What Is a Consumer Arbitration Request Spain (Solicitud de Arbitraje de Consumo)?

A Consumer Arbitration Request (Solicitud de Arbitraje de Consumo) in Spain is a formal written application submitted to a Junta Arbitral de Consumo — a public body operating under the Sistema Arbitral de Consumo (SAC) — asking a panel of arbitrators to resolve a consumer dispute through a binding, extrajudicial procedure free of charge to the consumer. The SAC operates under Real Decreto 231/2008, de 15 de febrero, por el que se regula el Sistema Arbitral de Consumo, which established a unified national framework administered by the Instituto Nacional del Consumo (INC), now integrated into the Agencia Española de Seguridad Alimentaria y Nutrición (AESAN), in coordination with regional consumer protection bodies (organismos de consumo de las Comunidades Autónomas) and municipal and provincial juntas arbitrales.

The SAC offers consumers in Spain a free, fast, and binding alternative to civil litigation for resolving disputes with businesses over the purchase of goods or provision of services. Consumer arbitration under Real Decreto 231/2008 is entirely free for the consumer, conducted within a maximum period of six months from the appointment of the arbitral college (colegio arbitral) under Article 49 RD 231/2008, and produces a final award (laudo arbitral) that carries the same legal force as a court judgment (sentencia judicial firme) under Article 43 of the Ley 60/2003, de 23 de diciembre, de Arbitraje (LA). Consumer arbitration under the SAC covers disputes arising from consumer contracts (contratos de consumo) as defined in Article 2 of the Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios (LGDCU). The LGDCU defines a consumer (consumidor o usuario) as a natural or legal person acting outside their commercial or professional activity who acquires goods or services from a trader (empresario) acting within their trade. A Solicitud de Arbitraje de Consumo in Spain should be submitted when a consumer has been unable to resolve a dispute with a business through direct negotiation or formal complaint to the business's Servicio de Atención al Cliente (SAC), and wishes to seek a free, binding resolution without initiating civil court proceedings before the Juzgados de Primera Instancia. Consumer arbitration under Real Decreto 231/2008 is appropriate across a wide range of consumer contract disputes.

Defective goods and non-conforming services are the most common category. Under Articles 114–126 LGDCU — implementing the EU Consumer Goods Directive 1999/44/CE and updated by Real Decreto Legislativo 1/2007 — consumers have a right to repair, replacement, price reduction, or rescission when goods are not in conformity at delivery. Where the seller refuses to honour the guarantee, consumer arbitration before the Junta Arbitral de Consumo provides a direct enforcement route without legal fees. Common examples include defective household appliances, malfunctioning electronic equipment, and vehicles sold with concealed defects.

Telecommunications and energy disputes are a major category. Operators regulated by the Comisión Nacional de los Mercados y la Competencia (CNMC) — including Telefónica, Vodafone, Orange, MásMóvil, Endesa, Iberdrola, and Naturgy — frequently adhere to the SAC. Disputes about incorrect billing (facturación incorrecta), service discontinuation without cause, excessive charges for contract cancellation (penalización por baja), and failure to implement agreed service changes are appropriate for consumer arbitration.

Travel and tourism disputes are frequently brought before the juntas arbitrales. Online purchase and e-commerce disputes are subject to the SAC through the CONFIANZA EN LÍNEA online platform — an approved alternative dispute resolution (ADR) body under Directiva 2013/11/UE on consumer ADR and Reglamento (UE) 524/2013 on online dispute resolution (ODR). Under Ley 34/2002 (LSSICE) and the Ley Orgánica 3/2018 (LOPDGDD), consumers who purchased goods or services online from Spanish businesses may file their arbitration request through the Sede Electrónica of the competent Junta Arbitral or through the European ODR platform.

The solicitud must be submitted before the claim becomes time-barred. Consumer claims in Spain are generally subject to the three-year limitation period for contractual claims under Article 1964 of the Código Civil (CC), or shorter specific periods depending on the nature of the claim. Submission of the arbitration request interrupts the limitation period under Article 1973 CC. Consumers should submit promptly after the business's Servicio de Atención al Cliente fails to resolve the matter within one month, as required by Article 21 Ley 44/2006 de mejora de la protección de los consumidores y usuarios.

