What Is a Liability Release for Recreational Activities Colombia?

A Liability Release for Recreational Activities Colombia in Colombia liability Release Agreement for Recreational Activities Colombia is the document through which a participant in a recreational, adventure sports, or risk activity — paragliding, rafting, rock climbing, extreme cycling, speleology, mountain trekking, zip-lining, paintball, karting, high-risk water activities, mass events — freely and voluntarily acknowledges the inherent risks of the activity, declares their physical aptitude and absence of medical contraindications, and releases the operator or service provider from civil liability arising from accidents or injuries caused by those inherent risks, under the civil liability framework of Colombia's Código Civil (Articles 2341 to 2360) and limits imposed by Ley 1480 de 2011 (Estatuto del Consumidor) on abusive clauses.

In the Colombian legal system, extra-contractual civil liability is governed by Código Civil Article 2341 — establishing the obligation to repair harm caused by fault or wilful misconduct — and by Article 2356, which establishes liability for dangerous activities: those who undertake an activity that by its nature is dangerous (activities where the risk of harm exceeds ordinary everyday risk) are specially liable for damages caused, unless they demonstrate force majeure, act of God, exclusive fault of the victim, or exclusive act of a third party.

The Corte Suprema de Justicia de Colombia — Sala de Casación Civil — has developed extensive jurisprudencia on liability for dangerous activities in sports and recreational contexts, establishing that adventure sports and high-risk activity operators hold a relative objective liability regime requiring them to demonstrate damage was caused by a factor exogenous to the activity's inherent risk.

The liability release cannot validly exempt the operator from all liability: Ley 1480 de 2011 Article 34 establishes that clauses exonerating producers or providers from liability for wilful misconduct or gross negligence are absolutely null and void, and the SIC has declared abusive various liability exemption clauses in recreational and sports service contracts that sought to exempt the operator from all negligence liability.

The legal framework governing the Liability Release for Recreational Activities Colombia in Colombia draws on several key statutes and regulatory bodies. Under Colombian law, the Codigo Civil governs marriage, divorce, custody, and maintenance. The Ley 1098 de 2006 (Codigo de la Infancia y la Adolescencia) protects minors through the ICBF (Instituto Colombiano de Bienestar Familiar). The Ley 640 de 2001 governs conciliation. The Registraduria Nacional del Estado Civil records births, marriages, and deaths. The Defensoria del Pueblo protects fundamental rights. Parties executing a Liability Release for Recreational Activities Colombia in Colombia should confirm the document reflects current law, including any amendments enacted since the original drafting date. The Código Civil arts. 2341–2360 (responsabilidad extracontractual); Ley 1480 de 2011 art. 34 (cláusulas abusivas); Decreto 4183 de 2011 sets the foundational requirements.

When Do You Need a Liability Release for Recreational Activities Colombia?

A Liability Release Agreement for Recreational Activities is needed in Colombia when an operator provides sports, recreational, or adventure activity services that carry inherent risks above those of everyday life, and wishes to formally document the participant's informed consent regarding those risks as a liability management tool.

Adventure tourism operators — paragliding in Rionegro (Antioquia) or San Gil (Santander), rafting on the Río Cañón del Chicamocha, rock climbing in Suesca (Cundinamarca), canyoning in San Carlos (Antioquia), speleology at the Cueva de los Guácharos (Huila) — registered with the Registro Nacional de Turismo (RNT) of the Ministerio de Comercio, Industria y Turismo must obtain participants' signatures on liability releases before activity commencement, as required by civil liability insurance policies and as informed risk documentation.

Extreme sports clubs and schools — diving and scuba clubs at Parque Nacional Natural Corales del Rosario y San Bernardo, kitesurfing and windsurfing schools in Cartagena or Santa Marta, motocross schools in Bogotá, mountain biking (MTB) clubs on the Sabana de Bogotá — need members to sign liability releases documenting knowledge and acceptance of sports risks.

Mass outdoor event organisers — marathons and obstacle races (Spartan Race Colombia, Bogotá Marathon), music festivals, outdoor yoga and meditation events, corporate retreats with adventure activities — must include a liability release in the registration process to document that participants know the required physical conditions, applicable medical restrictions, and activity risks.

Parties in Colombia should prepare a Liability Release for Recreational Activities Colombia proactively rather than waiting for a dispute to arise. Courts interpret agreements based on the written terms rather than oral representations. Under Colombian law, the Codigo Civil governs marriage, divorce, custody, and maintenance. The Ley 1098 de 2006 (Codigo de la Infancia y la Adolescencia) protects minors through the ICBF (Instituto Colombiano de Bienestar Familiar). The Ley 640 de 2001 governs conciliation. The Registraduria Nacional del Estado Civil records births, marriages, and deaths. The Defensoria del Pueblo protects fundamental rights. Where the transaction involves regulated activities, prior approval from the relevant authority may be required before execution.

What to Include in Your Liability Release for Recreational Activities Colombia

A valid Liability Release Agreement for Recreational Activities in Colombia, under the Código Civil, Ley 1480 de 2011, and the Corte Suprema de Justicia — Sala de Casación Civil jurisprudencia, must contain the following elements to have probative effect and withstand judicial or SIC scrutiny.

Operator identification: Company name or full name of the activity operator, NIT or cédula, establishment address, Registro Nacional de Turismo (RNT) number if registered with the Ministerio de Comercio, Industria y Turismo, and reference to the current civil liability and personal accident insurance covering the activity.

Participant identification: Full name, cédula de ciudadanía or passport number, date of birth, emergency contact information (name, relationship, telephone). For minors: the agreement must be signed by the parent or legal guardian, with their identification and relationship to the minor.

Detailed activity description: Specific name of the activity, location, date and time, technical description of equipment used, difficulty profile or risk level (for adventure tourism: category per Icontec sectoral technical standard NTS-OPC 001 for adventure activity operators), and relevant climate or environmental conditions for safety.

Specific identification of inherent risks: The most critical element. The Corte Suprema de Justicia has established that for a participant's risk acceptance to have exonerating effects, risks must be identified specifically and concretely — a generic "I accept all risks" clause is insufficient. Risks must be those inherent to the specific activity: for paragliding — unexpected turbulence, variable weather, equipment failure not attributable to the operator, landing injuries; for rafting — falling into water, hypothermia, rock collisions; for rock climbing — fall risk, musculoskeletal injuries, natural anchor failure.

Scope of liability release: The release clause must be drafted with legal precision: limited to the specifically identified inherent risks of the activity; expressly excluding damages caused by operator negligence, defective equipment attributable to the operator, or inadequate guide instructions; and consistent with Ley 1480 de 2011 Article 34 — release from liability for gross negligence or wilful misconduct is always null, and the SIC can declare it abusive.
