What Is a Accommodation Agreement for Foreign Resident Colombia?

Accommodation Agreement for Foreign Resident Colombia is the agreement through which a Colombian host — the owner or legitimate holder of a residential property — receives a foreign national into their home or property, establishing the conditions of the stay, mutual obligations of the parties, and the duration of accommodation, with the purpose of serving as a supporting document before Migración Colombia in visa, cédula de extranjería, or migration registration processes, under Decreto 1067 de 2015 and Ley 820 de 2003 which regulates urban housing rental in Colombia.

The Colombia Accommodation Agreement for Foreign Resident Colombia agreement is distinct from the classic rental contract regulated by Articles 1973 to 2044 of the Código Civil and Ley 820 de 2003: while rental implies payment of rent and exclusive transfer of use and enjoyment of the property to the tenant, the accommodation agreement may be structured as a free housing arrangement (comodato de habitación under Código Civil Article 2200) or as a rental with payment, depending on whether the foreigner pays for accommodation.

Migración Colombia requires foreigners applying for their cédula de extranjería (CE) or migration registration to certify their place of residence in Colombia. The accommodation agreement or a current rental contract constitutes the appropriate document to certify this requirement under Articles 38 and 43 of Decreto 1067 de 2015.

The legal framework governing the Accommodation Agreement for Foreign Resident Colombia in Colombia draws on several key statutes and regulatory bodies. Under Colombian law, the Codigo Civil governs marriage, divorce, custody, and maintenance. The Ley 1098 de 2006 (Codigo de la Infancia y la Adolescencia) protects minors through the ICBF (Instituto Colombiano de Bienestar Familiar). The Ley 640 de 2001 governs conciliation. The Registraduria Nacional del Estado Civil records births, marriages, and deaths. The Defensoria del Pueblo protects fundamental rights. Parties executing a Accommodation Agreement for Foreign Resident Colombia in Colombia should confirm the document reflects current law, including any amendments enacted since the original drafting date. The Decreto 1067 de 2015; Ley 820 de 2003 (arrendamiento urbano); Código Civil arts. 1973–2044 sets the foundational requirements.

When Do You Need a Accommodation Agreement for Foreign Resident Colombia?

An Accommodation Agreement for Foreign Resident Colombia is needed at multiple stages of the migration and integration process of a foreign national in Colombian territory.

Foreigners applying for their Cédula de Extranjería (CE) before Migración Colombia, after obtaining a visa with validity exceeding three months under Decreto 1067 de 2015 Article 43, must certify their place of residence in Colombia through a current rental contract, accommodation agreement issued by the host, or a residence certificate from the junta de acción comunal. The accommodation agreement is especially useful when the foreigner stays with a Colombian family member or at the Colombian spouse's home without having formalised a rental agreement.

Foreigners requesting visa renewal or change from within Colombia must indicate their residence address in Colombia and may be required to present a document certifying domicile. A signed accommodation agreement with the Colombian host satisfies this requirement.

Refugees and international protection beneficiaries receiving support from ACNUR or the Ministerio de Relaciones Exteriores who are received by Colombian host families require an accommodation agreement documenting the temporary housing provided during refugee integration.

Venezuelan nationals with Permiso por Protección Temporal (PPT) under Decreto 216 de 2021 and the Estatuto Temporal de Protección para Migrantes Venezolanos (ETPV) who reside with Colombian families need to document their residence address, for which the accommodation agreement is an agile and accessible mechanism.

Parties in Colombia should prepare a Accommodation Agreement for Foreign Resident Colombia proactively rather than waiting for a dispute to arise. Courts interpret agreements based on the written terms rather than oral representations. Under Colombian law, the Codigo Civil governs marriage, divorce, custody, and maintenance. The Ley 1098 de 2006 (Codigo de la Infancia y la Adolescencia) protects minors through the ICBF (Instituto Colombiano de Bienestar Familiar). The Ley 640 de 2001 governs conciliation. The Registraduria Nacional del Estado Civil records births, marriages, and deaths. The Defensoria del Pueblo protects fundamental rights. Where the transaction involves regulated activities, prior approval from the relevant authority may be required before execution.

What to Include in Your Accommodation Agreement for Foreign Resident Colombia

A valid Accommodation Agreement for a Foreign Resident in Colombia, under Decreto 1067 de 2015, Ley 820 de 2003, and the Código Civil, must contain the following essential elements to be accepted by Migración Colombia and the Cancillería as a domicile certification document.

Identification of the host (landlord or lender): Full name, cédula de ciudadanía (CC) number, full address of the property offered for accommodation (street, number, apartment, neighbourhood, city, department), and relationship to the property — owner (with reference to the matrícula inmobiliaria at the Oficina de Registro de Instrumentos Públicos — ORIP), tenant with landlord's sub-letting authorisation, or legitimate holder with owner's authorisation. A tenant host who sub-lets must certify the main contract permits this, as sub-letting without authorisation violates Ley 820 de 2003 Article 17.

Identification of the hosted foreigner: Full name exactly as in the passport, passport number, current Colombian visa number, cédula de extranjería (CE) number if already issued by Migración Colombia, nationality, and date of birth.

Type of accommodation and economic conditions: Clear specification of whether the contract is free (comodato de habitación under Código Civil Article 2200 — no rent) or paid (arrendamiento under Ley 820 de 2003 — with agreed monthly rent). For rental: monthly rent in Colombian pesos, payment method, and payment frequency. Ley 820 de 2003 prohibits setting rents above 1% of the property's commercial value (Article 18).
