What Is a Construction Supervision Contract Mexico (Contrato de Supervisión de Obra)?

A Construction Supervision Contract Mexico (Contrato de Supervisión de Obra) is a professional services agreement by which a property owner (propietario or comitente) engages a qualified supervisor (supervisor de obra) — typically a licensed civil engineer (ingeniero civil) or architect (arquitecto) registered with the Dirección de Obras Públicas — to independently oversee, inspect, and verify the execution of a construction project on behalf of the owner. The agreement is governed by Código Civil Federal Article 2616, which classifies construction supervision as a professional services contract (contrato de prestación de servicios profesionales) in which the supervisor exercises technical judgment and professional expertise rather than physically performing the construction work.

The Contrato de Supervisión de Obra fulfils a distinct function from the main construction contract (contrato de obra): while the contratista (general contractor) builds the structure, the supervisor acts as the owner's independent technical representative on site, verifying that the contractor executes the work in strict accordance with the approved architectural and engineering plans (planos arquitectónicos y estructurales), technical specifications (especificaciones técnicas), the licensed construction project (licencia de construcción) issued by the Dirección de Obras Públicas Municipal, and applicable Normas Oficiales Mexicanas (NOMs) including NOM-006-STPS-2014 (construction safety), NOM-031-SSA3-2012 (healthcare facility construction), and the Reglamento de Construcciones del municipio or Distrito Federal.

In Mexico, the supervision function is particularly important because the Sistema de Desarrollo Urbano Municipal requires that all residential constructions of over 200 m² and all commercial and industrial projects have a Director Responsable de Obra (DRO) — a licensed architect or civil engineer who assumes legal and technical responsibility before the municipal authority for the construction's compliance with the licencia de construcción and applicable safety codes (reglamentos de construcción). The DRO may be either the supervisor engaged under this agreement or a separate professional. The Reglamento de Construcciones para el Distrito Federal (RCDF), widely used as a model code, and equivalent state regulations establish the DRO's obligations, liability, and professional registration requirements with the Sociedad de Arquitectos Mexicanos (SAM) or Colegio de Ingenieros Civiles de México (CICM).

Mexican construction projects above defined thresholds are also subject to quality inspection by the Comisión Federal de Electricidad (CFE) for electrical installations, CONAGUA for water and drainage connections, and the Secretaría del Medio Ambiente y Recursos Naturales (SEMARNAT) for projects in environmentally sensitive zones. The supervisor coordinates all third-party inspections and maintains a bitácora de obra (construction logbook) — a daily record of work progress, materials delivered, workforce levels, weather conditions, and incidents, which is a mandatory document under municipal construction regulations and is the primary evidence of construction progress for dispute resolution purposes.

The Ley Federal del Trabajo (LFT) Article 7 requires that in projects with more than 5 workers, the employer register all workers with the Instituto Mexicano del Seguro Social (IMSS). The supervisor's role includes verifying contractor compliance with LFT worker registration, IMSS affiliation, and NOM-031-STPS-2011 construction safety standards — failures in which can expose the property owner to joint liability (responsabilidad solidaria) under LFT Article 13 for outsourced construction services.

When Do You Need a Construction Supervision Contract Mexico (Contrato de Supervisión de Obra)?

A Construction Supervision Contract Mexico is required in a wide range of construction scenarios where the property owner lacks the technical expertise, time, or presence to personally verify that construction is being carried out correctly and in compliance with approved plans and regulations.

Residential construction projects: Homeowners building custom houses (casas habitación) or undertaking major renovations (remodelaciones) involving structural work, additions, or changes of use require independent supervision to protect their investment and ensure the contractor delivers the agreed quality. Without independent supervision, defects in foundations, structural elements, waterproofing, or electrical and plumbing installations may not be discovered until after final payment is made.

Commercial and industrial developments: Property developers, hotel operators, and industrial park owners undertaking commercial or industrial construction engage supervisors to control quality, monitor the construction schedule (programa de obra), and manage the payment certification process — verifying that the contractor's progress estimates (estimaciones de avance de obra) accurately reflect work actually completed before authorising payments.

Public and infrastructure works: Under the Ley de Obras Públicas y Servicios Relacionados con las Mismas (LOPSRM) Article 84, federal and state government agencies are required to engage independent supervisory services for public construction contracts above defined thresholds. Municipal governments contract supervision services under the Ley de Adquisiciones, Arrendamientos y Servicios del Sector Público (LAASSP) or equivalent state laws.

