What Is a Enforcement Proceedings Petition Colombia?

The Enforcement Proceedings Petition (Demanda de Proceso Ejecutivo) in Colombia is the formal judicial document through which a creditor — the ejecutante — initiates before the competent civil judge the special forced execution proceeding for a monetary or performance obligation, when the debtor — the ejecutado — has voluntarily defaulted and an executive title (título ejecutivo) exists meeting the requirements of Articles 422 to 424 of the Código General del Proceso (CGP — Ley 1564 de 2012). The executive process is the most agile procedural mechanism in the Colombian legal system for coercive debt collection, as unlike ordinary declarative proceedings, it does not require the judge to declare the creditor's right: the judge, upon verifying the existence of the executive title, directly orders the debtor to pay under threat of coercive measures such as embargo (attachment) and secuestro (seizure) of assets.

The executive title is the essential element of the enforcement proceeding. Article 422 of the CGP defines documents that constitute executive titles: those originating from the debtor or their predecessor (promissory notes, bills of exchange, protested cheques, contracts with clear and enforceable obligations); those issued by judges or administrative authorities (final judgments, executory arbitral awards, executory resolutions of public entities); and those expressly recognised by law as executive titles (accepted sales invoices under Article 773 of the Commercial Code, tax debt certifications from the DIAN under Article 828 of the Tax Code, condominium fee liquidations under Ley 675 de 2001).

The Colombian enforcement proceeding follows the procedure in Book 4 of the CGP (Articles 422-467). Once the petition is admitted and the executive title verified, the judge issues a mandamiento ejecutivo ordering the debtor to pay within five business days under threat of attachment and seizure of assets. The ejecutado may oppose through defences under CGP Article 442 within ten days of notification. If unopposed, the judge continues execution, orders auction of attached assets, and applies proceeds to the debt and costs.

Ley 2213 de 2022 introduced significant modifications to enforcement proceedings, permitting electronic notification of the mandamiento and virtual conduct of some proceedings, substantially accelerating the process in civil courts across Colombia.

When Do You Need a Enforcement Proceedings Petition Colombia?

An Enforcement Proceedings Petition in Colombia is appropriate when two essential conditions are met: the existence of a valid executive title and the enforceability of the obligation. The most common situations include: default on promissory notes and bills of exchange; unpaid sales invoices accepted by the buyer; non-compliance with court judgments and arbitral awards; non-payment of condominium administration fees; and enforcement of tax and parafiscal debts certified by the DIAN and UGPP. The petition may also be filed for obligations arising from notarial documents with executory force and from certain certified administrative resolutions. Before filing, the creditor must verify that the statute of limitations has not expired: three years for negotiable instruments under Commercial Code Article 789, ten years for ordinary civil obligations, and five years for commercial obligations under Article 1081.
