honor, a la intimidad personal y familiar y a la propia imagen (LO 1/1982), which recognizes the right to one's own image (derecho a la propia imagen) as a fundamental right under Article 18.1 of the Constitución Española 1978.

Article 2.2 of LO 1/1982 establishes that the owner of the right to one's own image may grant express consent (consentimiento expreso) to third parties to use their image — limiting or waiving, for the agreed scope and purpose, the protections otherwise afforded by the law. Without such express consent, any commercial use of a person's image constitutes an unlawful intrusion (intromisión ilegítima) under Article 7.6 LO 1/1982, entitling the subject to seek injunctive relief and damages (indemnización) before the Juzgado de Primera Instancia under Article 9 LO 1/1982. The authorization is needed for advertising campaigns (campañas publicitarias) — television commercials, digital advertising, outdoor billboards (vallas publicitarias), print advertising, and social media content — where models, actors, athletes, or ordinary members of the public appear in materials promoting products or services. Advertising agencies (agencias de publicidad) and brands operating in Spain are required under LO 1/1982 to hold signed image use authorizations from all identifiable individuals appearing in their commercial materials.
