Conforme al Artículo 40 de la Ley 100 de 1993, solicito la liquidación de la pensión de invalidez aplicando la siguiente fórmula:

• Si PCL entre 50% y 65.99%: 45% del IBL + 1.5% por cada 50 semanas adicionales sobre las primeras 500, hasta un máximo del 75% del IBL.

• Si PCL del 66% o más: 54% del IBL + 2% por cada 50 semanas adicionales sobre las primeras 800, hasta un máximo del 75% del IBL.

• Pensión mínima: un (1) Salario Mínimo Mensual Legal Vigente (SMMLV).

Si el saldo de la cuenta individual AFP no es suficiente para financiar la pensión calculada, solicito la aplicación del seguro previsional de vida e invalidez conforme al Artículo 65 de la Ley 100 de 1993 y el Decreto 2555 de 2010.

What Is a Disability Pension Application Colombia?

The Disability Pension Application Colombia (Solicitud de Reconocimiento de Pensión de Invalidez) is the formal written request a worker submits to Colpensiones (Régimen de Prima Media — RPM) or a private AFP (Régimen de Ahorro Individual con Solidaridad — RAIS) to obtain recognition and payment of a disability pension (pensión de invalidez) after suffering a loss of working capacity of 50% or more as a result of illness or non-occupational accident. Colombia's pensión de invalidez regime — governed by Articles 38 through 45 of Ley 100 de 1993 — is distinct from occupational disability benefits administered by the Administradoras de Riesgos Laborales (ARL) under Ley 1562 de 2012, which cover injuries and diseases arising from work-related causes.

Ley 100 de 1993 established a unified disability evaluation framework applicable to both RPM and RAIS. Article 38 defines an invalid worker (inválido) as one who has lost 50% or more of their normal working capacity (pérdida de capacidad laboral — PCL) due to disease or non-occupational accident. The PCL percentage is determined by a Junta de Calificación de Invalidez — an independent technical body regulated by Decreto 1352 de 2013 — which applies the Manual Único para la Calificación de la Pérdida de Capacidad Laboral y Ocupacional established by Decreto 1507 de 2014. The Juntas operate at two levels: Juntas Regionales de Calificación de Invalidez at the first instance, with appeals to the Junta Nacional de Calificación de Invalidez.

The PCL rating under Decreto 1507 de 2014 evaluates four components: (1) deficiencia (functional impairment of body structures and functions), (2) discapacidad (functional limitations in activities of daily living), (3) minusvalía (social disadvantage and participation restrictions), and (4) fecha de estructuración (date of onset of the disability, which determines the applicable contribution requirement). The combined weighting of these components produces the final PCL percentage. A rating of 50%-66% constitutes invalidez moderada; 66%-95% constitutes invalidez severa; above 95% constitutes invalidez total, which triggers the gran invalidez supplement under Article 45 of Ley 100 — an additional 15% of the monthly pension for workers requiring permanent assistance from a third person.

The pension amount under Article 40 of Ley 100 is calculated as a percentage of the Ingreso Base de Liquidación (IBL). For workers with a PCL between 50% and 65.99%, the pension equals 45% of the IBL plus 1.5% for each 50 weeks contributed above the first 500 weeks, capped at 75% of the IBL. For workers with a PCL of 66% or more, the pension equals 54% of the IBL plus 2% for each 50 weeks above the first 800 weeks, also capped at 75% of the IBL. The minimum disability pension cannot be less than one SMMLV per month.

The UGPP (Unidad de Gestión Pensional y Parafiscales) exercises supervisory authority over Colpensiones' and AFPs' compliance with disability pension obligations. The Ministerio de Salud y Protección Social through the Dirección de Riesgos Laborales oversees the Juntas de Calificación de Invalidez. Workers dissatisfied with the Junta Regional's PCL rating may appeal to the Junta Nacional within five business days of notification, and may subsequently seek judicial review before a labor court under the Código Procesal del Trabajo y de la Seguridad Social.

When Do You Need a Disability Pension Application Colombia?

The Disability Pension Application Colombia must be submitted in the following circumstances regulated by Ley 100 de 1993, Decreto 1352 de 2013, and Decreto 1507 de 2014.

After PCL Rating of 50% or More: Once the Junta Regional de Calificación de Invalidez has issued a dictamen (technical opinion) confirming a PCL of 50% or more, the affected worker must submit this application to Colpensiones (RPM workers) or their AFP (RAIS workers) within the limitation periods established by Ley 100. The dictamen is the mandatory prerequisite — no disability pension can be recognized without it.

Non-Occupational Origin Confirmed: The application applies when the disability results from common illness (enfermedad común) or non-occupational accident (accidente no laboral). If the disability originates from a work-related accident or occupational disease, the primary obligation falls on the ARL under Ley 1562 de 2012 Articles 5-8. When the ARL denies the occupational origin or when the ARL pension is inferior to the minimum pension, the worker may claim the supplementary pensión de invalidez from Colpensiones or the AFP.

Contribution Requirement Met (50 Weeks): Article 39 of Ley 100 as modified by Ley 860 de 2003 requires that the worker have contributed at least 50 weeks within the three years immediately preceding the date of structuring (fecha de estructuración) of the disability. Workers affiliated before March 27, 1994, must have contributed at least 150 weeks in the six years before the disability, or 300 weeks at any time prior.

Gran Invalidez Supplement: Workers whose PCL exceeds 95% — constituting gran invalidez under Article 45 of Ley 100 — must include in this application a specific request for the gran invalidez complement (15% additional monthly payment) to cover the costs of assistance required by a caregiver (persona asistente).

Appeal After ARL Denial: When the ARL has paid temporary disability benefits (incapacidad temporal) for up to 180 days and the worker's condition has not recovered sufficiently, the ARL must initiate the PCL qualification process. If the ARL denies the occupational origin or the resulting pension, the worker files this application with Colpensiones or the AFP as the alternate social security insurer.

What to Include in Your Disability Pension Application Colombia

The Junta Regional may request additional medical examinations before issuing its dictamen.

Contribution History: Certified historia laboral from Colpensiones or the AFP showing total weeks contributed, with particular attention to the 50-week requirement in the three years before the fecha de estructuración under Article 39 of Ley 100 (as modified by Ley 860 de 2003). Missing weeks from employer defaults must be reported to the UGPP for enforcement.