Arbitration is not available for disputes expressly excluded by Article 2.2 of Real Decreto 231/2008, including disputes involving bodily injury (daños a la salud), financial services other than basic payment services, healthcare services, transport services regulated by specific legislation, or disputes in which a criminal offence (delito) may have been committed. For excluded matters, consumers must use sector-specific remedies — the Banco de España for banking complaints, the Comisión Nacional del Mercado de Valores (CNMV) for securities disputes, or the CNMC for telecommunications and energy disputes — or civil litigation.

What to Include in Your Consumer Arbitration Request Spain (Solicitud de Arbitraje de Consumo)

A legally effective Solicitud de Arbitraje de Consumo under Real Decreto 231/2008 must contain the following elements to be accepted by the Junta Arbitral de Consumo and processed with maximum efficiency.

Consumer Identification. The full name, DNI/NIE or passport number, postal address, telephone number, and email address of the consumer submitting the request. Where the consumer is represented by another person (legal representative or consumer association such as OCU, FACUA, or CEACCU), the authority for representation must be evidenced by a written authorisation (representación) or the association's membership confirmation.

Business Identification. The full legal name or commercial name (razón social o nombre comercial), NIF/CIF, registered address, and contact details of the business against which the claim is directed. If the business has adhered to the SAC and displays the Distintivo Oficial de Adhesión, note this fact — it eliminates the need for the Junta Arbitral to obtain voluntary consent, significantly accelerating the process under Article 9 of Real Decreto 231/2008.

Description of the Dispute (Exposición de los Hechos). A clear, factual, and chronological account of the events giving rise to the dispute. The narrative should include: the date and nature of the purchase or service contract; the specific problem encountered (defect, non-delivery, non-conformity, billing error); the date on which the problem was first identified; and the steps already taken to resolve the matter directly with the business — including complaint reference numbers and any written responses from the Servicio de Atención al Cliente. Legal and factual precision is essential — the colegio arbitral decides only within the scope of the request.

The Claim Sought (Pretensión). A specific and quantifiable statement of the relief the consumer seeks under the LGDCU or other applicable law: full refund of €850 paid for a defective appliance; repair or replacement free of charge under Article 118 LGDCU; payment of €300 compensation for consequential losses; or cancellation of the contract and return of all sums paid. Vague claims are harder for the arbitrators to adjudicate and may result in a reduced award or a request for clarification that delays proceedings.

Supporting Documentation. All relevant evidence must be attached under Article 34.2 of Real Decreto 231/2008: purchase receipt or invoice (factura o ticket de compra); copy of the contract or terms and conditions (condiciones generales de la contratación); photographs of defects or damages; correspondence with the business (emails, letters, burofax with delivery confirmation); expert reports (informes periciales privados) where obtained; repair estimates or invoices; and any complaint acknowledgement or response from the business's SAC. The colegio arbitral may request additional evidence during the arbitration, but attaching all available documents with the initial request accelerates the procedure.

Prior Complaint to the Business. Evidence of a formal complaint to the business's Servicio de Atención al Cliente (SAC) — required under Ley 44/2006 as a prerequisite before most Juntas Arbitrales will accept the arbitration request. The SAC must have failed to resolve the matter within one month, or the response must be unsatisfactory, before the consumer proceeds to arbitration. A copy of the complaint and any response (or confirmation of no response after one month) should be attached.

Competent Junta Arbitral. The request must be directed to the territorially competent Junta Arbitral de Consumo. Juntas arbitrales exist at municipal level (e.g. Junta Arbitral de Consumo del Ayuntamiento de Madrid), provincial level (e.g. Junta Arbitral de Consumo de la Provincia de Barcelona), and autonomous community level (e.g. Junta Arbitral de Consumo de la Comunitat Valenciana, Junta Arbitral de Consumo de la Comunidad de Madrid). Competence is generally determined by the consumer's place of residence or the place of purchase.

Confirmation of Non-Exclusion from SAC Scope. The request should confirm that the dispute does not fall within the exclusions listed in Article 2.2 of Real Decreto 231/2008 — no bodily injury, no financial services, no health services, no criminal element, and no transport services excluded by specific legislation.

Date and Signature. The request must be dated and signed by the consumer or their legal representative.
