What Is a Habitual Residence Declaration Chile?

A Habitual Residence Declaration Chile is a formal sworn statement governed principally by Código Civil Article 59 and Decreto Ley N° 1.094 (Ley de Extranjería, published 19 July 1975 and substantially amended by subsequent legislation), by which a person officially certifies that they maintain their habitual residence (residencia habitual) in Chile — meaning they physically live and have their primary life centre in Chile, with the intention of remaining, regardless of whether they hold Chilean nationality or a particular immigration status.

Article 59 of the Código Civil establishes that the civil domicile of a person consists of their residence in a specific place, together with the real or presumed intention (ánimo) of remaining there permanently. The concept of residencia habitual is closely related to but legally distinct from domicilio civil — while domicilio requires both the physical element and the intention of permanence, residencia habitual is a factual concept focused on where the person actually lives as a matter of fact and habit, without necessarily requiring the formal animus element. Chilean courts, the Servicio Electoral (Servel), the Departamento de Extranjería, and the PDI (Policía de Investigaciones de Chile) each apply the concept of habitual residence within their respective regulatory frameworks.

Decree Law 1.094 — Chile's principal immigration statute — governs the entry, stay, and residence of foreign nationals in Chile. Articles 19 through 34 of DL 1.094 establish the categories of residency available to foreigners: sujeto a control de residencia (subject to residence control), residente temporario (temporary resident), residente con visa de residencia temporal (temporary residence visa holder), residente permanente (permanent resident), and ciudadano chileno (Chilean national). A Habitual Residence Declaration is required at multiple points in the immigration process — when applying for permanent residency (residencia definitiva) to demonstrate that the applicant has effectively been residing habitually in Chile; when renewing temporary residence visas; and when claiming rights and benefits available to persons with established habitual residence in Chile.

The immigration framework was substantially updated by Ley N° 21.325 (Ley de Migración y Extranjería, published 20 April 2021), which replaced DL 1.094 as the primary immigration law on an eventual basis. Ley N° 21.325 introduces new visa categories — visa de residencia temporal, visa de residencia de larga duración, and visa de reunificación familiar — and establishes that habitual residence is a key criterion for determining the applicable visa category and benefit entitlements under the new framework. The Servicio Nacional de Migraciones (SERMIG), created by Ley N° 21.325, is the administrative body replacing the Departamento de Extranjería under the new law.

The Habitual Residence Declaration is also used by Chilean nationals returning from extended periods abroad to re-establish their habitual residence in Chile — particularly for electoral roll (padrón electoral) registration with the Servel under Ley N° 18.556, tax domicile updates with the SII, and re-registration with the Servicio de Registro Civil e Identificación for a new cédula de identidad.

When Do You Need a Habitual Residence Declaration Chile?

A Habitual Residence Declaration Chile is required in numerous legal and administrative contexts where establishing or proving habitual residence in Chilean territory is a precondition for obtaining rights, benefits, permits, or legal recognition.

Immigration proceedings are the primary use case. Foreign nationals applying for permanent residency (residencia definitiva) under DL 1.094 — after completing the required period of temporary residence (typically two years of continuous temporary residency) — must demonstrate that they have been habitually resident in Chile throughout that period. The Departamento de Extranjería e Inmigración and the SERMIG require a formal Habitual Residence Declaration supported by utility bills, lease agreements, employer certificates, and other documentation confirming continuous physical presence in Chile. For family reunification visa applications, the sponsor (reunificante) must demonstrate their own habitual residence in Chile.

Electoral registration with the Servicio Electoral (Servel) under Ley N° 18.556 requires that Chileans resident abroad who wish to vote in Chile register their habitual residence in Chile. Returning Chileans must update their electoral domicile — and a Habitual Residence Declaration supports the Servel registration process.

Pension and social security benefits — particularly from the AFP system under DL 3.500 and the IPS (Instituto de Previsión Social) — may require proof of habitual residence in Chile for the beneficiary to receive payments domestically. AFP retirement pensions (pensiones de vejez) and survivor pensions (pensiones de sobrevivencia) are administered from Chile, and beneficiaries residing abroad may face additional requirements.

Court proceedings under the CPC frequently require parties to establish their habitual residence in Chile to determine procedural jurisdiction (competencia territorial) under CPC Article 134 and to comply with notification requirements. A Habitual Residence Declaration provides supplementary evidence in cases where the official address registered with the SII or Registro Civil differs from the actual place of residence.

What to Include in Your Habitual Residence Declaration Chile

A valid Habitual Residence Declaration Chile under Código Civil Article 59 and DL 1.094 must contain the following essential elements:

Declarant Full Identification: Full legal name as it appears in the cédula de identidad or passport, RUT (or foreign identification number — NIE — issued by the PDI for foreign nationals), nationality, date and place of birth, and current immigration status (for foreign nationals — visa type, visa number, and expiration date as recorded by the PDI and the Departamento de Extranjería).

Excessive absences (ausencias prolongadas) may break the continuity of residence required for permanent residency.

Purpose of the Declaration: The specific legal purpose for which the declaration is being made — immigration application, electoral registration, judicial proceedings, social security application, or other administrative purpose. This helps the receiving authority assess the relevance of the declaration to the procedure.

Supporting Evidence Referenced: The declaration should reference corroborating documents — utility bills, lease agreement or property title, certificate of employment, bank statements, school enrollment certificates, or medical records — that confirm the factual basis of the declared habitual residence.