Multifamily and condominium projects: Real estate developers constructing apartment buildings (edificios plurifamiliares) or condominium complexes must maintain independent supervision records to satisfy the Dirección de Desarrollo Urbano Municipal, obtain the Constancia de Terminación de Obra (construction completion certificate), and comply with the Ley de Condominios of the applicable state before the condominium regime can be legally established.

Bank-financed construction: Financial institutions (bancos) and INFONAVIT/FOVISSSTE providing créditos para autoconstrucción require property owners to engage a certified supervisor, who issues progress certificates (dictámenes de avance) that trigger disbursements of the construction loan tranches. Without a supervisor's periodic certificates, the bank will not release construction funds.

Heritage and historic property renovation: Projects in zones declared zonas de monumentos históricos by the Instituto Nacional de Antropología e Historia (INAH) or the Instituto Nacional de Bellas Artes (INBA) require supervisors who can verify compliance with INAH/INBA restoration standards alongside the RCDF or state Reglamento de Construcciones. Environmental impact projects requiring SEMARNAT Manifestación de Impacto Ambiental (MIA) also require documented supervision to demonstrate compliance with the environmental authorisation conditions during construction — the supervisor's bitácora de obra is accepted as evidence of compliance in SEMARNAT follow-up inspections.

What to Include in Your Construction Supervision Contract Mexico (Contrato de Supervisión de Obra)

A valid Construction Supervision Contract Mexico under CCF Article 2616 and applicable professional services regulations must include the following key provisions.

Identification of Parties: Full legal name, RFC, professional licence number (cédula profesional), and domicile of the property owner (comitente) and the supervisor (supervisor de obra). The supervisor's professional registration with the Colegio de Ingenieros Civiles de México (CICM) or Colegio de Arquitectos, and their registration as Director Responsable de Obra (DRO) with the Dirección de Obras Públicas Municipal if applicable, must be stated.

Scope of Supervision Services: Precise description of the construction project subject to supervision — address, type of project (obra nueva, ampliación, remodelación), total contracted construction value (monto de la obra), and the approved plans and specifications that serve as the technical reference for the supervisor's work. The supervisor's specific duties must be listed: periodic site visits (frequency and duration), review of construction materials, verification of compliance with NOMs and the licencia de construcción, review and approval/rejection of contractor's progress estimates (estimaciones), and coordination with municipal inspectors.

Bitácora de Obra: Obligation to maintain a daily construction logbook (bitácora de obra) in the format required by the Reglamento de Construcciones of the applicable municipality. The bitácora records all instructions, non-conformances (no conformidades), material approvals, and incidents. Under the RCDF and equivalent state regulations, the bitácora is an official document shared between the DRO, the construction company, and the municipal authority — digital bitácoras are now accepted in CDMX and several other states through the Sistema Electrónico de Trámites (SET).

Supervisor's Fees and Payment Schedule: The agreed supervision fee — either a fixed monthly retainer (honorarios mensuales fijos), a percentage of the total contracted construction value (typically 3–5% of obra value), or a per-visit fee (honorarios por visita). Payment schedule tied to milestones or monthly billing. Under CCF Article 2616, professional fees must be reasonable given the professional's qualifications, the complexity of the work, and local customs. All fees are subject to IVA at 16% and must be invoiced via CFDI under Artículo 29 of the Código Fiscal de la Federación (CFF).

Professional Liability and Insurance: The supervisor's liability for errors or omissions (errores u omisiones) in the exercise of professional judgment — limited to cases of negligence or professional misconduct under CCF Articles 2615–2616. Requirement for the supervisor to maintain professional liability insurance (seguro de responsabilidad profesional) if the project value exceeds defined thresholds. Exclusions — the supervisor is not responsible for defects caused by contractor execution errors not identified during scheduled visits, or by materials approved by the owner independently.

Reporting Obligations: Format and frequency of written supervision reports — weekly or bi-weekly progress reports (informes de avance), photographic documentation, non-conformance reports (reportes de no conformidad), and the final completion report (informe final de obra) certifying that the completed construction complies with the approved plans. The final report is required by the Dirección de Obras Públicas Municipal to issue the Constancia de Terminación de Obra.

NOM Compliance Verification: The supervisor's obligation to verify compliance with applicable NOMs throughout construction — including NOM-031-STPS-2011 (construction site safety), NOM-001-SEDE-2012 (electrical installations), NOM-002-SCFI-2011 (plumbing), and sector-specific NOMs for the project type. Non-conformances identified during supervision visits must be documented in the bitácora de obra and resolved by the contractor before the supervisor certifies the corresponding progress estimate.
